Document. <strong>The</strong> mem<strong>or</strong>andum <strong>or</strong> copy is f<strong>or</strong>warded<br />

to the Customer Contact Team of the Office of<br />

Initial <strong>Patent</strong> Examination (OIPE).<br />

Upon receipt, the Customer Service Branch of the<br />

OIPE prepares a retention label (PfO-150) and<br />

attaches it to the Disclosure Document, and indicates<br />

such on the f<strong>or</strong>warded memo <strong>or</strong> copy, and returns the<br />

memo <strong>or</strong> copy to the TC. <strong>The</strong> returned memo <strong>or</strong> copy<br />

is stapled to the inside left flap of the file wrapper so<br />

that the examiner's attention is directed to it when the<br />

next Office action is prepared. If prosecution bef<strong>or</strong>e<br />

the examiner has been concluded, a separate letter<br />

indicating that the Disclosure Document will be<br />

retained should be sent to the applicant by the examining<br />

TC technical supp<strong>or</strong>t staff member.<br />

After the acknowledging letter is mailed, the paper<br />

number of the acknowledgment is noted in the application<br />

file. <strong>The</strong> returned memo <strong>or</strong> copy is stapled to<br />

and retained with the <strong>or</strong>iginal paper referring to the<br />

Disclosure Document in the file wrapper.<br />

FEE<br />

A fee of $10, as set f<strong>or</strong>th in 37 CPR 1.21(c), in the<br />

f<strong>or</strong>m of a check <strong>or</strong> money <strong>or</strong>der made payable to<br />

"Assistant Commissioner f<strong>or</strong> <strong>Patent</strong>s" must accompany<br />

the Disclosure Document when it is submitted to<br />

the USPfO. Documents not accompanied by the full<br />

fee will be returned. Mail the Disclosure Document<br />

along with the fee to:<br />

Applicants can request a copy of their Disclosure<br />

Document as filed in the USPfO if they are the <strong>or</strong>iginal<br />

submitters of the document. <strong>The</strong> request must be<br />

made in writing and accompanied by a fee f<strong>or</strong> $25.<br />

Fees are subject to change annually. To confirm<br />

current fees, contact the General Inf<strong>or</strong>mation Services<br />

Division <strong>or</strong> visit the USPfO's Internet site (see MPEP<br />

§ 1730).<br />

NOTICE TO INVENTORS<br />

<strong>The</strong> two-year retention period is not a "grace<br />

period" during which the invent<strong>or</strong> can wait to file his<br />

<strong>or</strong> her patent application without possible.loss of ben-<br />

efits. It must be recognized that, in <strong>or</strong>der to establish<br />

pri<strong>or</strong>ity of invention, an affidavit <strong>or</strong> testimony referring<br />

to a Disclosure Document must usually also<br />

establish diligence in completing the invention <strong>or</strong> in<br />

filing the patent application after the filing of the Disclosure<br />

Document.<br />

Invent<strong>or</strong>s are also reminded that any public use<br />

<strong>or</strong> sale in the United States <strong>or</strong> publication of the<br />

invention anywhere in the w<strong>or</strong>ld m<strong>or</strong>e than oue<br />

year pri<strong>or</strong> to the filing of a patent application on<br />

that inventiou will prohibit the granting of a U.S.<br />

patent on it. See 35 U.S.C.I02(b). F<strong>or</strong>eign patent<br />

laws in this regard may be much m<strong>or</strong>e restrictive<br />

than U.S. laws.<br />

<strong>The</strong> USPfO advises invent<strong>or</strong>s who are not familiar<br />

with the requirements of U.S. patent law and procedures<br />

to consult an att<strong>or</strong>ney <strong>or</strong> agent registered to<br />

practice bef<strong>or</strong>e the USPfO. A list of Att<strong>or</strong>neys and<br />

Agents Registered to Practice Bef<strong>or</strong>e the U.S. <strong>Patent</strong><br />

and Trademark Office can be found at the USPfO's<br />

Internet site. See MPEP § 1730 f<strong>or</strong> additional sources<br />

of this list.<br />

As a service to USPfO's customers, the three Partnership<br />

<strong>Patent</strong> and Trademark Deposit<strong>or</strong>y Libraries<br />

(PfDLs) listed below have been auth<strong>or</strong>ized to act as<br />

USPfO's "agent" in accepting documents under the<br />

Disclosure Document Program. This service provides<br />

customers with a completed transaction on-site, eliminating<br />

the wait f<strong>or</strong> USPfO notification of acceptance.<br />

<strong>The</strong> documents are stamped with an identifying number<br />

and date at the time of receipt by the PfDL. Original<br />

documents are sent to the USPfO f<strong>or</strong> processing<br />

and retention.<br />
