will be reviewed, the Office need not act on that inf<strong>or</strong>mation<br />

n<strong>or</strong> deny any accompanying request f<strong>or</strong> issuance<br />

of a Certificate of C<strong>or</strong>rection. Acc<strong>or</strong>dingly, a fee<br />

f<strong>or</strong> submission of the inf<strong>or</strong>mation by a third party has<br />

not been imposed. <strong>The</strong> Office may, however, choose<br />

to issue a Certificate of C<strong>or</strong>rection on its own initiative<br />

based on the inf<strong>or</strong>mation supplied by a third<br />

party, if it desires to do so. Regardless of whether the<br />

third party inf<strong>or</strong>mation is acted upon, the inf<strong>or</strong>mation<br />

will not be made of rec<strong>or</strong>d in the file that it relates to,<br />

n<strong>or</strong> be retained by the Office. 37 CFR l.322(a)(2)(ii).<br />

When such third party inf<strong>or</strong>mation (about mistakes<br />

in patents) is received by the Office, the Office will<br />

not c<strong>or</strong>respond with third parties about the inf<strong>or</strong>mation<br />

they submitted either (1) to inf<strong>or</strong>m the third parties<br />

of whether it intends to issue a Certificate of<br />

C<strong>or</strong>rection, <strong>or</strong> (2) to issue a denial of any request f<strong>or</strong><br />

issuance of a Certificate of C<strong>or</strong>rection that may<br />

accompany the inf<strong>or</strong>mation. <strong>The</strong> Office will confirm<br />

to the party submitting such inf<strong>or</strong>mation that the<br />

Office has in fact received the inf<strong>or</strong>mation if a<br />

stamped, self-addressed post card has been submitted.<br />

PUBLICATION IN THE OFFICIAL GAZETTE<br />

Each issue of the Official Gazette (patents section)<br />

numerically lists all United States patents having Certificates<br />

of C<strong>or</strong>rection. <strong>The</strong> list appears under the<br />

heading "Certificates of C<strong>or</strong>rection f<strong>or</strong> the week of<br />

(date)."<br />

1481 Applicant's Mistake<br />

35 u.s. C. 255. Certificate of c<strong>or</strong>rection of applicant's<br />

mistake.<br />

Whenever a mistake ofa clerical <strong>or</strong> typographical nature, <strong>or</strong> of<br />

min<strong>or</strong> character, which was not the fault of the <strong>Patent</strong> and Trademark<br />

Office, appears in a patentand a showing has been made that<br />

such mistake occurred in good faith, the Direct<strong>or</strong> may, upon payment<br />

of the required fee, .issue a "certificate'of c<strong>or</strong>rection, if the<br />

c<strong>or</strong>rection does not involve such changes in the patent as would<br />

constitute new matter <strong>or</strong>, would require. reexamination. Such<br />

patent, together with thecertificate.shall have the sameeffect and<br />

operation in law on the trial of actions f<strong>or</strong> causes thereafter arising<br />

as if the same had been <strong>or</strong>iginally issued in such c<strong>or</strong>rected f<strong>or</strong>m.<br />

<strong>The</strong> Office may issue a certificate of c<strong>or</strong>rection under the conditions<br />

specified in 35 U:S.C. 255 at the request 'of the patentee <strong>or</strong><br />

the patentee's assignee, upon payment of the fee set f<strong>or</strong>th in<br />

§ -120(a). lithe request relates to a patent involved .in'an'interfer-<br />

ence, the request must comply with the requirements of this 'section<br />

and be accompanied by a motion under § 1.635.<br />

37 CFR 1.323 relates to the issuance of Certificates<br />

of C<strong>or</strong>rection f<strong>or</strong> the c<strong>or</strong>rection of err<strong>or</strong>s which were<br />

not the fault of the Office. Mistakes in a patent which<br />

are not c<strong>or</strong>rectable by Certificate of C<strong>or</strong>rection may<br />

be c<strong>or</strong>rectable via filing a reissue application (see<br />

MPEP § 1401- § 1460).<br />

In re Arnott, 19 USPQ2d 1049, 1052 (Comm'r Pat.<br />

1991) specifies the criteria of 35 U.S.C. 255 (f<strong>or</strong> a<br />

Certificate of C<strong>or</strong>rection) as follows:<br />

Two separate statut<strong>or</strong>y requirements must be met<br />

bef<strong>or</strong>e a Certificate of C<strong>or</strong>rection' f<strong>or</strong> an applicant's mistake<br />

may issue. <strong>The</strong> first statut<strong>or</strong>y requirement concerns<br />

the nature; i.e., type, of the mistake f<strong>or</strong> which a c<strong>or</strong>rection<br />

is sought. <strong>The</strong> mistake must be:<br />

(1) of a clerical nature,<br />

(2) of a typographical nature, <strong>or</strong><br />

(3) a mistake of min<strong>or</strong> character.<br />

<strong>The</strong> second statut<strong>or</strong>y requirement c-oncerns the nature<br />

of -the proposed c<strong>or</strong>rection. <strong>The</strong> c<strong>or</strong>rection must not<br />

involve changes which would:<br />

(1) -constitute new matter <strong>or</strong><br />

(2) require reexamination.<br />

Ifthe above criteria are not satisfied, then a Certificate<br />

of C<strong>or</strong>rection f<strong>or</strong> an applicant's mistake will not issue,<br />

and reissue must be employed as the vehicle to "c<strong>or</strong>rect"<br />

the patent. Usually, any mistake affecting Claim<br />

scope must be c<strong>or</strong>rected by reissue.<br />

A mistake is not considered to be of the "min<strong>or</strong>"<br />

character required f<strong>or</strong> the issuance of a Certificate of<br />

C<strong>or</strong>rection if the requested change would materially<br />

affect the scope <strong>or</strong> meaning of the patent. See also<br />

MPEP § 1412.04 as to c<strong>or</strong>rection of invent<strong>or</strong>ship via<br />

certificate of c<strong>or</strong>rection <strong>or</strong> reissue.<br />

<strong>The</strong> fee f<strong>or</strong> providing a c<strong>or</strong>rection of applicant's<br />

mistake, other than invent<strong>or</strong>ship, is set f<strong>or</strong>th in 37<br />

CFR 1.20(a). <strong>The</strong> fee f<strong>or</strong> c<strong>or</strong>rection of invent<strong>or</strong>ship in<br />

a patent is setf<strong>or</strong>th in 37 CFR 1.20(b).<br />

CORRECTION OF ASSIGNEES' NAMES<br />

<strong>The</strong> Issue Fee Transmittal F<strong>or</strong>m p<strong>or</strong>tion (PTOL­<br />

85B) of the Notice of Allowance provides a space<br />

(item 3) f<strong>or</strong> assignment data which should be completed<br />

in <strong>or</strong>der to comply with 37 CFR 3.81. Unless<br />

an assignee's name and address are identified in the<br />

appropriate space f<strong>or</strong> specifying the assignee, (i.e.,<br />

item 3 of the Issue Fee Transmittal F<strong>or</strong>m PTOL-85B),
