NOTICE INVITING TENDER<br />

Sealed tenders are invited, on behalf <strong>of</strong> the President <strong>of</strong> <strong>India</strong>, by the<br />

Dy. Superintending Horticulturist, <strong>Archaeological</strong> <strong>Survey</strong> <strong>of</strong> <strong>India</strong>, Horticulture Division No.-II,<br />

Safdarjung Tomb, New Delhi from experienced, registered and eligible contractors <strong>of</strong><br />

CPWD/PWD/MES/Railways/ P & T Department / A.S.I. for the under mentioned work. The<br />

tenders will be received on 28/06/2010 up to 3.00 P.M. and will be opened on the same day<br />

at 3.30 P.M. in the presence <strong>of</strong> contractors or authorized representatives who chose to<br />

remain present.<br />

(Non-refundable) and another Bank Draft for the earnest money drawn only from Scheduled<br />

Bank in favour <strong>of</strong> ‘Deputy Superintending Horticulturist, <strong>Archaeological</strong> <strong>Survey</strong> <strong>of</strong> <strong>India</strong>,<br />

Horticulture Division No.-II, Safdarjung Tomb, New Delhi.’ Both drafts should be submitted<br />

along with tender document and following attested documents before or on the notified date.<br />

If the Bank draft for Rs.500/- as cost <strong>of</strong> Tender documents, bank draft for required earnest<br />

money and required following attested documents are not found attached with the tender<br />

document at the time <strong>of</strong> opening <strong>of</strong> tender, the tender document will be rejected outrightly.<br />

ITEM RATE TENDER & CONTRACT FOR WORK<br />

(<strong>Archaeological</strong> Works Code, Paragraph 13.4.3)<br />

General rules and directions<br />

Note:- In case any discrepancy is between the Hindi and the English version <strong>of</strong> the<br />

documents, the English version shall be final & binding.<br />

1. All the proposed for execution by contract notified in the form <strong>of</strong> invitation<br />

<strong>of</strong> tender posted in the public places and signed by the Circle / Branch<br />

Officer. This form will state the work to be carried out as well as the date<br />

for submitting and opening tenders and the time allowed for carrying out<br />

the work, also the amount <strong>of</strong> the earnest money to be deposited with the<br />

tender and the percentage <strong>of</strong> security deposited by the successful<br />

tenderer and the percentage, if any to be deducted from the bill. Copies <strong>of</strong><br />

the specification, designs and drawing and any other document required in<br />

the connection with the work signed for the purpose <strong>of</strong> identification by the<br />

circle / Branch <strong>of</strong>ficer shall also be open for inspection by the contractor at<br />

the <strong>of</strong>fice <strong>of</strong> the circle / Branch during <strong>of</strong>fice hours.<br />

2. In event <strong>of</strong> tender being submitted by a firm, it must be signed separately<br />

by each member there <strong>of</strong> or in the event <strong>of</strong> absence <strong>of</strong> any partner, it must<br />

be signed on the behalf by a person holding the power <strong>of</strong> attorney<br />

authorising him to do so, such power <strong>of</strong> attorney should be produced with<br />

the tender and it must be disclose that is duly registered under the <strong>India</strong>n<br />

Partnership Act.<br />

3. Receipt for the payment made on the account <strong>of</strong> work, when executed by the<br />

firm, must also be signed by the several Partners, except where the<br />

contractors have described in their tender as a firm, in which case the<br />

must be signed in the name <strong>of</strong> the firm by one the partner or be some<br />

other person having authority to give effectual receipts for the firm.<br />

4. Any person, who submits the tender, shall fill up the usual printed form,<br />

stating at what rate he is willing to undertake each item <strong>of</strong> work. Tenders,<br />

which propose any alteration in the work specified in the said form <strong>of</strong><br />

invitation <strong>of</strong> tender or which contains any other condition <strong>of</strong> any sort, will<br />

liable to rejection. No single tender shall include more than one work but<br />

contractor who wish to tender for two or more work shall submit a separate<br />

tender for each work. They shall have the name and number <strong>of</strong> the work to<br />

which they refer, written outside the envelope.<br />

A. The rate (s) /or amount (s) must be quoted in decimal coinage.


5. The Circle / Branch <strong>of</strong>ficer or his duly authorised assistant will open<br />

tenders in the presence <strong>of</strong> any intending contractors who may be present<br />

at the time and will enter the amount <strong>of</strong> the several tenders in a<br />

comparative statement in a suitable form. In the event <strong>of</strong> a tender being<br />

accepted, a receipt for the earnest money forwarded therewith shall there<br />

upon for the purpose <strong>of</strong> identification sign. Copies <strong>of</strong> the specifications and<br />

other documents mentioned in rule. In event <strong>of</strong> being tender being<br />

rejected, the earnest money appended with such unaccepted tender shall<br />

thereupon be returned to the contractor remitting the same.<br />

6. The <strong>of</strong>ficer inviting tenders shall have the right <strong>of</strong> rejecting all or any <strong>of</strong> the<br />

tenders and will not be bound to accept the lowest tender.<br />

7. The receipts <strong>of</strong> the accountant or a clerk for any money paid by contractor<br />

will not be considered as an acknowledgement <strong>of</strong> payment to the Circle /<br />

Branch <strong>of</strong>ficer and the contractor shall be responsible for seeing that he<br />

procures a receipt signed by the Circle /Branch <strong>of</strong>ficer or a duly authorised<br />

Cashier or the Drawing & Disbursing <strong>of</strong>ficer.<br />

8. The memorandum <strong>of</strong> work tendered for and the schedule <strong>of</strong> material to be<br />

supplied by the <strong>Archaeological</strong> <strong>Survey</strong> <strong>of</strong> <strong>India</strong> and their issue rates, shall<br />

be filled in and completed in the <strong>of</strong>fice <strong>of</strong> the Circle /Branch <strong>of</strong>ficer before<br />

the tender form is issued to an intending tenderer, without having been so<br />

filled in and not complete form, he shall request the <strong>of</strong>fice to have this<br />

done before he completes and delivers his tender.<br />

9. The tenderer shall sign a declaration under the <strong>of</strong>ficial Secret Act to maintain<br />

secrecy <strong>of</strong> the tender document, drawing or other records connected with<br />

the work given to them. The unsuccessful tenderer shall return all drawing<br />

given to them.<br />

DECLARATION<br />

I/We here by declare that I/We treat the tender documents, drawing and other<br />

records connected with the work as secret/confidential documents and shall not<br />

communicate information derived there from to any person other than a person to<br />

whom I/We am/ are authorised to communicate the same or use the information in<br />

any manner prejudicial to the safety <strong>of</strong> the state.<br />

CONTRACTOR<br />

I/We hereby tender for execution for the President <strong>of</strong> <strong>India</strong> <strong>of</strong> the work specified in<br />

the underwritten memorandum with in time specified therein and in accordance with<br />

and in all respects with specifications, designs, drawing and instructions in writing<br />

referred to in rule I there<strong>of</strong> and in clause II <strong>of</strong> the conditions <strong>of</strong> the contract and with<br />

such material as are provided for, by and in all respects in accordance with, such<br />

conditions so far as applicable.

(I) In case <strong>of</strong> works costing up to Rs. 1 lakh, 10% <strong>of</strong> the estimated cost <strong>of</strong> the work<br />

put to tender .<br />

(II) In case <strong>of</strong> works costing more than Rs. 1 lakh, and up to 2 lakh 10% <strong>of</strong> the first<br />

1lakh 7.5 % on the balance and<br />

(III) In case <strong>of</strong> works costing more than Rs. 2 lakh 10%on the first Rs. 1 lakh 7.5%<br />

on the next 1 lakh and 5% on the balance, subject to a maximum <strong>of</strong> Rs. 1 lakh<br />

only.<br />

The security deposit will be collected by deductions from the running bills <strong>of</strong> the<br />

Contractors at the rate mentioned above and the earnest, if deposited in cash at the<br />

time <strong>of</strong> tender as a part <strong>of</strong> security deposit.<br />

Government for the purpose.<br />

(e) Time allowed for the work will be reckoned from the 15 th day after the date<br />

<strong>of</strong> written order for completion within ……………………. Month.<br />

Should this tender be accepted in whole or in part, I/ We hereby agree (i)<br />

to abided by and fulfil all terms and provisions <strong>of</strong> the conditions annexed hereto<br />

and all terms and provisions contained in notice inviting tenders so far as<br />

applicable and / or in default there <strong>of</strong> forfeit and pay to the President <strong>of</strong> <strong>India</strong> or<br />

tender tainted or referred to therein and to carry out such deviations as may be<br />

TERMS AND CONDITIONS<br />

1. The work/ supply shall be carried out by the contractor/ firm strictly and in<br />

accordance with A.S.I specifications as amended from time to time. At<br />

present norms for maintenance <strong>of</strong> Garden include one Man / Acre and for<br />

Woodland it is ½ Man / Acre.<br />

2. The rates given for the works should be inclusive <strong>of</strong> all taxes, leads and<br />

lifts etc. Nothing extra shall be paid over the rates quoted by the<br />

contractor/ firm.<br />

3. In case the material is not as per specifications, the same shall be<br />

replaced by the contractor/ firm. The Department shall not be responsible<br />

for any theft or loss. If required, Department/ Govt. can remove the<br />

material at the risk and cost <strong>of</strong> the contractor / firm.<br />

4. No payment shall be made to the contractor / firm if the materials are<br />

damaged due to natural calamities before measurement.<br />

5. The competent authority reserves the right to accept or reject any or all the<br />

tenders without assigning any reason.<br />

6. Water charges @ 1% will be recovered from the contractor’s bill, wherever<br />

applicable.<br />

7. The tender must accompany the Earnest money <strong>of</strong> Rs………… in the form<br />

<strong>of</strong> bank draft <strong>of</strong> nationalized bank in favour <strong>of</strong> Dy. Suptdg. Horticulturist,<br />

A.S.I., H.D-II, Safdarjung Tomb, New Delhi. Cheque will not be accepted.<br />

Earnest money will be refundable after successful completion <strong>of</strong> work.<br />

8. It shall be the responsibility <strong>of</strong> the contractor / firm to ensure that no<br />

damage is caused to Govt. property at the site by his/ their vehicle or<br />

labour party. Cost <strong>of</strong> such damages, if any, will be assessed at the<br />

discretion <strong>of</strong> the Dy. Suptdg. Horticulturist and the same will have to be<br />

made good by the contractor / firm.<br />

9. The tender submitted on behalf <strong>of</strong> a firm shall be signed by all the partners<br />

<strong>of</strong> the firm or by a partner who is duly authorised on behalf <strong>of</strong> the firm to<br />

enter into contract. Otherwise the tender is liable to be rejected.<br />

10. The contractors / firm shall not sublet any portion <strong>of</strong> contract. Failing which<br />

the undersigned shall serve a notice, rescinding the contract, where upon<br />

the Earnest Money and Security Money shall be forfeited.<br />

11. Time shall be considered as the essence <strong>of</strong> the Contract. The entire work<br />

must be completed during 2009-10 from the date <strong>of</strong> award letter, failing<br />

which the remaining work can be reallotted to another contractor / firm at<br />

the risk and cost <strong>of</strong> the contractor / firm with due notice to the contractor /<br />

firm.<br />

12. The Contract/ agreement can be terminated at any time after serving one<br />

month notice due to Non-Availability <strong>of</strong> Funds or technical reasons or<br />

financial complications. In these circumstances no claim shall be made.<br />

Dept./ Govt. shall not pay any compensation on this account.<br />

13. The contractor / firm should comply the requirement <strong>of</strong> labour / child labour<br />

Act and they will be responsible for violation, if any.<br />

14. The contractor should maintain attendance and other records <strong>of</strong> the<br />

manpower engaged by him required under law and must observe all the<br />

formalities under the Labour act.<br />

15. Security Money will be deposited in advance by the contractor / firm whose<br />

tender is accepted by the competent authority.<br />

16. The running payment will be made as per rules <strong>of</strong> A.S.I.<br />

17. Error / omission if any shall be rectifiable with no claim.<br />

18. No claim whatsoever on account <strong>of</strong> fluctuations in prices will be<br />

entertained.<br />

19. In the event <strong>of</strong> the Site-in-charge being <strong>of</strong> the opinion that the Contractor is<br />

not employing on the works a sufficient number <strong>of</strong> staff and workmen as is<br />

necessary for the proper completion <strong>of</strong> the works within the time<br />

prescribed, the Contractor shall forthwith on receiving intimation to this<br />

effect take additional staff and labour (at his own expense) specified by the<br />

site-in-charge / Dy. S.H. within seven days <strong>of</strong> being so required and failure<br />

on the part <strong>of</strong> the contractor to comply with such instruction will entitle the<br />

company to rescind the contract under clause <strong>of</strong> these conditions.<br />

20. The Competent Authority reserves the right to increase or decrease upto 30%<br />

<strong>of</strong> the quantity <strong>of</strong> material/work at any time during the execution <strong>of</strong> work<br />

and before completion <strong>of</strong> work according to the requirement <strong>of</strong> the site and<br />

no claim whatsoever on this account shall be entertained.<br />

21.All gold, silver, oil and other materials or any antiques and other similar things,<br />

which may be found, in or upon the site shall be the property <strong>of</strong> the<br />

<strong>Archaeological</strong> <strong>Survey</strong> <strong>of</strong> <strong>India</strong>. Contractor / firm shall deliver the same to<br />

such persons as the Department may from time to time appoint to receive<br />

the same.<br />

22.The contractor / firm shall not be entitled to any compensation whatsoever on<br />

account <strong>of</strong> any delay or default in the supply <strong>of</strong> materials mentioned in the<br />

schedule.<br />

23. The contractor shall arrange at his own expenses for clear drinking water,<br />

housing, medical facilities necessary for the welfare <strong>of</strong> the labours<br />

employed at his work.<br />

24.Any material left on the site <strong>of</strong> work after one month from the date <strong>of</strong><br />

completion <strong>of</strong> the work shall become the property <strong>of</strong> the Govt. and no<br />

payment shall be made for it.<br />

25. The Department reserve the option to take away any item <strong>of</strong> the work or part<br />

there<strong>of</strong> any time during the currency <strong>of</strong> the contract and reallot it to<br />

another agency with due notice to the contractor / firm without liability or<br />

compensation.<br />

26. The Earnest Money and Security deposit <strong>of</strong> the successful contractor / firm<br />

will be forfeited, if he fails to comply with any <strong>of</strong> the conditions <strong>of</strong> the<br />

contract and work shall be carried out at risk and cost <strong>of</strong> the contractor /<br />

firm.<br />

27.Overall rates shall be considered for approval <strong>of</strong> tender.<br />

28.Value <strong>of</strong> item if above Rs. 50,000/- may be test checked by the Chief<br />

Horticulturist or his representative.<br />

29. The contractor will get themselves Registered with the PF & ESI<br />

Authorities and submit a pro<strong>of</strong> to this effect with the <strong>Archaeological</strong> <strong>Survey</strong><br />

<strong>of</strong> <strong>India</strong> for the regular employees on the roll <strong>of</strong> contractor.<br />

30. The Grass in lawns shall regularly moved with lawn mowers provided by<br />

the A.S.I. The thickness <strong>of</strong> the grass shall not be allowed to increase<br />

beyond 60 mm. the minimum thickness <strong>of</strong> grass shall be maintained as 50<br />

mm. The thickness shall be measured from top <strong>of</strong> the soil surface. The<br />

grass shall also be kept free from all kinds <strong>of</strong> weeds.<br />

31.Payment will be made as per actual measurement.<br />

32.The Department will provide required material, machinery and tools.<br />

33.The lawns shall be kept constantly rolled to give cushioning effect to the<br />

grass. The manuring <strong>of</strong> the lawn shall be done preferably in the months <strong>of</strong><br />

DECEMBER & JANUARY or as directed by the site-in-charge.<br />

(Manure/sludge/good earth/urea etc. wherever needed will be provided<br />

departmentally).<br />

34. As per clause 19-D <strong>of</strong> the agreement, it is obligatory on part <strong>of</strong> the<br />

contractor to provide following information / statement by 4 th and 19 th <strong>of</strong><br />

every month to the Garden in-charge in respect <strong>of</strong> IInd half <strong>of</strong> the<br />

preceding month and IInd half <strong>of</strong> current month respectively<br />

a). No. <strong>of</strong> the labour employed by him on the work.<br />

b). Their working hours<br />

c) The wages paid to them.<br />

d). The accidents that occurred during the said fortnight showing the<br />

circumstances under which that happened and the extent <strong>of</strong> damage<br />

and injury caused.<br />

e). The number <strong>of</strong> female workers who have been allowed maternity<br />

benefit according to clause 19-F and the amount paid to them.<br />

Failing which the contractor shall be liable to pay to govt. a sum not<br />

exceeding Rs.200/- for each default or materially incorrect statement. The<br />

decision <strong>of</strong> the Divisional <strong>of</strong>ficer shall be final in deducting from any bill<br />

due to the contractor the amount levied as fine and be binding on the<br />

contractor.<br />

35. In case, any laxity <strong>of</strong> garden maintenance is noticed at any time during<br />

the contract period, such works shall be carried out departmentally<br />

to the extent <strong>of</strong> recouping to the desired levels and costs will be<br />

recovered from the contractor.<br />

36.The contractor shall submit a pro<strong>of</strong> in support <strong>of</strong> engaged labour having<br />

applied for police verification to ensure safety & security <strong>of</strong> the<br />

monuments.<br />

37. The responsibility for providing any accommodation, feeding and sanitary<br />

necessities for the workmen employed by the Contractor shall be<br />

exclusively that <strong>of</strong> the contractor and such facilities can be provided<br />

outside the Site provided by the <strong>Archaeological</strong> <strong>Survey</strong> <strong>of</strong> <strong>India</strong>.<br />

38. The Contractor shall not allow his workmen to put up any unauthorized<br />

hutment, canteens or tea shops etc. on the <strong>Archaeological</strong> <strong>Survey</strong> <strong>of</strong><br />

<strong>India</strong>’s property.<br />

39.The seasonal flower beds and Rose beds should be kept maintained including<br />

preparation, manuring, watering, hoeing, etc. as per directions <strong>of</strong> the sitein-charge<br />

/ Dy. Superintending Horticulturist.<br />

40.Minimum one supervisor is to be engaged for 18 nos. <strong>of</strong> staff. The contractor<br />

must engage one full time, experienced supervisor who preferably should<br />

be an experienced agriculture graduate or retired<br />

Chaudhary (garden supervisor) on C.P.W.D., M.C.D., N.D.M.C., D.D.A. or<br />

other Govt. Deptt. Undertaking or firm <strong>of</strong> repute and with knowledge <strong>of</strong> the<br />

subject and he should be literate enough to maintain the required records.<br />

41. If any litigation arises through labour court or labour commissioner & any<br />

other court etc. on account <strong>of</strong> litigation through labourers engaged by him,<br />

the contractor will be fully responsible. Moreover, if claim arises out <strong>of</strong> any<br />

litigation, the contractor will be responsible for payment <strong>of</strong> such claim.<br />
