NOTICE INVITING TENDER
Sealed tenders are invited, on behalf of the President of India, by the
Dy. Superintending Horticulturist, Archaeological Survey of India, Horticulture Division No.-II,
Safdarjung Tomb, New Delhi from experienced, registered and eligible contractors of
CPWD/PWD/MES/Railways/ P & T Department / A.S.I. for the under mentioned work. The
tenders will be received on 28/06/2010 up to 3.00 P.M. and will be opened on the same day
at 3.30 P.M. in the presence of contractors or authorized representatives who chose to
remain present.

The tender form bearing details of materials can be had in this office on all
working days up to 5.00 P.M. on payment of Rs.500/- in cash. The Tender Form & Tender
Document can also be downloaded from the website of Archaeological Survey of India
www.asi.nic.in and must be accompanied by Bank Draft for Rs.500/- towards tender cost
(Non-refundable) and another Bank Draft for the earnest money drawn only from Scheduled
Bank in favour of ‘Deputy Superintending Horticulturist, Archaeological Survey of India,
Horticulture Division No.-II, Safdarjung Tomb, New Delhi.’ Both drafts should be submitted
along with tender document and following attested documents before or on the notified date.
If the Bank draft for Rs.500/- as cost of Tender documents, bank draft for required earnest
money and required following attested documents are not found attached with the tender
document at the time of opening of tender, the tender document will be rejected outrightly.
The tenderer must submit the attested copies of the following documents along
with the application for obtaining the tender documents or at the time of submission of tender
document, if downloaded from the website of A.S.I.:-
1. Proof of T.I.N. number.
2. Proof of Income Tax return for last three years.
3. Works experience as contractor at par of estimated cost or more for the last three
years with the CPWD/PWD/MES/Railways/P & T Department/ASI.
4. Proof of Registration in any Government Department.
5. Demand Draft for the earnest money drawn only from Scheduled Bank in favour of
‘Deputy Superintending Horticulturist, Archaeological Survey of India, Horticulture
Division No.-II, Safdarjung Tomb, New Delhi.’

ITEM RATE TENDER & CONTRACT FOR WORK
(Archaeological Works Code, Paragraph 13.4.3)
General rules and directions
Note:- In case any discrepancy is between the Hindi and the English version of the
documents, the English version shall be final & binding.
1. All the proposed for execution by contract notified in the form of invitation
of tender posted in the public places and signed by the Circle / Branch
Officer. This form will state the work to be carried out as well as the date
for submitting and opening tenders and the time allowed for carrying out
the work, also the amount of the earnest money to be deposited with the
tender and the percentage of security deposited by the successful
tenderer and the percentage, if any to be deducted from the bill. Copies of
the specification, designs and drawing and any other document required in
the connection with the work signed for the purpose of identification by the
circle / Branch officer shall also be open for inspection by the contractor at
the office of the circle / Branch during office hours.
2. In event of tender being submitted by a firm, it must be signed separately
by each member there of or in the event of absence of any partner, it must
be signed on the behalf by a person holding the power of attorney
authorising him to do so, such power of attorney should be produced with
the tender and it must be disclose that is duly registered under the Indian
Partnership Act.
3. Receipt for the payment made on the account of work, when executed by the
firm, must also be signed by the several Partners, except where the
contractors have described in their tender as a firm, in which case the
must be signed in the name of the firm by one the partner or be some
other person having authority to give effectual receipts for the firm.
4. Any person, who submits the tender, shall fill up the usual printed form,
stating at what rate he is willing to undertake each item of work. Tenders,
which propose any alteration in the work specified in the said form of
invitation of tender or which contains any other condition of any sort, will
liable to rejection. No single tender shall include more than one work but
contractor who wish to tender for two or more work shall submit a separate
tender for each work. They shall have the name and number of the work to
which they refer, written outside the envelope.
A. The rate (s) /or amount (s) must be quoted in decimal coinage.

5. The Circle / Branch officer or his duly authorised assistant will open
tenders in the presence of any intending contractors who may be present
at the time and will enter the amount of the several tenders in a
comparative statement in a suitable form. In the event of a tender being
accepted, a receipt for the earnest money forwarded therewith shall there
upon for the purpose of identification sign. Copies of the specifications and
other documents mentioned in rule. In event of being tender being
rejected, the earnest money appended with such unaccepted tender shall
thereupon be returned to the contractor remitting the same.
6. The officer inviting tenders shall have the right of rejecting all or any of the
tenders and will not be bound to accept the lowest tender.
7. The receipts of the accountant or a clerk for any money paid by contractor
will not be considered as an acknowledgement of payment to the Circle /
Branch officer and the contractor shall be responsible for seeing that he
procures a receipt signed by the Circle /Branch officer or a duly authorised
Cashier or the Drawing & Disbursing officer.
8. The memorandum of work tendered for and the schedule of material to be
supplied by the Archaeological Survey of India and their issue rates, shall
be filled in and completed in the office of the Circle /Branch officer before
the tender form is issued to an intending tenderer, without having been so
filled in and not complete form, he shall request the office to have this
done before he completes and delivers his tender.
9. The tenderer shall sign a declaration under the official Secret Act to maintain
secrecy of the tender document, drawing or other records connected with
the work given to them. The unsuccessful tenderer shall return all drawing
given to them.
DECLARATION
I/We here by declare that I/We treat the tender documents, drawing and other
records connected with the work as secret/confidential documents and shall not
communicate information derived there from to any person other than a person to
whom I/We am/ are authorised to communicate the same or use the information in
any manner prejudicial to the safety of the state.

the underwritten memorandum with in time specified therein and in accordance with
and in all respects with specifications, designs, drawing and instructions in writing
referred to in rule I thereof and in clause II of the conditions of the contract and with
such material as are provided for, by and in all respects in accordance with, such
conditions so far as applicable.

(I) In case of works costing up to Rs. 1 lakh, 10% of the estimated cost of the work
put to tender .
(II) In case of works costing more than Rs. 1 lakh, and up to 2 lakh 10% of the first
1lakh 7.5 % on the balance and
(III) In case of works costing more than Rs. 2 lakh 10%on the first Rs. 1 lakh 7.5%
on the next 1 lakh and 5% on the balance, subject to a maximum of Rs. 1 lakh
only.
The security deposit will be collected by deductions from the running bills of the
Contractors at the rate mentioned above and the earnest, if deposited in cash at the
time of tender as a part of security deposit.

3. Post office cash certificates, National saving certificates, Treasury saving
Certificates and National Plan Saving Certificates.
4. Post Office Saving Bank Pass books.

6. Deposit Receipts of Public Sector Recognised Banks (approved by
Government for the purpose.
(e) Time allowed for the work will be reckoned from the 15 th day after the date
of written order for completion within ……………………. Month.
Should this tender be accepted in whole or in part, I/ We hereby agree (i)
to abided by and fulfil all terms and provisions of the conditions annexed hereto
and all terms and provisions contained in notice inviting tenders so far as
applicable and / or in default there of forfeit and pay to the President of India or
his successors, in officer the sum of money mentioned in the said contentions. A
sum of Rs………. … is hereby forwarded in cash / Treasury challan / deposit at
call Receipt of a public sector Bank ( scheduled Bank guaranteed by through
Reserve Bank of India ) as earnest money. I/We fail to commence the work

forfeit the said earnest money absolutely, otherwise the said earnest money shall
be retained by him towards Security Deposits mentioned against clauses of the
above mentioned memorandum (ii) to execute all the works referred to in the
tender tainted or referred to therein and to carry out such deviations as may be

TERMS AND CONDITIONS
1. The work/ supply shall be carried out by the contractor/ firm strictly and in
accordance with A.S.I specifications as amended from time to time. At
present norms for maintenance of Garden include one Man / Acre and for
Woodland it is ½ Man / Acre.
2. The rates given for the works should be inclusive of all taxes, leads and
lifts etc. Nothing extra shall be paid over the rates quoted by the
contractor/ firm.
3. In case the material is not as per specifications, the same shall be
replaced by the contractor/ firm. The Department shall not be responsible
for any theft or loss. If required, Department/ Govt. can remove the
material at the risk and cost of the contractor / firm.
4. No payment shall be made to the contractor / firm if the materials are
damaged due to natural calamities before measurement.
5. The competent authority reserves the right to accept or reject any or all the
tenders without assigning any reason.
6. Water charges @ 1% will be recovered from the contractor’s bill, wherever
applicable.
7. The tender must accompany the Earnest money of Rs………… in the form
of bank draft of nationalized bank in favour of Dy. Suptdg. Horticulturist,
A.S.I., H.D-II, Safdarjung Tomb, New Delhi. Cheque will not be accepted.
Earnest money will be refundable after successful completion of work.
8. It shall be the responsibility of the contractor / firm to ensure that no
damage is caused to Govt. property at the site by his/ their vehicle or
labour party. Cost of such damages, if any, will be assessed at the
discretion of the Dy. Suptdg. Horticulturist and the same will have to be
made good by the contractor / firm.
9. The tender submitted on behalf of a firm shall be signed by all the partners
of the firm or by a partner who is duly authorised on behalf of the firm to
enter into contract. Otherwise the tender is liable to be rejected.
10. The contractors / firm shall not sublet any portion of contract. Failing which
the undersigned shall serve a notice, rescinding the contract, where upon
the Earnest Money and Security Money shall be forfeited.
11. Time shall be considered as the essence of the Contract. The entire work
must be completed during 2009-10 from the date of award letter, failing
which the remaining work can be reallotted to another contractor / firm at
the risk and cost of the contractor / firm with due notice to the contractor /
firm.
12. The Contract/ agreement can be terminated at any time after serving one
month notice due to Non-Availability of Funds or technical reasons or
financial complications. In these circumstances no claim shall be made.
Dept./ Govt. shall not pay any compensation on this account.
13. The contractor / firm should comply the requirement of labour / child labour
Act and they will be responsible for violation, if any.
14. The contractor should maintain attendance and other records of the
manpower engaged by him required under law and must observe all the
formalities under the Labour act.
15. Security Money will be deposited in advance by the contractor / firm whose
tender is accepted by the competent authority.
16. The running payment will be made as per rules of A.S.I.

17. Error / omission if any shall be rectifiable with no claim.
18. No claim whatsoever on account of fluctuations in prices will be
entertained.
19. In the event of the Site-in-charge being of the opinion that the Contractor is
not employing on the works a sufficient number of staff and workmen as is
necessary for the proper completion of the works within the time
prescribed, the Contractor shall forthwith on receiving intimation to this
effect take additional staff and labour (at his own expense) specified by the
site-in-charge / Dy. S.H. within seven days of being so required and failure
on the part of the contractor to comply with such instruction will entitle the
company to rescind the contract under clause of these conditions.
20. The Competent Authority reserves the right to increase or decrease upto 30%
of the quantity of material/work at any time during the execution of work
and before completion of work according to the requirement of the site and
no claim whatsoever on this account shall be entertained.
21.All gold, silver, oil and other materials or any antiques and other similar things,
which may be found, in or upon the site shall be the property of the
Archaeological Survey of India. Contractor / firm shall deliver the same to
such persons as the Department may from time to time appoint to receive
the same.
22.The contractor / firm shall not be entitled to any compensation whatsoever on
account of any delay or default in the supply of materials mentioned in the
schedule.
23. The contractor shall arrange at his own expenses for clear drinking water,
housing, medical facilities necessary for the welfare of the labours
employed at his work.
24.Any material left on the site of work after one month from the date of
completion of the work shall become the property of the Govt. and no
payment shall be made for it.
25. The Department reserve the option to take away any item of the work or part
thereof any time during the currency of the contract and reallot it to
another agency with due notice to the contractor / firm without liability or
compensation.
26. The Earnest Money and Security deposit of the successful contractor / firm
will be forfeited, if he fails to comply with any of the conditions of the
contract and work shall be carried out at risk and cost of the contractor /
firm.
27.Overall rates shall be considered for approval of tender.
28.Value of item if above Rs. 50,000/- may be test checked by the Chief
Horticulturist or his representative.
29. The contractor will get themselves Registered with the PF & ESI
Authorities and submit a proof to this effect with the Archaeological Survey
of India for the regular employees on the roll of contractor.
30. The Grass in lawns shall regularly moved with lawn mowers provided by
the A.S.I. The thickness of the grass shall not be allowed to increase
beyond 60 mm. the minimum thickness of grass shall be maintained as 50
mm. The thickness shall be measured from top of the soil surface. The
grass shall also be kept free from all kinds of weeds.
31.Payment will be made as per actual measurement.
32.The Department will provide required material, machinery and tools.

33.The lawns shall be kept constantly rolled to give cushioning effect to the
grass. The manuring of the lawn shall be done preferably in the months of
DECEMBER & JANUARY or as directed by the site-in-charge.
(Manure/sludge/good earth/urea etc. wherever needed will be provided
departmentally).
34. As per clause 19-D of the agreement, it is obligatory on part of the
contractor to provide following information / statement by 4 th and 19 th of
every month to the Garden in-charge in respect of IInd half of the
preceding month and IInd half of current month respectively
a). No. of the labour employed by him on the work.
b). Their working hours
c) The wages paid to them.
d). The accidents that occurred during the said fortnight showing the
circumstances under which that happened and the extent of damage
and injury caused.
e). The number of female workers who have been allowed maternity
benefit according to clause 19-F and the amount paid to them.
Failing which the contractor shall be liable to pay to govt. a sum not
exceeding Rs.200/- for each default or materially incorrect statement. The
decision of the Divisional officer shall be final in deducting from any bill
due to the contractor the amount levied as fine and be binding on the
contractor.
35. In case, any laxity of garden maintenance is noticed at any time during
the contract period, such works shall be carried out departmentally
to the extent of recouping to the desired levels and costs will be
recovered from the contractor.
36.The contractor shall submit a proof in support of engaged labour having
applied for police verification to ensure safety & security of the
monuments.
37. The responsibility for providing any accommodation, feeding and sanitary
necessities for the workmen employed by the Contractor shall be
exclusively that of the contractor and such facilities can be provided
outside the Site provided by the Archaeological Survey of India.
38. The Contractor shall not allow his workmen to put up any unauthorized
hutment, canteens or tea shops etc. on the Archaeological Survey of
India’s property.
39.The seasonal flower beds and Rose beds should be kept maintained including
preparation, manuring, watering, hoeing, etc. as per directions of the sitein-charge
/ Dy. Superintending Horticulturist.
40.Minimum one supervisor is to be engaged for 18 nos. of staff. The contractor
must engage one full time, experienced supervisor who preferably should
be an experienced agriculture graduate or retired

Chaudhary (garden supervisor) on C.P.W.D., M.C.D., N.D.M.C., D.D.A. or
other Govt. Deptt. Undertaking or firm of repute and with knowledge of the
subject and he should be literate enough to maintain the required records.
41. If any litigation arises through labour court or labour commissioner & any
other court etc. on account of litigation through labourers engaged by him,
the contractor will be fully responsible. Moreover, if claim arises out of any
litigation, the contractor will be responsible for payment of such claim.
