1 In one <strong>of</strong> the ICQ chats dated July 15, 2008, 3FN's Head <strong>of</strong> Programm<strong>in</strong>g engages <strong>in</strong> a<br />
2 conversation with a customer regard<strong>in</strong>g the number <strong>of</strong> compromised computers the customer<br />
3 controls. Drexler Decl., Ex 7 at p. 361-362. The customer <strong>in</strong>forms 3FN that he controls a total<br />
4 <strong>of</strong> 200,000 compromised computers, with 20,000 onl<strong>in</strong>e <strong>and</strong> available for use at the time <strong>of</strong>the<br />
5 chat. Id. The customer then <strong>of</strong>fers this massive network <strong>of</strong>bots to 3FN. The head <strong>of</strong>3FN's<br />
6 Programm<strong>in</strong>g Department agrees to work with the customer, but compla<strong>in</strong>s upon learn<strong>in</strong>g <strong>of</strong> the<br />
7 size <strong>of</strong>the botnet that it will require a lot <strong>of</strong> effort. Id. at p. 361. The substance <strong>of</strong> the chat<br />
