G- Link to an Appeal System<br />

Regardless of how well the plan does, there will always be occasi<strong>on</strong>s<br />

of dispute between the plan and members about decisi<strong>on</strong>s <strong>on</strong> medical necessity.<br />

The c<strong>on</strong>tract should therefore clearly spell out an appropriate<br />

grievance and appeal mechanism, and the c<strong>on</strong>tract's definiti<strong>on</strong> of meditally<br />

necessary' should form the basis for resolving such disputes.<br />

Sancti<strong>on</strong>s In developing c<strong>on</strong>tracts for managed mental health care, states will<br />

need to address the issue of what sancti<strong>on</strong>s areapplied should the plan<br />

fail to comply with the provisi<strong>on</strong>s of the c<strong>on</strong>tract: Unless specific sancti<strong>on</strong>s<br />

apply if a plan violates the requirements of the medical-necessity<br />

criteria, the state will have <strong>on</strong>ly limited opti<strong>on</strong>s: to ignore the violati<strong>on</strong>s,<br />

to pressure the plan to address the violati<strong>on</strong>s or to cancel the entire<br />

c<strong>on</strong>tract. A better approach would be to delineate specific interim<br />

sancti<strong>on</strong>s, such as m<strong>on</strong>etary penalties, for failure to follow the medicalnecessity<br />

criteria appropriately.<br />

Failure of a plan to deliver services according to the above criteria shall be Cause<br />
