of the condition should be transmitted to the appropriate vice president or designee who will make the<br />

determination if the information should be further disseminated. It should be remembered that mere exposure to<br />

the person in a classroom does not constitute a need to know the diagnosis. It is, therefore, unnecessary to<br />

document in a student's file the fact that he or she has AIDS unless the information is to be used for accommodation<br />

reasons. Sharing confidential information without consent may create legal liability.<br />

Students are encouraged to contact the Office of Disabled Resources <strong>and</strong> Services <strong>and</strong>/or the vice president of<br />

student affairs or designee for the types of services available in the district or community on matters regarding AIDS<br />

or the HIV virus.<br />

4.12 Smoke‐Free/Tobacco‐Free Environment<br />

The Maricopa County <strong>Community</strong> College District is dedicated to providing a healthy, comfortable, <strong>and</strong> educationally<br />

productive environment for students, employees, <strong>and</strong> visitors. In order to promote a healthy learning <strong>and</strong> work<br />

environment, the Chancellor has directed that the Maricopa County <strong>Community</strong> College District serve as a total smoke<br />

free <strong>and</strong> tobacco free environment, effective July 1, 2012. Smoking (including the use of “e‐cigs”) <strong>and</strong> all uses of tobacco<br />

shall be prohibited from all District owned <strong>and</strong> leased property <strong>and</strong> facilities, including but not limited to parking lots,<br />

rooftops, courtyards, plazas, entrance <strong>and</strong> exit ways, vehicles, sidewalks, common areas, grounds, athletic facilities, <strong>and</strong><br />

libraries.<br />

Support signage prohibiting the use of smoking instruments <strong>and</strong> tobacco shall be placed throughout all college <strong>and</strong><br />

District locations.<br />

Continued violations by an employee or student shall be h<strong>and</strong>led through the respective conduct procedures established<br />

for employees <strong>and</strong> students.<br />

Appendix S‐16: Statement on the Arizona Medical Marijuana Act (Proposition 203)<br />

In 2010, Arizona voters approved the Arizona Medical Marijuana Act (Propositions 203), a state law permitting<br />

individuals to possess <strong>and</strong> use limited quantities of marijuana for medical purposes. Because of its obligations under<br />

federal law, however, the Maricopa <strong>Community</strong> Colleges will continue to prohibit marijuana possession <strong>and</strong> use on<br />

campus for any purpose.<br />

Under the Drug Free Workplace Act of 1988, <strong>and</strong> the Drug Free Schools <strong>and</strong> Communities Act of 1989, “…no institution<br />

of higher education shall be eligible to receive funds or any other form of financial assistance under any federal<br />

program, including participation in any federally funded or guaranteed student loan program, unless it has adopted <strong>and</strong><br />

has implemented a program to prevent the use of illicit drugs <strong>and</strong> abuse of alcohol by students <strong>and</strong> employees.”<br />

Another federal law, the Controlled Substances Act, prohibits the possession, use, production, <strong>and</strong> distribution of<br />

marijuana for any <strong>and</strong> all uses, including medicinal use. This law is not affected by the passage of the Arizona Medical<br />

Marijuana Act. Because Maricopa <strong>Community</strong> Colleges could lose its eligibility for federal funds if it fails to prohibit<br />

marijuana, it is exempt from the requirements of the Arizona Medical Marijuana Act. Therefore, Maricopa <strong>Community</strong><br />

Colleges will continue to enforce its current policies prohibiting the unlawful manufacture, distribution, dispensation,<br />

possession, or use of a controlled substance on its property or as part of any of its activities.<br />

Employees <strong>and</strong> students who violate Maricopa <strong>Community</strong> Colleges policy prohibiting the use or possession of illegal<br />

drugs on campus will continue to be subject to disciplinary action, up to <strong>and</strong> including expulsion from school <strong>and</strong><br />

termination of employment.<br />
