1.19 Confidentiality and Independent CONTRACTOR Status<br />

INTRODUCTION<br />

CONTRACTOR shall be required to comply with the Confidentiality provision<br />

contained in Sub-paragraph 7.5 in Appendix A, Sample Contract and the<br />

Independent CONTRACTOR Status provision contained in Sub-paragraph 8.22<br />

in Appendix A, Sample Contract.<br />

CONTRACTOR shall ensure that it obtains and submits to the COUNTY, a<br />

signed “CONTRACTOR Employee Acknowledgement and Confidentiality” as<br />

specified in Appendix A, Sample Contract, Exhibit G2, for each employee<br />

performing services under the Contract before execution of the Contract.<br />

CONTRACTOR shall also ensure that it obtains and submits to the COUNTY, a<br />

signed “CONTRACTOR Non-Employee Acknowledgement and Confidentiality”<br />

as specified in Appendix A, Sample Contract, Exhibit G3, for each nonemployee<br />

performing services under the Contract before execution of the<br />

contract.<br />

The CONTRACTOR shall insure that by the first day of employment, all<br />

persons who may have access to adult and juvenile records, and arrest<br />

information have signed an acknowledgment that meets the standards of the<br />

<strong>Probation</strong> Department for COUNTY employees having access to confidential<br />

criminal offender record information (CORI). CONTRACTOR shall retain<br />

original CORI form and forward a copy to Program Manager within five (5)<br />

business days of start of employment. (Appendix C, Technical Exhibit 3)<br />

1.20 Conflict of Interest<br />

No COUNTY employee whose position in the COUNTY enables him/her to<br />

influence the selection of a CONTRACTOR for this RFP, or any competing<br />

RFP, nor any spouse of economic dependent of such employees, shall be<br />

employed in any capacity by a PROPOSER or have any other direct or indirect<br />

financial interest in the selection of a CONTRACTOR. PROPOSER shall certify<br />

that he/she is aware of and has read Section 2.180.010 of the <strong>Los</strong> <strong>Angeles</strong><br />

<strong>County</strong> Code as stated in Appendix D - Required Forms Exhibit 5, Certification<br />

of No Conflict of Interest.<br />

1.21 Determination of Proposer Responsibility<br />

1.21.1 Responsible Proposer<br />

A responsible PROPOSER is a PROPOSER who has<br />

demonstrated the attribute of trustworthiness, as well as quality,<br />

fitness, capacity and experience to satisfactorily perform the<br />

contract. It is the COUNTY’S policy to conduct business only with<br />

responsible PROPOSERS.<br />
