. Real property and equipment records. The retention period for real property and equipment<br />

records starts from <strong>the</strong> date <strong>of</strong> disposition or replacement or transfer, whichever is later.<br />

4. GDEM, <strong>the</strong> Texas Department <strong>of</strong> Public Safety, Texas State Auditor, or any <strong>of</strong> <strong>the</strong>ir authorized<br />

representatives, shall have <strong>the</strong> right <strong>of</strong> access to any pertinent books, documents, papers, or<br />

o<strong>the</strong>r records <strong>of</strong> grantees which are pertinent to <strong>the</strong> grant, in order to make audits, examinations,<br />

excerpts, and transcripts. This right <strong>of</strong> access is not limited to <strong>the</strong> required retention period but<br />

shall last as long as <strong>the</strong> records are retained.<br />

V. Procurement<br />

A. Procurement Standards<br />

1. Grantees will use <strong>the</strong>ir own procurement procedures that reflect applicable state and local laws<br />

and regulations, provided that <strong>the</strong> procurements conform to standards in this section.<br />

2. Grantees will maintain a contract administration system that ensures that contractors perform in<br />

accordance with <strong>the</strong> terms, conditions, and specifications <strong>of</strong> <strong>the</strong>ir contracts or purchase orders.<br />

. Grantees will maintain a written code <strong>of</strong> standards <strong>of</strong> conduct governing <strong>the</strong> performance <strong>of</strong> <strong>the</strong>ir<br />

employees engaged in <strong>the</strong> award and administration <strong>of</strong> contracts. See UGMS §__.14, Subsection<br />

(a) (1) and Chapter 171, Local Government Code, for additional ethics provisions.<br />

4. Grantees will maintain records sufficient to detain <strong>the</strong> significant history <strong>of</strong> procurements.<br />

5. Grantees will have protest procedures to handle and resolve disputes relating to <strong>the</strong>ir<br />

procurements and shall in all instances disclose information regarding <strong>the</strong> protest to GDEM.<br />

B. Competition<br />

1. All procurement transactions will be conducted in a manner providing full and open competition<br />

consistent with <strong>the</strong> procurement standards. See UGMS §__. 6, Subsection (b).<br />

2. Grantees will ensure that all pre-qualified lists <strong>of</strong> persons, firms, or products that are used<br />

in acquiring goods and services are current and include enough qualified sources to ensure<br />

maximum open and free competition.<br />

. The Texas Procurement and Support Services (TPASS) Cooperative Purchasing Program (State <strong>of</strong><br />

Texas CO-OP) provides <strong>the</strong> State <strong>of</strong> Texas volume purchasing power to local governments and<br />

assistance organizations. Members can purchase goods and services from state term contracts,<br />

Texas Multiple Award Schedule (TXMAS) contracts, and piggyback contracts. A grantee that<br />

chooses to use any <strong>of</strong> <strong>the</strong>se services through <strong>the</strong> State <strong>of</strong> Texas CO-OP will meet state competitive<br />

bidding requirements. The State <strong>of</strong> Texas CO-OP can be accessed at http://www.window.state.<br />
