(ABS), unless such fraud is determined to have been committed by an employee or other<br />

person under the control of SBC TEXAS.<br />

34.3.5 SBC TEXAS shall use its fraud system to determine suspected occurrences of ABSrelated<br />

fraud for CLEC customers, using the same criteria SBC TEXAS uses to monitor<br />

fraud on its own accounts.<br />

34.3.5.1 SBC TEXAS will provide notification messages to CLEC on suspected<br />

occurrences of ABS-related fraud on CLEC accounts stored in the applicable<br />

LIDB. Subsequent to CLEC’s investigation of the notification message, CLEC’s<br />

Fraud Center will notify SBC TEXAS of any action that needs to be taken. SBC<br />

TEXAS will complete such action as requested by CLEC.<br />

34.3.5.2 CLEC understands that the fraud notification messages only identify potential<br />

occurrences of fraud. CLEC understands and agrees that it will need to perform<br />

its own investigations to determine whether a fraud situation actually exists.<br />

CLEC understands and agrees that it will also need to determine what, if any,<br />

action should be taken as a result of a fraud notification message.<br />

34.3.5.3 The Parties will provide contact names and numbers to each other for the<br />

exchange of fraud notification messages twenty-four (24) hours per day seven<br />

(7) days per week.<br />

34.3.5.4 For each alert notification provided to CLEC, CLEC may request a corresponding<br />

thirty-day (30-day) historical report of ABS-related query processing. CLEC may<br />

request up to three reports per alert.<br />

34.3.5.6 ABS-related alerts are provided to CLEC at no additional charge.<br />

34.3.6 The Parties agree that CLEC reserves the right to negotiate, as needed, the rates, terms<br />

and conditions of a 1+ IntraLATA toll fraud service provided by SBC TEXAS.<br />

35. NOTICE OF NETWORK CHANGES/NOTIFICATION OF OTHER INFORMATION<br />

35.1 SBC TEXAS agrees to provide CLEC reasonable notice consistent with applicable FCC rules of<br />

changes in the information necessary for the transmission and routing of services using SBC<br />

TEXAS’ facilities or networks, as well as other changes that affect the interoperability of those<br />

respective facilities and networks. This Agreement is not intended to limit SBC TEXAS’ ability to<br />

upgrade its network through the incorporation of new equipment, new software or otherwise so<br />

long as such upgrades are not inconsistent with SBC TEXAS’ obligations to CLEC under the terms<br />

of this Agreement.<br />

35.2 SBC TEXAS communicates official information to competitive local exchange carriers via its<br />

Accessible Letter notification process. This process covers a variety of subjects, including updates<br />

on products/services promotions; deployment of new products/services; modifications and price<br />

increases to existing products/services; cancellation or retirement of existing products/services;<br />

and operational issues.<br />

35.3 # SBC will provide CLEC with direct notice of any tariff or filing which concerns the subject matter of<br />

this Agreement as required by the PUCT’s Substantive Rules.<br />
