It is important to note that <str<strong>on</strong>g>Medicaid</str<strong>on</strong>g> itself recognizes a range of services<br />

as 'medical.' Under <str<strong>on</strong>g>Medicaid</str<strong>on</strong>g>, n<strong>on</strong>medical clinical services (i.e.,<br />

services of psychologists and psychiatric social workers), case management,<br />

rehabilitati<strong>on</strong>, pers<strong>on</strong>al assistance, speech therapy and oeacupati<strong>on</strong>al<br />

therapy are reimbursable. Using the term 'medically necessary<br />

services' in a <str<strong>on</strong>g>Medicaid</str<strong>on</strong>g> c<strong>on</strong>text rherefore does not substantiallv limit the<br />

range of mental health services covered.<br />

Below is a proposed definiti<strong>on</strong> of medically necessary services for inclusi<strong>on</strong><br />

in managed care c<strong>on</strong>tracts, based <strong>on</strong> the approach suggested<br />

here. The secti<strong>on</strong>s that follow lay out issues to address under each facet<br />

-of the definiti<strong>on</strong>, illustrating the new approach with suggested language.<br />

This material is not intended as a 'model' definiti<strong>on</strong>. Each state definiti<strong>on</strong><br />

will need to be crafted individually to reflect the unique aspects of<br />

a state's current legal code, goals, c<strong>on</strong>sumer, family and advocate aspirati<strong>on</strong>s,<br />

and the organizati<strong>on</strong> of the state's service system.<br />

A medically necessary service is a service:<br />

* furnshedin accordance with thegoals of srr cs decsed in paragraph<br />

(A);<br />

* funishedlor the s purpoes dsribed in paragraph (B),<br />

* that meets the standxrdis of ser-ice delivery in paragraph (C); and<br />

* that, in the case of individuals underage 21, meets the additi<strong>on</strong>al standards<br />

in paragraph (D).<br />

Medually necessary service shall h provided in accordance wirth paragraph (E).<br />

which prohibits arbitrary acti<strong>on</strong>s by the c<strong>on</strong>tractor to limit services, and through<br />

a process that meets the requirements in paragraph (P9 and shall be appropriately<br />

linked to the grimence and appeal system as required in paragraph (G).<br />

A. r;oaLs of Services<br />

The first questi<strong>on</strong> a 'medically necessary' definiti<strong>on</strong> must answer is:<br />

necessary for what end) Services and supports are provided to achieve<br />

certain goals, both for the individual and for society. Articulati<strong>on</strong> of<br />

these goals in the medical necessity definiti<strong>on</strong> will enable the state to<br />

clearly articulate the overall objectives of its mental health system and<br />

provides the foundati<strong>on</strong> for addressing other critical issues.<br />

Many states have articulated-goals in their waiver plans or requests<br />

for proposals, and a few include them in their c<strong>on</strong>tract language. However,<br />

including this language in the c<strong>on</strong>tract does not necessarily create a<br />
