Sandwich, to view the lands, "and make report there<strong>of</strong> unto the<br />

Court, that if these proportions which Mr. Andrew Hellott hath<br />

assumed to himself there shall be so p'judiciall to the whole, that<br />

then some just and equall order be taken therein, to prevent the<br />

evil consequences it may be to the whole pla)»tation."<br />

No report <strong>of</strong> the committee is on record, and it would appear<br />

from the subsequent action <strong>of</strong> the Court that Mr. Hallett had not<br />

"assumed to himself" a greater proportion <strong>of</strong> the planting lauds<br />

than he had a right to claim. On the 5th <strong>of</strong> May, 1639, the<br />

Court Ordered, "that the proportion <strong>of</strong> lands granted to Mr. Andrew<br />

Hellott, at Mattacheesett, shal be and remain unto him, and<br />

those that are appoynted to set forth the bounds betwixt Mattacheese<br />

and Mattacheeset shall lay forth the said proportion unto<br />

him in a convenient plase there." (Coart Orders, vol. 1, page<br />

121).<br />

The two hundred acre lot <strong>of</strong> Mr. Hallett was laid out, approved<br />

by the Court and recorded Sept. 3, 1639. A particular<br />

description <strong>of</strong> this lot is given in the account <strong>of</strong> the Gorham family,<br />

who were afterwards the principal owners. June 17, 1641, a<br />

new boundary line was run between <strong>Barnstable</strong> and Yarmouth.<br />

This line divided the Hallett farm into two parts ; the larger in<br />

<strong>Barnstable</strong> contained 150 acres, and the smaller in Yarmouth containing<br />

forty-four acres.<br />

Oct. 7, 1639, "It was ordered by the Court that the seventeen<br />

acres <strong>of</strong> meadow lying at the Stony Cove (Mill Pond) in<br />

Yarmouth, shall be laid forth for Mr. Andrew Hellott, on the<br />

south west side <strong>of</strong> the said Cove, and if it want <strong>of</strong> that proportion,<br />

then to be made up on the other side, and ten acres more<br />

upon the Stony Cove Neck."<br />

Mr. Hallett's name first appears on record in March 1638-9,<br />

but he had probably then been in the country several years. He<br />

was then a resident in Plymouth, where he had a dwelling-house<br />

and seven and one-half acres <strong>of</strong> land situate on the "new street."<br />

This estate he sold to Thomas Cushman, who conveyed it to<br />

Thomas Lettis March 28, 1641-2.<br />

Nov. 25, 1639, Mr. Hallett bought for £10 sterling, <strong>of</strong> Dr.<br />

Thomas Starr, <strong>of</strong> Duxbury, seventeen acres <strong>of</strong> land in Yarmouth,<br />

in two divisions, and twelve acres <strong>of</strong> meadow "with the frame <strong>of</strong><br />

a house to be set and made with a chimney, and to be thached,<br />

studded and latched, (daubing excepted) by William Chase, who<br />

was agreed with all and paid to the doing there<strong>of</strong> by the said<br />

Thomas Starr, before the bargain was made with Mr. Hallett."<br />

[Deeds, page 50.] No boundaries are given in the deed. The<br />

houselot was at the north west corner <strong>of</strong> the town <strong>of</strong> Yarmouth,<br />

and adjoined his "great lot" on the west, south by the highway,<br />

east by by the lot <strong>of</strong> Robert Dennis, and north by the mill pond.<br />

It is now owned by Joshua Hallett and others. The other divis-
