medication until after <strong>the</strong> release <strong>of</strong> <strong>the</strong> results <strong>of</strong> <strong>the</strong> WHI study on July 9, 2002.<br />

Coleman<br />

Plaintiff Elizabeth Coleman was diagnosed with breast cancer on October 20,<br />

2000. R.437a. She and her husband filed suit against Wyeth and Upjohn on June<br />

28, 2004. R.8a. The Coleman action was selected as a bellwe<strong>the</strong>r case for <strong>the</strong> first<br />

round <strong>of</strong> hormone <strong>the</strong>rapy trials in <strong>the</strong> <strong>Court</strong> <strong>of</strong> Common Pleas <strong>of</strong> Philadelphia<br />

County. Thus, unlike <strong>the</strong> o<strong>the</strong>r 13 consolidated cases, in Coleman a substantial<br />

amount <strong>of</strong> discovery has occurred.<br />

On September 24, 2007, shortly before trial in <strong>the</strong> Coleman case was to begin,<br />

Judge Tereshko granted Wyeth’s motion for summary judgment on statute <strong>of</strong><br />

limitations grounds, which had been filed in February <strong>of</strong> that year.<br />

<strong>In</strong> granting Wyeth’s motion, Judge Tereshko relied on <strong>the</strong> following<br />

deposition testimony by Mrs. Coleman:<br />

Q: Have any <strong>of</strong> your doctors told you that <strong>the</strong>y think your breast<br />

cancer was caused by taking hormone <strong>the</strong>rapy?<br />

A: Not in so many words, no.<br />

Q: Have <strong>the</strong>y told you in any way?<br />

A: Well, I was told that it was estrogen positive.<br />

Q: Do you interpret that to mean — by somebody telling you<br />

“estrogen positive,” do you interpret that to mean that <strong>the</strong>y think your<br />

breast cancer is caused by hormones?<br />

A: I don’t know.<br />
