1.2.15 As a result, under <strong>the</strong> <strong>transition</strong>al provisions, after <strong>FSR</strong><br />

commencement a representative of a current financial service<br />

provider in respect of <strong>the</strong> principal’s existing <strong>and</strong> new activities<br />

will be subject <strong>to</strong> <strong>the</strong> principal’s old regula<strong>to</strong>ry <strong>regime</strong> <strong>and</strong> <strong>the</strong><br />

new regula<strong>to</strong>ry <strong>regime</strong> at <strong>the</strong> same time.<br />

R is a representative of P, a securities dealer licensed under <strong>the</strong> old<br />

Corporations Act.<br />

P decides <strong>to</strong> exp<strong>and</strong> its business <strong>and</strong> obtains an AFS licence covering its<br />

proposed new commodity derivatives trading activities 6 months after <strong>FSR</strong><br />

commencement. P authorises R under <strong>the</strong> new regula<strong>to</strong>ry <strong>regime</strong> in relation <strong>to</strong><br />

those new activities. From this time, P <strong>and</strong> R are subject <strong>to</strong> <strong>the</strong> new regula<strong>to</strong>ry<br />

<strong>regime</strong> in respect of <strong>the</strong> commodity derivatives trading activities, but P <strong>and</strong> R<br />

remain subject <strong>to</strong> <strong>the</strong>ir old regula<strong>to</strong>ry <strong>regime</strong>, <strong>the</strong> old Corporations Act, in<br />

respect of <strong>the</strong>ir securities activities.<br />

P obtains an AFS licence covering its securities activities 12 months after <strong>FSR</strong><br />

commencement. P authorises R under <strong>the</strong> new regula<strong>to</strong>ry <strong>regime</strong> in relation <strong>to</strong><br />

those activities. From this time, P <strong>and</strong> R are subject <strong>to</strong> <strong>the</strong> new regula<strong>to</strong>ry<br />

<strong>regime</strong> in respect of <strong>the</strong> securities activities, as well as <strong>the</strong> commodity<br />

derivatives trading activities.<br />

1.2.16 Similarly, under <strong>the</strong> <strong>transition</strong>al provisions, after <strong>FSR</strong><br />

commencement a representative of two or more current financial<br />

service providers who obtain an AFS licence at different times<br />

will be subject <strong>to</strong> <strong>the</strong> principals’ old regula<strong>to</strong>ry <strong>regime</strong>(s) <strong>and</strong><br />

<strong>the</strong> new regula<strong>to</strong>ry <strong>regime</strong> at <strong>the</strong> same time.<br />

Example A<br />

Before <strong>FSR</strong> commencement, R is an insurance multi-agent who acts on behalf<br />

of two life insurers, A <strong>and</strong> B.<br />

A obtains an AFS licence 1 month after <strong>FSR</strong> commencement. R chooses <strong>to</strong><br />

lodge an opt-in notice with ASIC under s1436A in respect of its authorising<br />

agreement with A, stating that it does not want <strong>the</strong> IABA <strong>to</strong> apply <strong>to</strong> it from 1<br />

month after <strong>FSR</strong> commencement.<br />
