Tennessee<br />

Section 39-14-202 Cruelty to animals<br />

(e)(1) Nothing in this section shall be construed as prohibiting the owner of a farm animal<br />

or someone acting with the consent of the owner of such animal from engaging in usual<br />

and customary practices which are accepted by colleges of agriculture or veterinary<br />

medicine with respect to such animal.<br />

Texas<br />

Section 42.09 Cruelty to animals<br />

(h) It is a defense to prosecution under this section that the conduct engaged in by the<br />

actor is a generally accepted and otherwise lawful:<br />

(2) animal husbandry or farming practice involving livestock.<br />

Utah<br />

Section 76-9-301 Cruelty to animals<br />

(11) As used in this section:<br />

(b) (i) “Animal” means a live, nonhuman vertebrate creature.<br />

(ii) “Animal” does not include animals kept or owned for agricultural<br />

purposes and cared for in accordance with accepted husbandry practices,<br />

animals used for rodeo purposes, and does not include protected and<br />

unprotected wildlife as defined in Section 23-13-2.<br />

Vermont<br />

Section 13:352 Cruelty to animals<br />

A person commits the crime of cruelty to animals if the person:<br />

(3) ties, tethers, or restrains an animal, either a pet or livestock, in a manner that is<br />

inhumane or is detrimental to its welfare. Livestock and poultry husbandry practices are<br />

exempted.<br />

West Virginia<br />

Section 61-8-19 Cruelty to animals; penalties; exclusions<br />

(f) The provisions of this section do not apply to lawful acts of hunting, fishing, trapping<br />

or animal training or farm livestock, poultry, gaming fowl or wildlife kept in private or<br />

licensed game farms if kept and maintained according to usual and accepted standards<br />

of livestock, poultry, gaming fowl or wildlife or game farm production and management<br />

[emphasis added], nor to humane use of animals or activities regulated under and in<br />

conformity with the provisions of 7 U.S.C. 2131, et seq. [Federal Animal Welfare Act],<br />

and the regulations promulgated thereunder, as both statutes and regulations are in effect<br />

on the effective date of this section.<br />

Wyoming<br />

Section 6-3-203 Cruelty to animals; penalties; limitation on manner of destruction<br />

(m) Nothing in subsection (a), (b) or (n) of this section shall be construed to prohibit:<br />

(ii) The use of industry accepted agricultural and livestock practices on<br />

livestock;<br />
