adopted by the Secretary. The second way that the definition <strong>of</strong> Certified EHR<br />

Technology can be met is if each constituent EHR Module <strong>of</strong> a combination <strong>of</strong> EHR<br />

Modules has been tested and certified in accordance with the <strong>certification</strong> program<br />

established by the National Coordinator as having met all applicable <strong>certification</strong> criteria<br />

adopted by the Secretary and the resultant combination also meets the requirements<br />

included in the definition <strong>of</strong> a Qualified EHR.<br />

As previously written, it was unclear to many commenters that the comma<br />

preceding “each <strong>of</strong> which” was meant to separately apply a Complete EHR and<br />

“combination <strong>of</strong> EHR Modules” to the subsequent requirements. Our intention was that a<br />

combination <strong>of</strong> EHR Modules would have to provide the capabilities necessary to meet<br />

the definition <strong>of</strong> a Qualified EHR and that the EHR Modules combined would have each<br />

been tested and certified in accordance with the <strong>certification</strong> criteria applicable to each<br />

EHR Module.<br />

In response to commenters, we have decided to revise the definition <strong>of</strong> Certified<br />

EHR Technology to state explicitly the two distinct ways the definition can be met. The<br />

revised definition will read as follows. Certified EHR Technology means:<br />

1) A Complete EHR that meets the requirements included in the definition <strong>of</strong> a<br />

Qualified EHR and has been tested and certified in accordance with the <strong>certification</strong><br />

program established by the National Coordinator as having met all applicable<br />

<strong>certification</strong> criteria adopted by the Secretary; or<br />

2) A combination <strong>of</strong> EHR Modules in which each constituent EHR Module <strong>of</strong> the<br />

combination has been tested and certified in accordance with the <strong>certification</strong> program<br />

established by the National Coordinator as having met all applicable <strong>certification</strong> criteria<br />
