During the past year you have on several occasions been convicted of hazardous violations of the traffic laws. This places you dangerously close to being categorized as a negligent operator in accordance with Section 12810 of the Vehicle Code. This section empowers – and in fact obligates – the Department of Motor Vehicles to utilize its discretionary authority in taking hazardous drivers off the streets and highways. Statistics clearly indicate that irresponsible driving patterns such as yours often result in the maiming of innocent people and in destruction of human life. Thus we cannot – and will not – tolerate negligent and hazardous driving on the streets and highways of this state. Violation of traffic laws must cease or the Department will be forced to take harsh measures against your driving privilege. The revocation or even restriction of one’s license can result in severe personal and economic disaster. Your record will henceforth be placed in an action pending file and reviewed by the Department on a periodic basis to determine if restrictive measures will be necessary. It is never too late to improve, but in your case, improvement must be immediate if restrictive action is to be avoided. My review of your record indicates that during the past year you have been convicted on several occasions of violations of the traffic laws. Since you are very close to the legal definition of a negligent driver, I must make a recommendation to the Department as to what we should do about you. I know from years of experience that some drivers with records like yours are a danger to themselves, their loved ones, and their community. In addition, there is always the danger of financial loss. I am sure you must realize the important responsibility which the Department and I have to keep unsafe drivers off our highways. I am counting on you to show me that you can drive in a safe, responsible manner. I will personally check your record for improvement to determine if further action is necessary. It has been my experience that drivers like you can improve if they really try. Remember, now is the time for you to improve your driving – not later.
