Statutes Exempting Slaughter by Approved Methods:<br />

Connecticut<br />

Section 53-247 Cruelty to animals; fighting animals; intentional killing of police animal<br />

(b) … The provisions of this subsection shall not apply to any licensed veterinarian<br />

while following accepted standards of practice of the profession or to any person while<br />

following approved methods of slaughter under section 22-272a [emphasis added], while<br />

performing medical research as an employee of, student in or person associated with<br />

any hospital, educational institution or laboratory, while following generally accepted<br />

agricultural practices or while lawfully engaged in the taking of wildlife.<br />

Delaware<br />

Section 1325 Cruelty to animals; class A misdemeanor; class F felony<br />

(a) For the purpose of this section, the following words and phrases shall include, but not<br />

be limited to, the meanings respectively ascribed to them as follows:<br />

(11) “Animal” shall not include fish, crustacea or molluska…<br />

(b) A person is guilty of cruelty to animals when the person intentionally or recklessly:<br />

(4) Cruelly or unnecessarily kills or injures any animal whether belonging to the<br />

actor or another. This section does not apply to the killing of any animal normally<br />

or commonly raised for food for human consumption, provided that such killing is<br />

not cruel [emphasis added]. A person acts unnecessarily if the act is not required to<br />

terminate an animal’s suffering, to protect the life or property of the actor or another<br />

person or if other means of disposing of an animal exist which would not impair the<br />

health or well-being of that animal;<br />

Idaho<br />

Section 25-3514 Cruelty to animals<br />

No part of this chapter shall be construed as interfering with or allowing interference<br />

with:<br />

(2) The humane slaughter of any animal normally and commonly raised for food or<br />

for production of fiber;<br />

Oregon<br />

Chapter 167. Offenses against public health, decency and animals<br />

167.335 Exemption from ORS 167.315 to 167.333. Unless gross negligence can be<br />

shown, the provisions of ORS 167.315 to 167.333 do not apply to:<br />

(5) The killing of livestock according to the provisions of ORS 603.065 [state humane<br />

slaughter law];<br />

South Dakota<br />

Section 40-1-2.4 Inhumane treatment defined<br />

For the purposes of this chapter and chapter 40-2, the inhumane treatment of an animal is<br />

any act of mistreatment, torture, cruelty, neglect, abandonment, mutilation or inhumane<br />

slaughter of an animal that is not consistent with generally accepted training, use and<br />

husbandry procedures for the species, breed, physical condition and type of animal<br />

[emphasis added].<br />
