Any such replacement will be effected at no additional cost to the Agency.<br />

In case of replacement, the Contractor must propose a minimum of two replacement<br />

persons with the equivalent qualifications and experience and as required for the<br />

profile. If the Contractor does not propose suitable replacement staff, the Agency may<br />

immediately terminate the specific contract.<br />

On the Agency’s demand, during holidays or other periods of planned absence by the<br />

person employed, the Contractor will be required to provide an adequate replacement.<br />

The replacement person will be given sufficient training and provided with all<br />

information necessary to guarantee continuity of the service provided to the Agency.<br />

All such training and handover work will be carried out at the Contractor's expense.<br />

When a person is no more available before the start of a new specific contract, the<br />

Contractor is obliged to inform the Agency immediately and provide adequate<br />

replacement as indicated above.<br />

The invoicing requires the acceptance of the deliverables by the Agency, and is based<br />

on real workload of the profiles used in the specific contract. The request for payment<br />

of the Contractor shall be admissible if accompanied by a report specifying the tasks,<br />

deliverables accepted by the Agency, as well as the worked days per resource.<br />

<strong>ECHA</strong> reserves the right to ask for additional proof in the form of diplomas, certificates<br />

and references of studies, training, technical competence and work experience<br />

alleged in the CV of candidates proposed for a specific contract. <strong>ECHA</strong> reserves the<br />

right to take into account only the studies, training, technical competence and work<br />

experience, for which sufficient evidence has been provided, as evaluated by <strong>ECHA</strong>.<br />

All infrastructure of the Contractor containing <strong>ECHA</strong> related information and<br />

connections to it must be properly secured.<br />

If the work is performed off site on the contractor’s premises, the Contractor shall<br />

provide all necessary infrastructures on his premises (hardware and software 16 ) for<br />

the successful execution of the work. In many cases this will mean at least three<br />

functional testing systems, of which one is suitable for performance testing, in addition<br />

to all other development / unit testing systems.<br />

The security and confidentiality issues will be addressed as described on section 1.14.<br />

On request of the Agency, during the execution of the specific contract, the Contractor<br />

will provide <strong>ECHA</strong> remote access to the off site infrastructure for Quality Assurance<br />

purposes. This includes access to the actively used test environments and the<br />

systems reporting the quality metrics and the systems used for test planning and test<br />

follow-up.<br />

The Contractor is responsible for all software and hardware required to set up the<br />

infrastructure at his premises for the implementation of the specific contracts. In case<br />

of intellectual property rights infringements occurred, the Contractor undertakes full<br />

liability.<br />
