<strong>The</strong> right to a patent f<strong>or</strong> a design stems from:<br />

Whoever invents any new, <strong>or</strong>iginal and <strong>or</strong>namental design f<strong>or</strong><br />
an article of manufacture may obtain a patent theref<strong>or</strong>, subject to<br />
the conditions and requirements of this title.<br />

1502. Definition of a Design<br />
In a design patent application, the subject matter<br />
which is claimedis the design embodied in <strong>or</strong> applied<br />
to an article of manufacture (<strong>or</strong> p<strong>or</strong>tion thereof) and<br />

refers, not to the design of an article, but to the design<br />
f<strong>or</strong> an article, and is inclusive of <strong>or</strong>namental designs<br />
of all kinds including surface <strong>or</strong>namentation as well<br />

<strong>The</strong> design f<strong>or</strong> an article consists ?fthe visual characteristics<br />
embodied in <strong>or</strong> applied to an article.<br />
Since a designis manifested in appearance, the subject<br />
matter of a design patent application may relate to<br />
the configuration <strong>or</strong> shape of an article, to the surface<br />
<strong>or</strong>namentation applied to an article, <strong>or</strong> to the combination<br />
of configuration and surface <strong>or</strong>namentation.<br />
Design is inseparable from the article to which it is<br />
applied and.cannot exist alone merely as a scheme of<br />
surface <strong>or</strong>namentation. It must be a definite, preconceived<br />
thing, capable of reproduction and not merely<br />
the chance result of a method.<br />

<strong>The</strong>-designf<strong>or</strong> an article consists ofthe visual characteristics <strong>or</strong><br />
aspect displayed bythe article. It -is the' appearance presented by<br />
the article which creates an impressionthrough the eye upon the<br />
mind of the observer.<br />

Since a designis manifested in appearancc.. the subject matter<br />
of a: Design <strong>Patent</strong>. may relate to the configuration <strong>or</strong> shape of.an<br />
article.to the surface <strong>or</strong>namentation on anarticIe,<strong>or</strong>to both.<br />
1502.01 Distinction Between Design<br />
and Utility <strong>Patent</strong>s<br />
In general terms, a "utility patent" protects the way<br />
an article is used and w<strong>or</strong>ks (35 U.S.c. 101), while a<br />
"design patent" protects the way an article looks<br />
(35 U.S.C. 171). <strong>The</strong> <strong>or</strong>namental appearance f<strong>or</strong> an<br />
article includes its vshape/configuration <strong>or</strong> surface.<br />
