CONDITIONS OF CONTRACT.<br />

1. The normal working hours will be 8 hours a day from 8.00 A.M. to 5.00 P.M. with one hour lunch break from<br />

12.00 Noon to 1.00 PM subject to staggering <strong>of</strong> duty hours as per actual requirement.<br />

2. Minimum one supervisor is to be engaged for above 15 Nos. <strong>of</strong> staff. The Contractor must engage one full time<br />

supervisor who preferably should be an experience.<br />

3. The contractor should maintain attendance and other records <strong>of</strong> the manpower engaged by him required under<br />

labour law and must observe all the formalities under the labour act.<br />

4. The contractor shall provide uniform as decided by the Site – Incharge / Dy. Suptdg. Horticulturist at own cost.<br />

5. The department will provide a suitable place to store for T & P articles<br />

6. The Contractor will provide and utilize the garden equipment etc. including their repair and required fuel<br />

( Diesel / Petrol)<br />

7. The Contractor is forbidden to sell or gift any item from the garden area to any person or organization with out<br />

the prior written permission <strong>of</strong> the department.<br />

8. All the materials like good earth, manure, chemical fertilizer, insecticides, pesticides, seasonal flower seeds,<br />

water for irrigation and earthen / cement pots will be provided by the department as and when required.<br />

9. Contractor will follow the minimum wages act.<br />

10. The whole garden area should be kept neat and clean and maintained to its optimum level through out the year<br />

and garden area should be kept ready for inspection by judges at the time <strong>of</strong> garden competition.<br />

11. The maintenance will be carried out under supervision <strong>of</strong> the Dy. Suptdg. Horticulturist, or his representative i.e.<br />

Site Incharge. .<br />

12. The instructions <strong>of</strong> Garden Incharge to be carried out promptly. In case <strong>of</strong> any difference <strong>of</strong> opinion /<br />

interpretation <strong>of</strong> specifications and conditions, the matter is to be referred by the Contractor to the Divisional<br />

Head for his decision, which shall be final and binding.<br />

13. If any litigation arises through laboureres engaged by him through labour court or labour commissioner & any<br />

other court etc. on account <strong>of</strong> litigation. The contractor will be fully responsible, for payment <strong>of</strong> such claim.<br />

14. In case <strong>of</strong> non – satisfactory maintenance found in any area <strong>of</strong> the garden, the amount will be deleted at the time<br />

<strong>of</strong> payment according under intimation to the contractor with full opportunity, failing which the Dy. Suptdg.<br />

Horticulturist is competent to terminate the full agreement or party agreement on account <strong>of</strong> non-proper<br />

maintenance <strong>of</strong> the garden by the contractor.<br />

15. Labour not to be engaged below 18 year and above 60 years.<br />

16. Overall total amount is considered for approval <strong>of</strong> tender.<br />

17. Works should be carried out as per directions <strong>of</strong> garden incharge.<br />

18. The rates given for works should be inclusive <strong>of</strong> all taxes, leads and lifts etc. Nothing extra shall be paid over the<br />

rates quoted by the Contractors. / Firm.<br />

19. It shall be the responsibility <strong>of</strong> the Contractor / Firm to ensure that no damage is caused to Govt. Property at the<br />

site by his / their vehicle or labour party. Cost <strong>of</strong> such damages, if any will be assessed at the discretion <strong>of</strong> the<br />

Dy. Suptdg. Horticulturist and same will have to be made good by the Contractor / Firm.<br />

20. The Contractors / Firm shall not sublet any portion <strong>of</strong> Contract. Failing which the undersigned shall serve a<br />

notice, rescinding the contract, where upon the Earnest Money and Security Money shall be forfeited.<br />

21. The agreement can be cancelled at any time due to technical reasons or financial complications. In these<br />

circumstances no claim and no any compensation on this account shall be made on Department.<br />

22. The running payment will be made as per rules <strong>of</strong> ASI.<br />

23. Error / Omission if any shall be rectifiable with no claim.<br />

24. The Contractor Shall arranged to his own expenses for clear drinking water, housing, medical facilities necessary<br />

for the welfare <strong>of</strong> the labour employed at his work.<br />

25. The Deptt. Reserve the option <strong>of</strong> take away any item <strong>of</strong> the work or part there<strong>of</strong> any time during the occurrence<br />

<strong>of</strong> the contract and reallot it to another agency with due notice to the Contractor / Firm without liability or<br />

compensation.<br />

26. The contractor will be held responsible for any loss <strong>of</strong> Govt. property due to negligence <strong>of</strong> Watch & Ward and<br />

same will be replace by his at his own cost.<br />

27. The contract is subject to availability <strong>of</strong> funds, if funds are exhausted, then tender can be terminated at any time<br />

after serving one month notice.<br />

28. The filed staff to be engaged for One Man/ 2Acre for extensive area & one man/Acre for intensive area and the<br />

staff should have an experienced.<br />

29. Payment will be made as per survivality <strong>of</strong> trees shrubs at site.<br />

30. Letter <strong>of</strong> award can be withdrawn if the funds are not available after issuing one month notice.

General Rules and Directions<br />

Note: IN CASE OF ANY DISCREPANCY BETWEEN THE HINDI AND THE ENGLISH<br />

DOCUMENTS, THE ENGLISH VERSION SHALL BE FINAL & BINDING.<br />

1. All works proposed for execution by contract notified in forms <strong>of</strong> invitation <strong>of</strong> tender<br />

posted in public planes and signed by the Circle/Branch Officer. This form will state the<br />

work to be carried out as well as the date for submitting and opening tenders and the<br />

time allowed for carrying out the work: also the amount <strong>of</strong> earnest money to be<br />

deposited with tender, and the amount <strong>of</strong> the Secrurity Deposit to be deposited by the<br />

successful tendered and the percentage, if any to be deducted from the bills. Copies <strong>of</strong><br />

the specification, designs and drawings and any other documents, required in<br />

connection with the work signed for the purpose <strong>of</strong> identification be the Circle/Branch<br />

Officer shall also be open for inspection by the contractor at the <strong>of</strong>fice <strong>of</strong> the circle /<br />

branch during <strong>of</strong>fice hours.<br />

2. In the event <strong>of</strong> the tender being submitted by a firm, it must be signed separately by<br />

each member there <strong>of</strong>, or in the event <strong>of</strong> the absence <strong>of</strong> any partner, it must be signed<br />

on this behalf by a person holding a power <strong>of</strong> attorney authorizing him to do so such<br />

power <strong>of</strong> attorney should be produced with the tender, and it must disclose that the<br />

firm is duly registered under the <strong>India</strong>n Partnership Act.<br />

3. Receipt for payment made on account <strong>of</strong> work, when executed by a firm, must also be<br />

signed by the several partners, except where the contractors are described in their<br />

tender as a firm, in which case the receipt must be signed in the name <strong>of</strong> the firm by<br />

one <strong>of</strong> the partner, or be some other person having authority to give effectual receipts<br />

for the firm.<br />

4. Any person who submits a tender shall fill up the usual printed form, stating at what<br />

rate he is willing to undertake each items <strong>of</strong> the work. Tenders which propose any<br />

alteration in the work specified in the said form <strong>of</strong> invitation to tender, or which<br />

contains any other condition <strong>of</strong> any sort, will be liable to rejection. No single tender<br />

shall include more than one work but contractors who wish to tender for two or more<br />

works shall submit a separate tender for each work. The tender shall have the name<br />

and number <strong>of</strong> the work to which they refer written outside the envelope.<br />

5. The rate(s) and / or amount (s) must be quoted in decimal coinage.<br />

6. The Circle/Branch Officer or his duly authorized assistant will open tenders in the<br />

presence <strong>of</strong> any intending contractors who may be present at the time and will enter<br />

the amount <strong>of</strong> the several tenders in a comparative statement in a suitable form. In the<br />

event <strong>of</strong> a tender being accepted, a receipt for the earnest money forwarded therewith<br />

shall thereupon for the purpose <strong>of</strong> identification sign. Copies <strong>of</strong> the specifications and<br />

other documents mentioned in Rule. In the event <strong>of</strong> tender being rejected, the Earnest<br />

money appended with such unaccepted tender shall thereupon be returned to the<br />

contractor remitting the same.<br />

7. The <strong>of</strong>ficer inviting tenders shall have the right <strong>of</strong> rejecting all or any <strong>of</strong> the tenders,<br />

and will not be bound to accept the lowest tender.<br />

8. The receipts <strong>of</strong> an accountant or a clerk for any money paid by the contractor will not<br />

be considered as an acknowledgment <strong>of</strong> payment to the Circle/Branch Officer and the<br />

contractor shall be responsible for seeing that he procures a receipt signed by the<br />

Circle/branch Officer or a duly authorized cashier or the drawing and Disbursing Officer.<br />

9. The memorandum <strong>of</strong> work tendered for and the schedule <strong>of</strong> materials to be supplied by<br />

the <strong>Archaeological</strong> <strong>Survey</strong> <strong>of</strong> <strong>India</strong> and their issue rates, shall be filled in and completed<br />

in the <strong>of</strong>fice <strong>of</strong> the circle / branch <strong>of</strong>ficer before the tender form is issued to an<br />

intending tendered without having been so filled in and not in complete form, he shall<br />

request the <strong>of</strong>fice to have this done before he completes and delivers his tender.<br />

10. The tenders shall sign a declaration under the <strong>of</strong>ficial Secret Act for maintain a secrecy<br />

<strong>of</strong> the tender documents, drawings or other records connected with the work given to<br />

them. The unsuccessful tenders hall return all the drawing given to them<br />

DECLARATION<br />

I/We hereby declare that I/We treat the tender documents, drawings and other records<br />

connected with work as secret /confidential documents and shall not communicate information<br />

derived there from to any person other than a person to whom I/We am/are authorized to<br />

communicate the same or use the information in any manner prejudicial to the safety <strong>of</strong> the<br />

State.<br />

other right or remedy, by that liberty to forfeit the said Earnest Money absolutely,<br />

otherwise the said earnest Money shall be retained by him towards Security Deposit<br />

mentioned against Claused <strong>of</strong> the above mentions Memorandum (ii) to execute all the<br />

works referred to in the tender tained or referred to therein and to carry out such<br />

deviations as may be ordered. Up to a maximum <strong>of</strong><br />

those in excess <strong>of</strong> that limit at the rates to be determined in accordance with provision<br />
