(1) Reference signs not mentioned in the description shall<br />

not appear in the drawings, andvice versa.<br />

(m) <strong>The</strong> same features, when denoted by reference signs,<br />

shall, throughout the international application, be denoted by the<br />

samesigns.<br />

(n) If the drawings contain a large number of reference<br />

signs, it is stronglyrecommended to attach a separate sheet listing<br />

all reference signs andthe features denotedby them.<br />

(a) <strong>Subject</strong> to paragraph (b) of this section, when drawings<br />

are necessary f<strong>or</strong> the understanding of the invention, <strong>or</strong> are mentioned<br />

in the description, they must be part.of an international<br />

application as. <strong>or</strong>iginally filed in the United States Receiving<br />

Office in <strong>or</strong>dert<strong>or</strong>riaintain the international filing date duringthe<br />

national stage (PCT Art. 7).<br />

(b) Drawings missing from the application upon filing will<br />

be accepted if such drawings are received within 30 days of the<br />

date of firstreceipt of the incompletepapers.Ifthe missing drawings<br />

arereceived within the 30-day period,the international filing<br />

date shall be the dateon which such drawingsarereceived.Ifsuch<br />

drawings arenot timely received, all,references to drawings in the<br />

international application shall be considered non-existent (peT<br />

Art. 14(2), Administrative Instruction 310).<br />

(c) <strong>The</strong> physical requirements f<strong>or</strong> drawings are set f<strong>or</strong>th in<br />

PCT Rule 11 and shall he adhered to.<br />

<strong>The</strong> international application must contain drawings<br />

when they are necessary f<strong>or</strong> the understanding of<br />

the invention. M<strong>or</strong>eover where, without drawings<br />

being actually necessary f<strong>or</strong> the understanding of the<br />

invention, its nature admits of illustration by drawings,<br />

the applicant may include such drawings and<br />

any designated Office may require the applicant to file<br />

such drawings during the national phase. Flow sheets<br />

and diagrams are considered drawings. "Guidelines<br />

f<strong>or</strong> Drawings Under the <strong>Patent</strong> Cooperation Treaty,"<br />

published in the PCl' Gazette (No. 711978), may be<br />

obtained, in English and French, from the International<br />

Bureau.<br />

Drawings must be presented on one <strong>or</strong> m<strong>or</strong>e separate<br />

sheets. <strong>The</strong>y may not be included in the description,<br />

the claims <strong>or</strong> the abstract. <strong>The</strong>y may not contain<br />

text matter, except a single w<strong>or</strong>d <strong>or</strong> w<strong>or</strong>ds when absolutely<br />

indispensable. Note that if the drawings contain<br />

text matter not in English but in a language accepted<br />

under PCT Rule 12.I(a) by the International Bureau<br />

as a Receiving Office, the international application<br />

will be transmitted to the International Bureau f<strong>or</strong><br />

processing in its capacity as a Receiving Office. See<br />

37 CFR 1.412(c)(6)(ii). If the drawings contain text<br />

matter not in a language accepted under PCT Rule<br />

12.I(a) by the International Bureau as a Receiving<br />

Office, the application will be denied an international<br />

filing date.<br />

All lines in the drawings must, <strong>or</strong>dinarily, be drawn<br />

with the aid ofa drafting instrument and must be executed<br />

in black, unif<strong>or</strong>mly thick and well-defined lines.<br />

PCT Rules 11.10 to 11.13 contain detailed requirements<br />

as to further physical requirements of drawings.<br />

Drawings newly executed acc<strong>or</strong>ding to national standards<br />

may not be required during the national phase if<br />

the drawings filed with the international application<br />

comply with PCTRule 11. <strong>The</strong> examiner may require<br />

new drawings where the drawings which were<br />

accepted during the international phase did not comply<br />

with PCT Rule II. A file referencemay be indicated<br />

in the upper left comer on each sheet of the<br />

drawings as f<strong>or</strong> the description.<br />

All of the figures constituting the drawings must be<br />

grouped together on a sheet <strong>or</strong> sheets without waste of<br />

space, preferably in an upright position and clearly<br />

separated from each other. Where the drawings <strong>or</strong><br />

tables cannot be presented satisfact<strong>or</strong>ily in an upright<br />

position, they may be placed sideways, with the tops<br />

of the drawings <strong>or</strong> tables on the left-hand side of the<br />

sheet.<br />

<strong>The</strong> usable surface of sheets (which must be of A4<br />

size) must not exceed 26.2 em x 17.0 ern. <strong>The</strong> sheets<br />

must not contain frames around the usable surface.<br />

<strong>The</strong> minimum margins which must be observed are:<br />

top and left side: 2.5 em; right side: 1.5 em; bottom:<br />

1.0 ern.<br />

All sheets of drawings must be numbered in the<br />

center of either the top <strong>or</strong> the bottom of each sheet but<br />

not in the margin in numbers larger than those used as<br />

reference signs in <strong>or</strong>der to avoid confusion with the<br />

latter. F<strong>or</strong> drawings, a separate series of page numbers<br />

is to be used. <strong>The</strong> number of each sheet of the<br />

drawings must consist of two Arabic numerals separated<br />

by an oblique stroke, the first being the sheet<br />

number and the second being the total number of<br />

sheets of drawings. F<strong>or</strong> example, "2/5" would be used<br />

f<strong>or</strong> the second sheet of drawings where there are five<br />

in all.<br />
