As described in III.B.4.b, we are not proposing regulations that would specify the<br />

criteria under which a state could petition the EPA for a waiver <strong>of</strong> the RFS requirements,<br />

nor the ramifications <strong>of</strong> Agency approval <strong>of</strong> such a waiver in terms <strong>of</strong> the level or<br />

applicability <strong>of</strong> the st<strong>and</strong>ard. As a result, the proposed formula for the st<strong>and</strong>ard shown<br />

above does not include any components to account for Agency approval <strong>of</strong> a state<br />

petition for a waiver <strong>of</strong> the RFS requirements.<br />

EPA is proposing the following formula for calculating the cellulosic st<strong>and</strong>ard<br />

that is required beginning in 2013:<br />

Where, except for RFCelli, the variable descriptions are as discussed above. The<br />

definition <strong>of</strong> RFCelli is proposed as:<br />

RFCelli = <strong>Renewable</strong> <strong>Fuel</strong> Cellulosic St<strong>and</strong>ard in year i, in percent<br />

EPA requests comments on the components <strong>of</strong> both <strong>of</strong> the proposed formulas, <strong>and</strong><br />

on how the values for the components should be obtained.<br />

2. What Are The Applicable St<strong>and</strong>ards?<br />

EPA will set the percentage st<strong>and</strong>ard for each upcoming year based on the most<br />

recent EIA projections, <strong>and</strong> using the other sources <strong>of</strong> information as noted above. EPA<br />

will publish the st<strong>and</strong>ard in the Federal Register by November 30 <strong>of</strong> the preceding year.<br />

We are proposing the st<strong>and</strong>ard for 2007 <strong>and</strong> estimating the st<strong>and</strong>ard for later years based<br />

on current information using the formulas discussed above. The st<strong>and</strong>ards would be used<br />

to determine the renewable volume obligation based on an obligated party’s total gasoline<br />

production or import volume in a calendar year, January 1 through December 31. The<br />

percentage st<strong>and</strong>ards do not apply on a per gallon basis. An obligated party will calculate<br />

its <strong>Renewable</strong> Volume Obligation (discussed in Section III.A.4) using the annual<br />

st<strong>and</strong>ard.<br />
