where the modification requested has limited effect (e.g., requires limited assessment<br />

and no capital expenditure by AT&T) shall be the Subsequent Application Fee as set<br />

forth in Exhibit C. If the modification requires capital expenditure assessment, a full<br />

Application Fee shall apply. The Subsequent Application is Bona Fide when it is<br />

complete and accurate, meaning that all required fields on the Application are<br />

completed with the appropriate type of information.<br />

6.4 Space Preferences. If BHN has previously requested and received a Space Availability<br />

Report for the Premises, BHN may submit up to three (3) space preferences on their<br />

application identifying specific space identification numbers as referenced on the Space<br />

Availability Report. In the event that AT&T cannot accommodate the BHN's<br />

preference(s), BHN may elect to accept the space allocated by AT&T or may cancel<br />

its application and submit another application requesting additional preferences, which<br />

will be treated as a new application and an application fee will apply.<br />

6.5 Space Availability Notification.<br />

6.5.1 Unless otherwise specified, AT&T will respond to an application within ten (10)<br />

calendar days as to whether space is available or not available within a AT&T<br />

Premises. AT&T will also respond as to whether the Application is Bona Fide and if it<br />

is not Bona Fide the items necessary to cause the Application to become Bona Fide. If<br />

the amount of space requested is not available, AT&T will notify BHN of the amount<br />

of space that is available and no Application Fee shall apply. When AT&T’s response<br />

includes an amount of space less than that requested by BHN, or differently<br />

configured, BHN must resubmit its Application to reflect the actual space available.<br />

6.5.2 AT&T will respond to a Florida Application within fifteen (15) calendar days as to<br />

whether space is available or not available within a AT&T Premises. AT&T will also<br />

respond as to whether the Application is Bona Fide and if it is not Bona Fide the items<br />

necessary to cause the Application to become Bona Fide. If a lesser amount of space<br />

than requested is available, AT&T will provide an Application Response for the<br />

amount of space that is available and an Application Fee will be assessed. When<br />

AT&T’s Application Response includes an amount of space less than that requested by<br />

BHN or differently configured, BHN must amend its Application to reflect the actual<br />

space available prior to submitting Bona Fide Firm Order.<br />

6.5.3 AT&T will respond to a Louisiana Application within ten (10) calendar days for space<br />

availability for one (1) to ten (10) Applications; fifteen (15) calendar days for eleven<br />

(11) to twenty (20) Applications; and for more than twenty (20) Applications, it is<br />

increased by five (5) calendar days for every five additional Applications received<br />

within five (5) business days. If the amount of space requested is not available, AT&T<br />

will notify BHN of the amount of space that is available and no Application Fee shall<br />

apply. When AT&T’s response includes an amount of space less than that requested<br />

by BHN or differently configured, BHN must resubmit its Application to reflect the<br />

actual space available. AT&T will also respond as to whether the Application is Bona<br />
