LICENSING AND DISCLOSURE: MAKING THE TRANSITION TO THE <strong>FSR</strong> REGIME<br />
18 We want <strong>to</strong> provide you with guidance about our plans for policy <strong>and</strong><br />
processes as soon as we can <strong>to</strong> help you plan effectively. While we have<br />
done our best <strong>to</strong> cover <strong>the</strong> main issues, you will need <strong>to</strong> make your own<br />
preparation plans. It is possible we have missed some key issues or have<br />
not taken in<strong>to</strong> account <strong>the</strong> way <strong>the</strong> new legislation will significantly<br />
affect specific industry situations.<br />
19 We are keen <strong>to</strong> hear from you on our general approach, <strong>and</strong> what<br />
might be missing from it, as well as your answers <strong>to</strong> <strong>the</strong> specific<br />
questions below.<br />
Question 1<br />
Do you consider that any interpretation of <strong>the</strong> law in this guide<br />
is materially incorrect? If so, where? How should our<br />
interpretation be amended <strong>and</strong> why?<br />
Question 2<br />
Are <strong>the</strong>re any inconsistencies between <strong>the</strong> old regula<strong>to</strong>ry<br />
<strong>regime</strong>s <strong>and</strong> <strong>the</strong> new regula<strong>to</strong>ry <strong>regime</strong> that would make it<br />
impossible <strong>to</strong> comply with <strong>the</strong> old <strong>and</strong> <strong>the</strong> new regula<strong>to</strong>ry<br />
<strong>regime</strong>s at <strong>the</strong> same time, as required under <strong>the</strong> <strong>transition</strong>al<br />
provisions? If yes, please specify <strong>and</strong> explain why it is not<br />
possible <strong>to</strong> comply with <strong>the</strong> old <strong>and</strong> new regula<strong>to</strong>ry <strong>regime</strong>.<br />
Please include in your answer what arrangements you have<br />
considered that might allow you <strong>to</strong> comply with <strong>the</strong> old <strong>and</strong> new<br />
regula<strong>to</strong>ry <strong>regime</strong>s.<br />
20 We will consider any comments on this guide in <strong>the</strong> development,<br />
issue <strong>and</strong> review of any <strong>transition</strong>al provisions policy <strong>and</strong> any fur<strong>the</strong>r<br />
guidance that we issue, such as <strong>the</strong> AFS <strong>Licensing</strong> Kit. At this time, we<br />
do not intend <strong>to</strong> issue ano<strong>the</strong>r version of this guide.<br />
