Webster, then Secretary <strong>of</strong> State, asking that he would signify his accept-<br />

ance or rejection <strong>of</strong> the appointment. He received, also, letters from the<br />

Hon. Alex<strong>and</strong>er Barrow, then Senator from Louisiana, <strong>and</strong> others, urging<br />

his acceptance <strong>of</strong> this place as a stepping-stone to the Supreme Bench <strong>of</strong><br />

the United States. He however thought it his duty to dechne the <strong>of</strong>fice.<br />

He was controlled in the matter by the necessities <strong>of</strong> an already large <strong>and</strong><br />

growing family. In 1853, under the new Constitution, which made the<br />

Judges <strong>of</strong> the Supreme Court elective, he was nominated by the Whigs for<br />

a seat upon that Bench as Associate Justice ; <strong>and</strong>, although the State was<br />

at that time decidedly Democratic, <strong>and</strong> several Whig c<strong>and</strong>idates were in<br />

the field, against a single <strong>and</strong> most formidable Democratic opponent, the<br />

Hon. Miles Taylor, he was elected by a small majority—the town <strong>of</strong><br />

Carrolton, near which he lived, forgetting political distinctions, <strong>and</strong> giving<br />

him an almost undivided vote. He held his place on the Supreme Bench<br />

only two years, being compelled to resign on account <strong>of</strong> the inadequacy <strong>of</strong><br />

the salary. Mr. Ogden died Aug. —, 1875.' "*<br />

" Daniel Haines was born in the city <strong>of</strong> New York in the year 1801,<br />

<strong>and</strong> descended from a family <strong>of</strong> that name who were <strong>of</strong> the earliest settlers<br />

<strong>of</strong> Elizabethtown, N. J. Graduated at Princeton 1820, admitted to the<br />

Bar 1823, Counsellor at Law 1826, Sergeant at Law 1837. Was Governor<br />

<strong>of</strong> New Jersey 1843-5 ^"d 1847-9, ^"^^ Associate Justice <strong>of</strong> the Supreme<br />

Court <strong>of</strong> New Jersey 1852-66. He was a prominent member <strong>of</strong> the<br />

General Assembly <strong>of</strong> the Presbyterian Church, <strong>and</strong> as a Member <strong>of</strong> the<br />

Bible Society <strong>and</strong> other societies <strong>of</strong> a religious or benevolent character was<br />

always prompt to render the aid <strong>of</strong> his influence <strong>and</strong> active exertions.<br />
