of the pri<strong>or</strong> application. This time period is not extendable. Unless<br />

the reference required by this paragraph is included in an application<br />

data sheet (§ 1.76), the specification must contain <strong>or</strong> 'be<br />

amended to contain such reference in the first sentence 'following<br />

the title. If the application claims the' benefit of an international<br />

application, the first sentence of the specification must include an<br />

indication of whether the international application was published<br />

under PCT Article 21 (2) iu English (regardless of whether benefit<br />

f<strong>or</strong> such application is claimed in the application data sheet). <strong>The</strong><br />

request f<strong>or</strong> a continued prosecution application under § 1.53(d) is<br />

the specific referencerequired by 35 U.S.C. 120 to the pri<strong>or</strong> application.<strong>The</strong><br />

identification of an application by'application number<br />

underthis section is the specific referencerequired by35 U.S.c.<br />

120 to every application assigned that application number. Cross<br />

references to other related applications may be made when appropriate<br />

(see § 1.14). Except as provided in paragraph (a)(3) of this<br />

section, the failure to timely submit the reference required -by<br />

35 U.S.c. 120 and this paragraph is considered a waiver of any<br />

benefit under 35 U.S.C. 120, 121, <strong>or</strong> 365(c) to such pri<strong>or</strong> application.<br />

<strong>The</strong> time period set f<strong>or</strong>th in this paragraph does not apply to<br />

an application f<strong>or</strong>a design patent.<br />

(3) If the reference required by 35 U.S.c. 120 and para,<br />

graph (a)(2) of this section is presented in a nonprovisional application<br />

after the time period provided by paragraph (a)(2) of this<br />

sectiou, the claim under 35 U.S.c. 120, 121, <strong>or</strong> 365(c) f<strong>or</strong> the benefit<br />

of a prt<strong>or</strong> filed copending nonprovisional application <strong>or</strong> international<br />

application designating the United States of America may<br />

be _accepted if the reference identifying the _pri<strong>or</strong> application by<br />

application number <strong>or</strong> international application number and international<br />

filing -_ date was unintentionally delayed. A petition to<br />

accept an unintentionally delayed claim under 35U.S.C. 120, 121,<br />

<strong>or</strong> 365(c) .f<strong>or</strong> the benefit of a pri<strong>or</strong> filed application must be<br />

accompanied by:<br />

(i) <strong>The</strong> surcharge set f<strong>or</strong>th in § 1.17(t); and<br />

(ii) A statement that the entire delay between the date<br />

the claim was due under paragraph (a)(2) of this section and the<br />

date the claim was filed was .unintentional. <strong>The</strong> Comrrrissioner<br />

may require _additional inf<strong>or</strong>mation -where there is a question<br />

whether the delay was unintentional.<br />

(4) A nonprovisional application other .than f<strong>or</strong>a design<br />

patent may claim an invention disclosed in one <strong>or</strong> m<strong>or</strong>e pri<strong>or</strong> filed<br />

provisional applications. In <strong>or</strong>der f<strong>or</strong> a nonprovisional application<br />

to claim _the-benefit ofone <strong>or</strong> m<strong>or</strong>e pri<strong>or</strong> filed provisional. applications,<br />

each pri<strong>or</strong> provisional application must name as an invent<strong>or</strong><br />

at leastone invent<strong>or</strong> named in the later filed nonprovisional application<br />

and disclose the named invent<strong>or</strong>'s invention.claimed in at<br />

least one claim of the later filed nonprovisional application in the<br />

mauner provided by the first paragraph of 35 U.S.C. 112. In addition,<br />

each pri<strong>or</strong> provisional application must be entitled to a filing<br />

date as set f<strong>or</strong>th in § 1.53(c), and the basic filing fee set f<strong>or</strong>th in §<br />

1.16(k) must be paid within the time period set f<strong>or</strong>th in § 1.53(g).<br />

(5) Any nonprovlsional application claiming the benefit<br />

of one <strong>or</strong> m<strong>or</strong>e pri<strong>or</strong> filed copending provisional applications must<br />

contain a reference to each such pri<strong>or</strong> provisional application,<br />

identifyingit as a provisional application, and including the provisional<br />

application number (consisting of series code and serial<br />

number), and, if the provisional application is filed in a language<br />

other than English, an English language translation of the non­<br />

English language provisional application and a statement that the<br />

translation is accurate. This reference and English language translation<br />

of a non-English-language provisional-application must be<br />

submitted during the pendency of the nonprovisional application,<br />

and within the later of four months from the actual filing date of<br />

the nonprovisional application <strong>or</strong> sixteen months from the filing<br />

date of the pri<strong>or</strong> provisional application. This time period is not<br />

extendable. Unless the reference required by this paragraph is<br />

included in an application data sheet (§ 1.76), the specification<br />

must contain <strong>or</strong> be amended to contain such reference in the first<br />

sentence following the title. Except as provided in paragraph<br />

(a)(6) of this section, the failure to timely subrrritthe reference and<br />

English language translation of a non-English language provisional<br />

application required by 35 U.S.C. 119(e) and this paragraph<br />

is considered a_ waiver of any benefit under 35 U.S.C. 119(e) to<br />

such pri<strong>or</strong>provisional application.<br />

(6) If the reference <strong>or</strong> English language translation of' a<br />

non-English language provisional application required by -35<br />

U.S.C. 119(e) and paragraph (a)(5) ofthis sectiou is presented iu a<br />

nonprovisional application after the time period provided by para:graph<br />

(a)(5) of this section, the claim uuder 35 U.S.c. 119(e) f<strong>or</strong><br />

the benefitof a pri<strong>or</strong> filed provisional application may be accepted<br />

during the pendency of the nonprovisional application if the reference<br />

identifying the pri<strong>or</strong> application by provisional application<br />

number and any English language translation of a non-English<br />

language provisional application were unintentionally delayed. A<br />

Under no circumstances can a Certificate 'of C<strong>or</strong>rection<br />

be employed to c<strong>or</strong>rect an applicant's mistake<br />

by adding <strong>or</strong> c<strong>or</strong>recting a pri<strong>or</strong>ity claim under<br />

35 U.S.C. 119(e) f<strong>or</strong> an application filed on <strong>or</strong> after<br />

November 29, 2000.<br />

Section 4503 of the American Invent<strong>or</strong>'s Protection<br />

Act of 1999 (AIPA) amended 35 U.S.C. 119(e)(I) to<br />

state that:<br />

No application shall be entitled to the benefit of an earlier<br />

filed provisional application under this subsection<br />

unless an amendment containing the specific reference to<br />

the earlier filed provisional application is subrrritted at such<br />

time during the pendency of the application as required by<br />

the Direct<strong>or</strong>. <strong>The</strong> _Direct<strong>or</strong> may consider the _failure to submit<br />

such an amendment within that time period as a waiver<br />

of any benefit under this' subsection. <strong>The</strong> Direct<strong>or</strong> may<br />

establish procedures, includingthe payment of a surcharge,
