described in Table III.E.1.b.i-1 below. Examples of batch splits using both types of
splitting protocols are given in Tables III.E.1.b.i-2 and III.E.1.b.i-3. We propose that the
Proportional Protocol be required for cases in which the Equivalence Value of a
renewable fuel is less than 1.0. For cases in which the Equivalence Value is equal to or
greater than 1.0, we propose to allow parties the flexibility to follow a batch splitting
protocol of their own choosing so long as there is at least one gallon-RIN for every
physical gallon in each of the daughter batches. We request comment on these batch
splitting protocols, any alternative protocols, and the need to codify a protocol in the
regulations for specific situations.
