obvious err<strong>or</strong> c<strong>or</strong>rections. <strong>The</strong> rectification is<br />
obvious only in the sense that anyone would immediately<br />
realize that nothing else could have been<br />
intended than what is offered as rectification. F<strong>or</strong><br />
example, a misspelled w<strong>or</strong>d could be considered an<br />
obvious err<strong>or</strong> subject to rectification, A missing<br />
chemical f<strong>or</strong>mula <strong>or</strong> missing line of text would not be<br />
considered obvious err<strong>or</strong> subject to rectification.<br />
However, improper identification of the application<br />
number of the file in which a paper is to be entered<br />
has been held to be an obvious err<strong>or</strong> subject to rectification<br />
when the applicant did include the proper<br />
agent's file reference and other inf<strong>or</strong>mation properly<br />
identifying the application file. See Helfgott & Karas<br />
P. C. v. Dickinson, 209 F.3d 1328, 54 USPQ2d 1425<br />
(Fed. Cir. 2000).<br />
Rectifications must be auth<strong>or</strong>ized:<br />
(A) If the err<strong>or</strong> is in the request by the Receiving<br />
Office;<br />
(B) If the err<strong>or</strong> is in the description, the Claims,<br />
the drawings <strong>or</strong> the abstract by the International<br />
Searching Auth<strong>or</strong>ity, <strong>or</strong> by the International Preliminary<br />
Examining Auth<strong>or</strong>ity where the international<br />
application is pending bef<strong>or</strong>e the latter Auth<strong>or</strong>ity;<br />
(C) If the err<strong>or</strong> is in any paper other. than the<br />
international application <strong>or</strong> amendments <strong>or</strong> c<strong>or</strong>rections<br />
to it by the International Bureau.<br />
<strong>The</strong> request f<strong>or</strong> rectification mustbe addressed to<br />
the auth<strong>or</strong>ity competent to auth<strong>or</strong>ize the rectification.<br />
It must be filed in time f<strong>or</strong> the rectification to be<br />
auth<strong>or</strong>ized and f<strong>or</strong> notification of the auth<strong>or</strong>ization to<br />
reach the International Bureau bef<strong>or</strong>e the expiration of<br />
the applicable time limit, namely:<br />
(A) Where the auth<strong>or</strong>ization is given by the<br />
Receiving Office <strong>or</strong> the International Searching<br />
Auth<strong>or</strong>ity its notification must reach the International<br />
Bureau bef<strong>or</strong>e the expiration of 17 months from the<br />
pri<strong>or</strong>ity date (<strong>or</strong> later, bef<strong>or</strong>e the technical preparations<br />
f<strong>or</strong> international publication have been completed);<br />
(B) Where the auth<strong>or</strong>ization is given by the Inter<br />
national Preliminary Examining Auth<strong>or</strong>ity it must be<br />
given bef<strong>or</strong>e the establishment of the international<br />
preliminary examination rep<strong>or</strong>t;<br />
(C) Where the auth<strong>or</strong>ization is given by the Inter<br />
national Bureau it must be given bef<strong>or</strong>e the expiration<br />

<strong>The</strong> patent examiner, in his <strong>or</strong> her capacity as an<br />
officer of either the International Searching Auth<strong>or</strong>ity<br />
<strong>or</strong> International Preliminary Examining Auth<strong>or</strong>ity,<br />
inf<strong>or</strong>ms the applicant of the auth<strong>or</strong>ization <strong>or</strong> refusal to<br />
auth<strong>or</strong>ize the rectification of obvious err<strong>or</strong>s. <strong>The</strong><br />
International Searching Auth<strong>or</strong>ity inf<strong>or</strong>ms the applicant<br />
of the decision by use of F<strong>or</strong>m PCTIISAJ217,<br />
while the International Preliminary Examining<br />
Auth<strong>or</strong>ity inf<strong>or</strong>ms the applicant of the decision by use<br />
of FOrmPCTIIPEAJ412.<br />
Where the examiner discovers what might be considered<br />
an obvious err<strong>or</strong>, an invitation to request rectification<br />
(F<strong>or</strong>m PCTIISAJ216 <strong>or</strong> PCTIIPEAJ411)<br />
should be mailed to applicant.<br />

Auth<strong>or</strong>ity<br />
35 U.S.C. 362, International Searching Auth<strong>or</strong>ity and<br />
International Preliminary Examining Auth<strong>or</strong>ity.<br />
(a) <strong>The</strong> Parent andTrademark Office may act as an Intemational<br />
Searching Auth<strong>or</strong>ity andInternational Preliminary Bxamining<br />
Auth<strong>or</strong>ity with respect to international applications in<br />
acc<strong>or</strong>dance with the terms andconditions of an agreement which<br />
may.be concluded with the International Bureau, and may discharge<br />

of handling fees and their transmittal to the International<br />

UnitedStates Receiving Office andin other Receiving Offices as<br />
may be agreed upon by the Commissioner, in acc<strong>or</strong>dance with<br />
agreement between the <strong>Patent</strong> and Trademark Office and the<br />
