Order may not constitute Intervening Law as set forth in Section 21 of the General Terms and<br />

Conditions of this <strong>Agreement</strong>, the Parties will implement any such modification via an amendment<br />

to this <strong>Agreement</strong> pursuant to the timelines and procedures set forth therein. Both Parties reserve<br />

their rights to modify this language pursuant to any appeals resulting from Docket No. U-31350.<br />

4.4.2.2 Until such time as the Parties can measure originating landline-to-WSP Inter-MTA traffic, a<br />

surrogate usage percentage, as stated in the Pricing Schedule attached hereto, will be applied to<br />

the total minutes originated by AT&T LOUISIANA’s End Users that are delivered to WSP’s network<br />

over the Interconnection Trunks. Cricket reserves its rights to modify this Section 4.4.2.2<br />

consistent with the Commission’s findings in a final and effective order in Docket No. U-<br />

31350(“Commission Order”) in accordance with Sections 39.2 and 39.3 of the General Terms and<br />

Conditions. Notwithstanding the fact that such a Commission Order may not constitute Intervening<br />

Law as set forth in section 21 of the General Terms and Conditions of this <strong>Agreement</strong>, the Parties<br />

will implement any such modification via an amendment to this <strong>Agreement</strong> pursuant to the<br />

timelines and procedures set forth therein. Both Parties reserve their rights to modify this language<br />

pursuant to any appeals resulting from Docket No. U-31350.<br />

4.5.1 Each Party will be responsible for the accuracy and quality of its data submitted to the other Party.<br />

4.5.2 Where SS7 connections exist, each Party will include in the information transmitted to the other Party, for<br />

each call being terminated on the other Party’s network, where available, the original and true Calling Party<br />

Number (“CPN”).<br />

4.5.3 If one Party is passing CPN but the other Party is not properly receiving information, the Parties will work<br />

cooperatively to correct the problem.<br />

4.6 Non-AT&T Tandem Providers:<br />

4.6.1 Third Party Terminating Carrier shall mean a CLEC, an ILEC, another CMRS provider, an OELEC, or a<br />

Carrier that utilizes local switching from AT&T LOUISIANA, purchased on a wholesale basis, to provide<br />

service to its End Users, to which traffic is terminated when WSP uses a Non-AT&T Tandem Provide, as<br />

defined below.<br />

4.6.2 Non-AT&T Tandem Provider shall mean a Telecommunications Carrier that provides tandem switching<br />

services to WSP and with whom WSP is directly interconnected for the purpose of delivering WSP traffic via<br />

Non-AT&T Tandem Provider’s direct interconnection arrangements with AT&T LOUISIANA to (i) AT&T<br />

LOUISIANA’s End User; or (ii) to an End User of a Third Party Terminating Carrier that utilizes local<br />

switching from AT&T LOUISIANA, purchased on a wholesale basis, to provide service to its End Users; or<br />

(iii) a Third Party Terminating Carrier’s End User.<br />

4.6.3 When a Non-AT&T Tandem Provider sends Traffic originated by the End Users of WSP to (i) AT&T<br />

LOUISIANA’s End User; or (ii) an End User of a Third Party Terminating Carrier that utilizes local switching<br />

from AT&T LOUISIANA, purchased on a wholesale basis, to provide service to its End Users; WSP is<br />

responsible for all Conversation MOU’s billed by AT&T LOUISIANA for Section 251(b)(5) traffic, or, for<br />

interMTA traffic, the applicable switched access rates as found in the Access Services tariffs, or other<br />

related contract for such traffic.<br />

5.0 Meet Point Billing (“MPB”) for Switched Access Services<br />

5.1 Pursuant to the procedures described in the Multiple Exchange Carrier Access Billing (“MECAB”) document,<br />

developed by the Alliance for Telecommunications Industry Solutions’ (“ATIS”) Ordering and Billing Forum (“OBF”),<br />

the Parties shall provide to each other the Switched Access Services detail usage data, on a per LATA basis, for<br />

jointly provided tandem switched Feature Groups B or D services to or from an IXC in accordance with Sections 5.1.1<br />

and 5.1.2 below. Information shall be exchanged in Electronic Message Interface (“EMI”) format, via a mutually<br />
