(Warning Letter)<br />

In reviewing your traffic record, we find that on several occasions you have violated<br />

traffic laws relating <strong>to</strong> <strong>the</strong> safe operation <strong>of</strong> mo<strong>to</strong>r vehicles. The California Vehicle Code<br />

contains <strong>the</strong> following definition.<br />

“Any person whose driving record shows a violation point count <strong>of</strong> four or more points<br />

in 12 months, six or more points in 24 months, or eight or more points in 36 months<br />

shall be prima facie presumed <strong>to</strong> be a negligent opera<strong>to</strong>r <strong>of</strong> a mo<strong>to</strong>r vehicle.<br />

Any accident in which <strong>the</strong> opera<strong>to</strong>r is deemed by <strong>the</strong> Department <strong>to</strong> be responsible<br />

shall be given a value <strong>of</strong> one point.”<br />

This does not mean that a driver is “entitled” <strong>to</strong> receive any specific number <strong>of</strong> traffic<br />

citations within a given period without action by <strong>the</strong> Department, nor does it imply that<br />

<strong>the</strong> Department condones even one violation.<br />

Your record is brought <strong>to</strong> your attention by this letter. If you continue <strong>to</strong> violate traffic<br />

laws and drive in a negligent or unsafe manner, you risk <strong>the</strong> suspension or revocation<br />

<strong>of</strong> your driving privilege.<br />

Driving is a privilege not a right. When <strong>the</strong> safety <strong>of</strong> persons using <strong>the</strong> highways is<br />

jeopardized by unsafe driving, it becomes <strong>the</strong> duty <strong>of</strong> <strong>the</strong> State <strong>to</strong> take away such<br />

privilege. You will protect your driving privilege by complying with <strong>the</strong> traffic laws<br />

and by following safe driving practices.<br />

No action is being taken in your case at this time for we believe that you can and will<br />

drive without fur<strong>the</strong>r traffic law violations and <strong>the</strong>reby reduce <strong>the</strong> possibility <strong>of</strong> an<br />

accident in <strong>the</strong> future.<br />

Always drive with <strong>the</strong> safety <strong>of</strong> yourself and o<strong>the</strong>rs foremost in your mind:<br />
