1.14 If BHN reports trouble on a UNE or Other Service, and no trouble actually exists<br />

on the AT&T portion, AT&T will charge BHN at the rates set forth in Exhibit A<br />

to this Attachment 2 for dispatching and testing (both inside and outside the<br />

Central Office (CO)) required by AT&T in order to confirm the working status. If<br />

BHN reports the same trouble on the same UNE or Other Service within thirty<br />

(30) calendar days of AT&T’s notification to BHN of its disposition of the prior<br />

trouble, and AT&T is able to determine that such trouble exists on AT&T’s<br />

network, BHN shall be credited on the next billing cycle for charges associated<br />

with the prior trouble.<br />

1.15 Rates<br />

1.15.1 The rates that BHN shall pay to AT&T for UNEs, Combinations and Other<br />

<strong>Services</strong> are set forth in Exhibit A and or B of this Attachment.<br />

1.15.2 Rates, terms and conditions for order cancellation charges and Service Date<br />

Advancement Charges will apply in accordance with Attachment 6, Section 3.7<br />

and are incorporated herein by this reference.<br />

1.15.3 If BHN modifies an order (Order Modification Charge (OMC)) after being sent a<br />

Firm Order Confirmation (FOC) from AT&T, any costs incurred by AT&T to<br />

accommodate the modification will be paid by BHN in accordance with FCC No.<br />

1 Tariff, Section 5.<br />

1.15.4 Fractionalized billing shall apply to all UNEs and Combinations such that<br />

recurring charges will be prorated based upon the number of days that the UNEs<br />

are in service. Non-recurring charges shall not be fractionalized.<br />

2 Unbundled Loops<br />

2.1 General<br />

2.1.1 AT&T will provide nondiscriminatory access to unbundled local loops in all<br />

locations required by 47 C.F.R. § 51.319(a). The local loop Network Element is<br />

defined as a transmission facility that AT&T provides pursuant to this Attachment<br />

between a distribution frame (or its equivalent) in AT&T’s central office and the<br />

loop demarcation point at an End User premises (Loop). Facilities that do not<br />

terminate at a demarcation point at an End User premises, including, by way of<br />

example, but not limited to, facilities that terminate to another carrier’s switch or<br />

premises, a cell site, Mobile Switching Center or base station, do not constitute<br />

local Loops. The Loop Network Element includes all features, functions, and<br />

capabilities of the transmission facilities, including the network interface device,<br />

and attached electronics (except those used for the provision of advanced services,<br />

such as Digital Subscriber Line Access Multiplexers (DSLAMs)), optronics and<br />

intermediate devices (including repeaters and load coils) used to establish the<br />

transmission path to the End User’s premises, including inside wire owned or<br />
