printed on the patent will be based solely on the inf<strong>or</strong>mation<br />

so supplied.<br />

A request f<strong>or</strong> a Certificate of C<strong>or</strong>rection under 37<br />

CFR 1.323 arising from incomplete <strong>or</strong> erroneous<br />

assignee's name furnished in item 3 of PTOL-85B<br />

will not be granted unless a petition under 37 CFR<br />

1.183 has been granted. Any such petition under 37<br />

CPR 1.183 should be directed to the Office of Petitions<br />

and should include:<br />

(A) the petition fee required by 37 CPR 1.17(h);<br />

(B) a request that 37 CPR 3.81(a) be waived to<br />

permit the c<strong>or</strong>rect name of the assignee to be provided<br />

after issuance of the patent;<br />

(C) a statement that the failure to include the c<strong>or</strong>rect<br />

assignee name on the PTOL-85B was inadvertent;<br />

and<br />

(D) a copy of the Notice of Rec<strong>or</strong>dation of<br />

Assignment Document.<br />

CORRECTION OF INVENTORS' NAMES<br />

35 U.S.c. 256. C<strong>or</strong>rection ofnamed invent<strong>or</strong>.<br />

Wheneverthrough err<strong>or</strong> a person is namedin an issued patent<br />

as the invent<strong>or</strong>;<strong>or</strong> through err<strong>or</strong>. an invent<strong>or</strong> is not named in an<br />

issued patentandsuch err<strong>or</strong> arosewithoutany deceptive intention<br />

on his part, theDirect<strong>or</strong> may, on application of all theparties and<br />

assignees, with proof of the facts and such otherrequirements as<br />

may be imposed, issue a certificatec<strong>or</strong>recting such err<strong>or</strong>.<br />

<strong>The</strong> err<strong>or</strong> of omittinginvent<strong>or</strong>s<strong>or</strong> namingpersons who are not<br />

invent<strong>or</strong>s shall not invalidate the patent in which such. err<strong>or</strong><br />

occurred if it can be c<strong>or</strong>rected as provided in this section. <strong>The</strong><br />

court bef<strong>or</strong>e which such matter is called in question may <strong>or</strong>der<br />

c<strong>or</strong>rection of the patent on notice and hearing of all parties concernedandtheDirect<strong>or</strong><br />

shall issue a certificate acc<strong>or</strong>dingly.<br />

In requesting the Office to effectuate a court <strong>or</strong>der<br />

c<strong>or</strong>recting invent<strong>or</strong>ship in a patent pursuant to 35<br />

U.S.c. 256, a copy of the court <strong>or</strong>der and a Certificate<br />

of C<strong>or</strong>rection under 37 CFR 1.323 should be submitted<br />

to the Certificates of C<strong>or</strong>rections Branch.<br />

37 CFR 1.324. C<strong>or</strong>rection of invent<strong>or</strong>ship in patent,<br />

pursuant to 35 U.S. C. 256.<br />

(a) Whenever through err<strong>or</strong> a person is namedin an issued<br />

patentas the invent<strong>or</strong>, <strong>or</strong> through err<strong>or</strong> an invent<strong>or</strong>is notnamedin<br />

an issued patentand such err<strong>or</strong> arosewithoutany deceptive intention<br />

on his <strong>or</strong> her part, the Commissionermay, on petition, <strong>or</strong> on<br />

<strong>or</strong>der of a court bef<strong>or</strong>e which such matter is called in question,<br />

issue a certificate naming only the actualinvent<strong>or</strong><strong>or</strong> invent<strong>or</strong>s. A<br />

petitionto c<strong>or</strong>rectinvent<strong>or</strong>ship of a patentinvolved in an interference<br />

must comply with the requirements of this section andmust<br />

be accompanied by a motion under§.1.634.<br />

CORRECTION OF PATENTS 1481<br />

(b) Any petition pnrsuant to paragraph (a) of this section<br />

mustbe accompanied by:<br />

(1) Where one <strong>or</strong> m<strong>or</strong>e persons are being added, a statement<br />

from each person who is being addedas an invent<strong>or</strong>thatthe<br />

invent<strong>or</strong>ship err<strong>or</strong> occurred withoutany deceptive intentionon his<br />

<strong>or</strong> her part;<br />

(2} A· statement from the current named invent<strong>or</strong>s who<br />

have not submitted a statement under paragraph (b)(t) of this section<br />

eitheragreeing to the change of invent<strong>or</strong>ship <strong>or</strong> stating.that<br />

they have no disagreement in regard to the requestedchange;<br />

(3) A statement from all assignees of the parties submitting<br />

a statement under paragraphs (b)(I) and (b)(2) of this section<br />

agreeing to the change of invent<strong>or</strong>ship in the patent, which'statement<br />

mustcomply with the requirements of § 3.73(b) of this chapter;<br />

and<br />

(4) <strong>The</strong> fee set f<strong>or</strong>th in § 1.20(b).<br />

(c) F<strong>or</strong> c<strong>or</strong>rection of invent<strong>or</strong>ship in an application see<br />

§§ 1.48 and 1.497, and in an interference see § 1.634.<br />

<strong>The</strong> petition to c<strong>or</strong>rect invent<strong>or</strong>ship under 37 CPR<br />

1.324 must include the statements and fee required by<br />

37 CPR 1.324(b).<br />

Under 37 CFR 1.324(b)(1), a statement is required<br />

from each person who is being added as an invent<strong>or</strong><br />

that the invent<strong>or</strong>ship err<strong>or</strong> occurred without any<br />

deceptive intention on their part. In <strong>or</strong>der to satisfy<br />

this,a statement such as the following is sufficient:<br />

''<strong>The</strong> invent<strong>or</strong>ship err<strong>or</strong>of failing to include John Smith<br />

as an invent<strong>or</strong> of the patentoccurred without any deceptive<br />

intention on the partof JohnSmith."<br />

Nothing m<strong>or</strong>e is required. <strong>The</strong> examiner will determine<br />

only whether the statement contains the required<br />

language; the examiner will not make any comment<br />

as to whether <strong>or</strong> not it appears that there was in fact<br />

deceptive intention (see MPEP § 2022.05).<br />

Under 37 CPR 1.324(b)(2), all current invent<strong>or</strong>s<br />

who did not submit a statement under 37 CFR<br />

1.324(b)(l) must submit a statement either agreeing to<br />

the change of invent<strong>or</strong>ship, <strong>or</strong> stating that they have<br />

no disagreement with regard to the requested change.<br />

"Current 'invent<strong>or</strong>s" include the invent<strong>or</strong>(s) being<br />

retained as such and the invent<strong>or</strong>(s) to be deleted.<br />

<strong>The</strong>se current invent<strong>or</strong>s need not make astatement as<br />

to whether the invent<strong>or</strong>ship err<strong>or</strong> occurred without<br />

deceptive intention.<br />

Ifan invent<strong>or</strong> is not available, <strong>or</strong> refuses, to submit<br />

a statement, the assignee of the patent may wish to<br />

consider filing a reissue application to c<strong>or</strong>rect invent<strong>or</strong>ship,<br />

since the invent<strong>or</strong>'s statement is not required<br />

f<strong>or</strong> a non-broadening reissue application to c<strong>or</strong>rect<br />

invent<strong>or</strong>ship. See MPEP § 1412.04.<br />
