<str<strong>on</strong>g>Rule</str<strong>on</strong>g> <str<strong>on</strong>g>51.5.</str<strong>on</strong>g> <str<strong>on</strong>g>Certificati<strong>on</strong></str<strong>on</strong>g> <str<strong>on</strong>g>by</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>committee</str<strong>on</strong>g> <strong>on</strong> functi<strong>on</strong>al <strong>equivalency</strong>.<br />

1. <str<strong>on</strong>g>Certificati<strong>on</strong></str<strong>on</strong>g> prior to applicati<strong>on</strong>. A prospective applicant who fails to meet <str<strong>on</strong>g>the</str<strong>on</strong>g> accreditati<strong>on</strong> requirement<br />

of <str<strong>on</strong>g>Rule</str<strong>on</strong>g> 51(1)(c) shall not be permitted to apply for admissi<strong>on</strong> to practice law unless <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>committee</str<strong>on</strong>g> <strong>on</strong> functi<strong>on</strong>al<br />

<strong>equivalency</strong> certifies that he or she has met <str<strong>on</strong>g>the</str<strong>on</strong>g> qualificati<strong>on</strong>s set forth in this rule. To request certificati<strong>on</strong>, a<br />

prospective applicant must petiti<strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>committee</str<strong>on</strong>g> <strong>on</strong> functi<strong>on</strong>al <strong>equivalency</strong> in accordance with <str<strong>on</strong>g>the</str<strong>on</strong>g> provisi<strong>on</strong>s of<br />

this rule and <str<strong>on</strong>g>the</str<strong>on</strong>g> policies and procedures of <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>committee</str<strong>on</strong>g>.<br />

Only prospective applicants satisfying <str<strong>on</strong>g>the</str<strong>on</strong>g> qualificati<strong>on</strong>s set forth in paragraphs (a), (b), or (c) of this subsecti<strong>on</strong><br />

may petiti<strong>on</strong> for such certificati<strong>on</strong>. A prospective applicant must include with <str<strong>on</strong>g>the</str<strong>on</strong>g> petiti<strong>on</strong> satisfactory evidence that<br />

he or she meets <str<strong>on</strong>g>the</str<strong>on</strong>g>se qualificati<strong>on</strong>s; o<str<strong>on</strong>g>the</str<strong>on</strong>g>rwise <str<strong>on</strong>g>the</str<strong>on</strong>g> petiti<strong>on</strong> shall be summarily denied, without review.<br />

The following qualificati<strong>on</strong>s are required for certificati<strong>on</strong>:<br />

(a) Graduati<strong>on</strong> from an unaccredited law school within <str<strong>on</strong>g>the</str<strong>on</strong>g> American Bar Associati<strong>on</strong>’s accreditati<strong>on</strong> jurisdicti<strong>on</strong><br />

and satisfactory evidence that:<br />

(1) <str<strong>on</strong>g>the</str<strong>on</strong>g> petiti<strong>on</strong>er has been admitted to practice law in any jurisdicti<strong>on</strong>, including ano<str<strong>on</strong>g>the</str<strong>on</strong>g>r state of <str<strong>on</strong>g>the</str<strong>on</strong>g> United<br />

States of America, a territory of <str<strong>on</strong>g>the</str<strong>on</strong>g> United States of America, <str<strong>on</strong>g>the</str<strong>on</strong>g> District of Columbia, or a foreign country; and<br />

(2) <str<strong>on</strong>g>the</str<strong>on</strong>g> petiti<strong>on</strong>er has been, for at least ten of <str<strong>on</strong>g>the</str<strong>on</strong>g> preceding twelve years, lawfully engaged in <str<strong>on</strong>g>the</str<strong>on</strong>g> full-time<br />

practice of law in <str<strong>on</strong>g>the</str<strong>on</strong>g> jurisdicti<strong>on</strong> where <str<strong>on</strong>g>the</str<strong>on</strong>g> petiti<strong>on</strong>er is admitted to practice law or in any o<str<strong>on</strong>g>the</str<strong>on</strong>g>r jurisdicti<strong>on</strong>,<br />

provided that if <str<strong>on</strong>g>the</str<strong>on</strong>g> legal work experience takes place in a foreign country, it is a country where <str<strong>on</strong>g>the</str<strong>on</strong>g> English comm<strong>on</strong><br />

law substantially forms <str<strong>on</strong>g>the</str<strong>on</strong>g> basis of that country’s jurisprudence, and where English is <str<strong>on</strong>g>the</str<strong>on</strong>g> language of instructi<strong>on</strong><br />

and practice in <str<strong>on</strong>g>the</str<strong>on</strong>g> courts of that jurisdicti<strong>on</strong>; and<br />

(3) <str<strong>on</strong>g>the</str<strong>on</strong>g> petiti<strong>on</strong>er’s legal educati<strong>on</strong>, as augmented <str<strong>on</strong>g>by</str<strong>on</strong>g> such subsequent legal work experience, is now<br />

functi<strong>on</strong>ally equivalent to an educati<strong>on</strong> provided <str<strong>on</strong>g>by</str<strong>on</strong>g> a law school accredited <str<strong>on</strong>g>by</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> American Bar Associati<strong>on</strong>.<br />

(b) Graduati<strong>on</strong> from a law school that was not accredited <str<strong>on</strong>g>by</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> American Bar Associati<strong>on</strong> at <str<strong>on</strong>g>the</str<strong>on</strong>g> time of <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

petiti<strong>on</strong>er’s graduati<strong>on</strong> but which has since achieved accreditati<strong>on</strong> and satisfactory evidence that:<br />

(1) <str<strong>on</strong>g>the</str<strong>on</strong>g> law school achieved American Bar Associati<strong>on</strong> accreditati<strong>on</strong> no more than 3 years after <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

petiti<strong>on</strong>er’s graduati<strong>on</strong>; and<br />

(2) <str<strong>on</strong>g>the</str<strong>on</strong>g> legal educati<strong>on</strong> received is functi<strong>on</strong>ally equivalent to an educati<strong>on</strong> provided <str<strong>on</strong>g>by</str<strong>on</strong>g> a law school<br />

accredited <str<strong>on</strong>g>by</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> American Bar Associati<strong>on</strong>.<br />

(c) Graduati<strong>on</strong> from a foreign law school outside <str<strong>on</strong>g>the</str<strong>on</strong>g> accreditati<strong>on</strong> jurisdicti<strong>on</strong> of <str<strong>on</strong>g>the</str<strong>on</strong>g> American Bar Associati<strong>on</strong><br />

and satisfactory evidence that <str<strong>on</strong>g>the</str<strong>on</strong>g> petiti<strong>on</strong>er ei<str<strong>on</strong>g>the</str<strong>on</strong>g>r:<br />

(1) meets <str<strong>on</strong>g>the</str<strong>on</strong>g> requirements of <str<strong>on</strong>g>Rule</str<strong>on</strong>g> 51.5(1)(a) above; or<br />

(2) received a legal educati<strong>on</strong> that is functi<strong>on</strong>ally equivalent to an educati<strong>on</strong> provided <str<strong>on</strong>g>by</str<strong>on</strong>g> a law school<br />

accredited <str<strong>on</strong>g>by</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> American Bar Associati<strong>on</strong>.<br />

2. Practice of law. For purposes of this rule, <str<strong>on</strong>g>the</str<strong>on</strong>g> term “practice of law” shall mean:<br />

(a) private practice as a sole practiti<strong>on</strong>er or for a law firm, legal services office, legal clinic or <str<strong>on</strong>g>the</str<strong>on</strong>g> like;<br />

(b) practice as an attorney for an individual, a corporati<strong>on</strong>, partnership, trust, or o<str<strong>on</strong>g>the</str<strong>on</strong>g>r entity, with <str<strong>on</strong>g>the</str<strong>on</strong>g> primary<br />

duties of furnishing legal counsel, researching legal issues, drafting legal documents, pleadings, and memoranda,<br />

interpreting and giving advice regarding <str<strong>on</strong>g>the</str<strong>on</strong>g> law, or preparing, trying or presenting cases before courts, departments<br />

of government or administrative agencies;<br />

(c) practice as an attorney for <str<strong>on</strong>g>the</str<strong>on</strong>g> federal government or for a state government with <str<strong>on</strong>g>the</str<strong>on</strong>g> same primary duties<br />

described in paragraph (b) of this subsecti<strong>on</strong>;<br />

(d) employment as a judge, magistrate, referee, arbitrator, mediator, or similar official, provided that such<br />

employment is available <strong>on</strong>ly to licensed attorneys;<br />

(e) legal service in <str<strong>on</strong>g>the</str<strong>on</strong>g> armed forces of <str<strong>on</strong>g>the</str<strong>on</strong>g> United States;<br />

(f) employment as a full-time teacher of law at a law school accredited <str<strong>on</strong>g>by</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> American Bar Associati<strong>on</strong>; or<br />

(g) any combinati<strong>on</strong> of <str<strong>on</strong>g>the</str<strong>on</strong>g> above.<br />

3. Filing. A petiti<strong>on</strong> for certificati<strong>on</strong> under this rule must be filed with <str<strong>on</strong>g>the</str<strong>on</strong>g> admissi<strong>on</strong>s director no later than<br />

September 1 of <str<strong>on</strong>g>the</str<strong>on</strong>g> year prior to <str<strong>on</strong>g>the</str<strong>on</strong>g> year in which <str<strong>on</strong>g>the</str<strong>on</strong>g> petiti<strong>on</strong>er seeks to sit for <str<strong>on</strong>g>the</str<strong>on</strong>g> bar examinati<strong>on</strong>. The petiti<strong>on</strong><br />

must be verified, and shall c<strong>on</strong>tain a statement of facts accompanied <str<strong>on</strong>g>by</str<strong>on</strong>g> copies of all relevant documents, a statement<br />

of each ground up<strong>on</strong> which relief is alleged to be warranted, and legal points and authorities, setting forth <str<strong>on</strong>g>the</str<strong>on</strong>g> legal<br />

basis for each ground for <str<strong>on</strong>g>the</str<strong>on</strong>g> relief requested.<br />

4. Refer to <str<strong>on</strong>g>committee</str<strong>on</strong>g> <strong>on</strong> moral character and fitness. If <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>committee</str<strong>on</strong>g> has noted questi<strong>on</strong>s relating to <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

petiti<strong>on</strong>er’s ability to meet <str<strong>on</strong>g>the</str<strong>on</strong>g> moral character and fitness requirements of <str<strong>on</strong>g>Rule</str<strong>on</strong>g> 51(4), (5), (6), (7), (8), or (9), <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

<str<strong>on</strong>g>committee</str<strong>on</strong>g> may recommend to <str<strong>on</strong>g>the</str<strong>on</strong>g> board of bar examiners that <str<strong>on</strong>g>the</str<strong>on</strong>g> petiti<strong>on</strong>er be referred to <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>committee</str<strong>on</strong>g> <strong>on</strong> moral<br />

character and fitness for fur<str<strong>on</strong>g>the</str<strong>on</strong>g>r investigati<strong>on</strong> and/or hearings prior to review <str<strong>on</strong>g>by</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>committee</str<strong>on</strong>g> <strong>on</strong> functi<strong>on</strong>al<br />

<strong>equivalency</strong>.


5. Favorable recommendati<strong>on</strong>. If <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>committee</str<strong>on</strong>g> <strong>on</strong> functi<strong>on</strong>al <strong>equivalency</strong> recommends that certificati<strong>on</strong> be<br />

granted, <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>committee</str<strong>on</strong>g> shall file a report with <str<strong>on</strong>g>the</str<strong>on</strong>g> board of bar examiners, toge<str<strong>on</strong>g>the</str<strong>on</strong>g>r with proof of service <str<strong>on</strong>g>by</str<strong>on</strong>g> mail <strong>on</strong><br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> petiti<strong>on</strong>er, certifying to <str<strong>on</strong>g>the</str<strong>on</strong>g> board of bar examiners that <str<strong>on</strong>g>the</str<strong>on</strong>g> petiti<strong>on</strong>er has met <str<strong>on</strong>g>the</str<strong>on</strong>g> qualificati<strong>on</strong>s set forth in<br />

subsecti<strong>on</strong> 1(a), 1(b), or 1(c) of this rule. Service <str<strong>on</strong>g>by</str<strong>on</strong>g> mail shall be complete up<strong>on</strong> mailing. The report shall be filed<br />

with <str<strong>on</strong>g>the</str<strong>on</strong>g> board of bar examiners within 30 days of <str<strong>on</strong>g>the</str<strong>on</strong>g> c<strong>on</strong>clusi<strong>on</strong> of any hearing, unless o<str<strong>on</strong>g>the</str<strong>on</strong>g>rwise ordered <str<strong>on</strong>g>by</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

board of bar examiners. Up<strong>on</strong> such a certificati<strong>on</strong>, <str<strong>on</strong>g>the</str<strong>on</strong>g> board of bar examiners shall permit <str<strong>on</strong>g>the</str<strong>on</strong>g> petiti<strong>on</strong>er to apply for<br />

admissi<strong>on</strong>, unless <str<strong>on</strong>g>the</str<strong>on</strong>g> board determines that fur<str<strong>on</strong>g>the</str<strong>on</strong>g>r investigati<strong>on</strong> is necessary. The petiti<strong>on</strong>er may, in <str<strong>on</strong>g>the</str<strong>on</strong>g> board’s<br />

discreti<strong>on</strong>, be permitted to sit for <str<strong>on</strong>g>the</str<strong>on</strong>g> bar examinati<strong>on</strong> if <str<strong>on</strong>g>the</str<strong>on</strong>g> petiti<strong>on</strong>er meets all o<str<strong>on</strong>g>the</str<strong>on</strong>g>r applicable requirements.<br />

6. Adverse recommendati<strong>on</strong>. If <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>committee</str<strong>on</strong>g> <strong>on</strong> functi<strong>on</strong>al <strong>equivalency</strong> recommends that certificati<strong>on</strong> be<br />

denied, <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>committee</str<strong>on</strong>g> shall file a report with <str<strong>on</strong>g>the</str<strong>on</strong>g> board of bar examiners, toge<str<strong>on</strong>g>the</str<strong>on</strong>g>r with proof of service <str<strong>on</strong>g>by</str<strong>on</strong>g> mail <strong>on</strong><br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> petiti<strong>on</strong>er, describing <str<strong>on</strong>g>the</str<strong>on</strong>g> basis for its adverse recommendati<strong>on</strong>. Service <str<strong>on</strong>g>by</str<strong>on</strong>g> mail shall be complete up<strong>on</strong> mailing.<br />

The report shall be filed with <str<strong>on</strong>g>the</str<strong>on</strong>g> board of bar examiners within 30 days of <str<strong>on</strong>g>the</str<strong>on</strong>g> c<strong>on</strong>clusi<strong>on</strong> of any hearing, unless<br />

o<str<strong>on</strong>g>the</str<strong>on</strong>g>rwise ordered <str<strong>on</strong>g>by</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> board of bar examiners. Absent a timely verified petiti<strong>on</strong> for review filed in accordance<br />

with this rule, <str<strong>on</strong>g>the</str<strong>on</strong>g> board of bar examiners shall approve <str<strong>on</strong>g>the</str<strong>on</strong>g> adverse recommendati<strong>on</strong> of <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>committee</str<strong>on</strong>g>, unless <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

board of bar examiners determines that fur<str<strong>on</strong>g>the</str<strong>on</strong>g>r investigati<strong>on</strong> is necessary.<br />

7. Notice and review. Any petiti<strong>on</strong>er notified of an adverse decisi<strong>on</strong> may, within 15 days from <str<strong>on</strong>g>the</str<strong>on</strong>g> date of<br />

service of <str<strong>on</strong>g>the</str<strong>on</strong>g> decisi<strong>on</strong>, file a verified petiti<strong>on</strong> for review with <str<strong>on</strong>g>the</str<strong>on</strong>g> supreme court, which shall be accompanied <str<strong>on</strong>g>by</str<strong>on</strong>g><br />

proof of service of a copy up<strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> admissi<strong>on</strong>s director of <str<strong>on</strong>g>the</str<strong>on</strong>g> state bar, <str<strong>on</strong>g>the</str<strong>on</strong>g> chair of <str<strong>on</strong>g>the</str<strong>on</strong>g> board of bar examiners, and<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> chair of <str<strong>on</strong>g>the</str<strong>on</strong>g> functi<strong>on</strong>al <strong>equivalency</strong> <str<strong>on</strong>g>committee</str<strong>on</strong>g>. Service <str<strong>on</strong>g>by</str<strong>on</strong>g> mail shall be complete up<strong>on</strong> mailing. Such petiti<strong>on</strong><br />

shall c<strong>on</strong>tain any relevant documentati<strong>on</strong> necessary for <str<strong>on</strong>g>the</str<strong>on</strong>g> court’s understanding of <str<strong>on</strong>g>the</str<strong>on</strong>g> matter, a statement of facts<br />

supported <str<strong>on</strong>g>by</str<strong>on</strong>g> adequate citati<strong>on</strong> to any record, and legal points and authorities setting forth <str<strong>on</strong>g>the</str<strong>on</strong>g> legal basis for each<br />

ground up<strong>on</strong> which <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>committee</str<strong>on</strong>g>’s recommendati<strong>on</strong> is alleged to be err<strong>on</strong>eous.<br />

Within 15 days of service of any verified petiti<strong>on</strong>, <str<strong>on</strong>g>the</str<strong>on</strong>g> board of bar examiners shall submit <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>committee</str<strong>on</strong>g>’s<br />

report to <str<strong>on</strong>g>the</str<strong>on</strong>g> court. Additi<strong>on</strong>ally, within 15 days of service of any verified petiti<strong>on</strong>, <str<strong>on</strong>g>the</str<strong>on</strong>g> board of bar examiners and/or<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>committee</str<strong>on</strong>g> <strong>on</strong> functi<strong>on</strong>al <strong>equivalency</strong>, or <str<strong>on</strong>g>the</str<strong>on</strong>g>ir representative, may file an answer to any issues raised in <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

petiti<strong>on</strong>. If <str<strong>on</strong>g>the</str<strong>on</strong>g> court is of <str<strong>on</strong>g>the</str<strong>on</strong>g> opini<strong>on</strong> that <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>committee</str<strong>on</strong>g>’s recommendati<strong>on</strong> should not be disturbed, it may deny <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

petiti<strong>on</strong>. Should <str<strong>on</strong>g>the</str<strong>on</strong>g> court determine that <str<strong>on</strong>g>the</str<strong>on</strong>g> petiti<strong>on</strong>er is entitled to relief, it may direct <str<strong>on</strong>g>the</str<strong>on</strong>g> board of bar examiners<br />

to permit <str<strong>on</strong>g>the</str<strong>on</strong>g> petiti<strong>on</strong>er to file an applicati<strong>on</strong> for admissi<strong>on</strong> and to process <str<strong>on</strong>g>the</str<strong>on</strong>g> applicati<strong>on</strong> in accordance with<br />

Supreme Court <str<strong>on</strong>g>Rule</str<strong>on</strong>g>s 49 to 75.<br />

8. Burden of proof. In any proceeding before <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>committee</str<strong>on</strong>g> <strong>on</strong> functi<strong>on</strong>al <strong>equivalency</strong>, or before <str<strong>on</strong>g>the</str<strong>on</strong>g> court, <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

petiti<strong>on</strong>er shall have <str<strong>on</strong>g>the</str<strong>on</strong>g> burden of proving that he or she meets <str<strong>on</strong>g>the</str<strong>on</strong>g> qualificati<strong>on</strong>s set forth in subsecti<strong>on</strong> 1(a), 1(b),<br />

or 1(c) of this rule. Should a petiti<strong>on</strong>er fail to meet this burden of proof, <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>committee</str<strong>on</strong>g> shall refuse to certify that <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

petiti<strong>on</strong>er meets <str<strong>on</strong>g>the</str<strong>on</strong>g> requirements of this rule, and <str<strong>on</strong>g>the</str<strong>on</strong>g> court shall refuse to disturb <str<strong>on</strong>g>the</str<strong>on</strong>g> adverse recommendati<strong>on</strong> of<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>committee</str<strong>on</strong>g>.


Addendum 2.<br />

Policies and Procedures of <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

Functi<strong>on</strong>al Equivalency Committee<br />

1. Number of Members <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> Committee. By order filed September 29, 1993, ADKT No. 171, <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

Supreme Court of Nevada created <str<strong>on</strong>g>the</str<strong>on</strong>g> Committee <strong>on</strong> Functi<strong>on</strong>al Equivalency ("<str<strong>on</strong>g>committee</str<strong>on</strong>g>"). The<br />

<str<strong>on</strong>g>committee</str<strong>on</strong>g> was formally codified in Supreme Court <str<strong>on</strong>g>Rule</str<strong>on</strong>g> 49 in 1996. The <str<strong>on</strong>g>committee</str<strong>on</strong>g> is composed of<br />

seven members who are active members of <str<strong>on</strong>g>the</str<strong>on</strong>g> State Bar of Nevada. Four of <str<strong>on</strong>g>the</str<strong>on</strong>g> members are appointed<br />

<str<strong>on</strong>g>by</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Supreme Court of Nevada ("Court"), and three members are appointed <str<strong>on</strong>g>by</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Board of Governors.<br />

The Chair will be selected <str<strong>on</strong>g>by</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Court from <str<strong>on</strong>g>the</str<strong>on</strong>g> appointed members.<br />

2. Terms of Office. The terms of <str<strong>on</strong>g>the</str<strong>on</strong>g> members of <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>committee</str<strong>on</strong>g> shall be three years. There is no limit <strong>on</strong><br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> number of terms an attorney may serve <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>committee</str<strong>on</strong>g>.<br />

3. Resp<strong>on</strong>sibilities and Powers of <str<strong>on</strong>g>the</str<strong>on</strong>g> Committee. The <str<strong>on</strong>g>committee</str<strong>on</strong>g> shall have all those powers and duties<br />

delegated under <str<strong>on</strong>g>the</str<strong>on</strong>g> Nevada Supreme Court <str<strong>on</strong>g>Rule</str<strong>on</strong>g>s to <str<strong>on</strong>g>the</str<strong>on</strong>g> Board of Bar Examiners relating to <str<strong>on</strong>g>the</str<strong>on</strong>g> c<strong>on</strong>duct<br />

of investigati<strong>on</strong>s and hearings, and <str<strong>on</strong>g>the</str<strong>on</strong>g> submissi<strong>on</strong> of reports and recommendati<strong>on</strong>s to <str<strong>on</strong>g>the</str<strong>on</strong>g> Board of Bar<br />

Examiners and <str<strong>on</strong>g>the</str<strong>on</strong>g> Court respecting those petiti<strong>on</strong>ers seeking certificati<strong>on</strong> in accordance with SCR <str<strong>on</strong>g>51.5.</str<strong>on</strong>g><br />

A. Chair. The chair will be selected <str<strong>on</strong>g>by</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Court from <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>committee</str<strong>on</strong>g> members and is<br />

resp<strong>on</strong>sible for ensuring that petiti<strong>on</strong>s for certificati<strong>on</strong> of <str<strong>on</strong>g>the</str<strong>on</strong>g> qualificati<strong>on</strong>s set forth in SCR 51.5 are<br />

processed in accordance with <str<strong>on</strong>g>the</str<strong>on</strong>g> Supreme Court <str<strong>on</strong>g>Rule</str<strong>on</strong>g>s and <str<strong>on</strong>g>the</str<strong>on</strong>g> policies and procedures of <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>committee</str<strong>on</strong>g><br />

as set forth herein.<br />

B. Vice-Chair. The vice-chair is to be appointed <str<strong>on</strong>g>by</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>committee</str<strong>on</strong>g> and shall take <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> duties<br />

and resp<strong>on</strong>sibilities of <str<strong>on</strong>g>the</str<strong>on</strong>g> chair in his/her absence.<br />

4. Quorum. No less than four of <str<strong>on</strong>g>the</str<strong>on</strong>g> seven members of <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>committee</str<strong>on</strong>g>, meeting ei<str<strong>on</strong>g>the</str<strong>on</strong>g>r in pers<strong>on</strong> or <str<strong>on</strong>g>by</str<strong>on</strong>g><br />

teleph<strong>on</strong>e c<strong>on</strong>ference, shall c<strong>on</strong>stitute a quorum for <str<strong>on</strong>g>the</str<strong>on</strong>g> purposes of a hearing. Committee decisi<strong>on</strong>s and<br />

recommendati<strong>on</strong>s require a majority vote of those in attendance.<br />

5. <str<strong>on</strong>g>Certificati<strong>on</strong></str<strong>on</strong>g> Procedure. Before submitting an applicati<strong>on</strong> for examinati<strong>on</strong> for a license to practice in<br />

Nevada, a prospective applicant who has received a degree of bachelor of laws or an equivalent law<br />

degree from a law school that has not been approved <str<strong>on</strong>g>by</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Committee <strong>on</strong> Legal Educati<strong>on</strong> and<br />

Admissi<strong>on</strong>s to <str<strong>on</strong>g>the</str<strong>on</strong>g> Bar of <str<strong>on</strong>g>the</str<strong>on</strong>g> American Bar Associati<strong>on</strong> as required <str<strong>on</strong>g>by</str<strong>on</strong>g> SCR 51(c) must first obtain<br />

certificati<strong>on</strong> <str<strong>on</strong>g>by</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>committee</str<strong>on</strong>g> that <str<strong>on</strong>g>the</str<strong>on</strong>g> prospective applicant has met <str<strong>on</strong>g>the</str<strong>on</strong>g> qualificati<strong>on</strong>s set forth in SCR<br />

51.5 ("certificati<strong>on</strong>"). Applicati<strong>on</strong>s for admissi<strong>on</strong> submitted without prior certificati<strong>on</strong> shall immediately<br />

be rejected and <str<strong>on</strong>g>the</str<strong>on</strong>g> applicati<strong>on</strong> fee shall not be refunded.<br />

To apply for certificati<strong>on</strong>, a prospective applicant who has met <str<strong>on</strong>g>the</str<strong>on</strong>g> standards set forth in SCR<br />

51.5 must submit to <str<strong>on</strong>g>the</str<strong>on</strong>g> Director of Admissi<strong>on</strong>s an original and two (2) copies of a verified petiti<strong>on</strong> for<br />

certificati<strong>on</strong> under SCR 51.5, toge<str<strong>on</strong>g>the</str<strong>on</strong>g>r with a $750.00 filing fee, and proof of service of <str<strong>on</strong>g>the</str<strong>on</strong>g> petiti<strong>on</strong> <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

chair of <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>committee</str<strong>on</strong>g>. The chair may be served at <str<strong>on</strong>g>the</str<strong>on</strong>g> office of <str<strong>on</strong>g>the</str<strong>on</strong>g> State Bar of Nevada. The petiti<strong>on</strong><br />

must be filed no later than September 1 of <str<strong>on</strong>g>the</str<strong>on</strong>g> year prior to <str<strong>on</strong>g>the</str<strong>on</strong>g> year in which <str<strong>on</strong>g>the</str<strong>on</strong>g> petiti<strong>on</strong>er seeks to sit for<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> bar examinati<strong>on</strong>, and shall c<strong>on</strong>tain a statement of facts accompanied <str<strong>on</strong>g>by</str<strong>on</strong>g> copies of all relevant<br />

documents, a statement of each ground up<strong>on</strong> which relief is alleged to be warranted, and legal points and<br />

authorities, setting forth <str<strong>on</strong>g>the</str<strong>on</strong>g> legal basis for each ground for <str<strong>on</strong>g>the</str<strong>on</strong>g> relief requested.<br />

In this petiti<strong>on</strong>, <str<strong>on</strong>g>the</str<strong>on</strong>g> burden of proof shall be up<strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> petiti<strong>on</strong>er, without imposing an excessive<br />

burden <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>committee</str<strong>on</strong>g>, to dem<strong>on</strong>strate that he or she meets <str<strong>on</strong>g>the</str<strong>on</strong>g> qualificati<strong>on</strong>s set forth in subsecti<strong>on</strong><br />

1(a), 1(b), or 1(c) of SCR <str<strong>on</strong>g>51.5.</str<strong>on</strong>g>


Listed below are <str<strong>on</strong>g>the</str<strong>on</strong>g> minimum qualificati<strong>on</strong>s that will be c<strong>on</strong>sidered <str<strong>on</strong>g>by</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>committee</str<strong>on</strong>g> in its investigati<strong>on</strong>.<br />

Petiti<strong>on</strong>ers shall provide <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>committee</str<strong>on</strong>g> with evidence addressing <str<strong>on</strong>g>the</str<strong>on</strong>g> following applicable items:<br />

1. Quality of Law School (profit vs. n<strong>on</strong>-profit, corresp<strong>on</strong>dence vs. attendance, etc.)<br />

2. Curriculum (courses taken, c<strong>on</strong>tent, comm<strong>on</strong> law subjects, length of classes for individual<br />

sessi<strong>on</strong>s, semester or o<str<strong>on</strong>g>the</str<strong>on</strong>g>r term, participati<strong>on</strong> required, moot court, etc.)<br />

3. Faculty (number of full-time faculty members, faculty/student ratio, professi<strong>on</strong>al credentials,<br />

availability of faculty to students after class, etc.)<br />

4. Admissi<strong>on</strong> Standards (requirement of LSAT or equivalent, average GPA, BA/BS required or<br />

AA acceptable, number of students, etc.)<br />

5. Resources and Research Facilities (library facility, number of volumes in library, types of<br />

volumes in library, study facilities, etc.)<br />

6. Physical Plant (size, classroom size, moot court facilities, offices for faculty, separati<strong>on</strong> of law<br />

school from general university, etc.)<br />

7. Existing Accreditati<strong>on</strong>, Prior Accreditati<strong>on</strong> History or Attempt (prior ABA accreditati<strong>on</strong> or<br />

provisi<strong>on</strong>al accreditati<strong>on</strong>, attempt at ABA accreditati<strong>on</strong>, accreditati<strong>on</strong> of foreign law school <str<strong>on</strong>g>by</str<strong>on</strong>g><br />

agency analogous to ABA, etc.)<br />

8. Evidence of experience in <str<strong>on</strong>g>the</str<strong>on</strong>g> full-time practice of law in any state of <str<strong>on</strong>g>the</str<strong>on</strong>g> United States of<br />

America, a territory of <str<strong>on</strong>g>the</str<strong>on</strong>g> United States of America, <str<strong>on</strong>g>the</str<strong>on</strong>g> District of Columbia, or a foreign<br />

country for at least ten of <str<strong>on</strong>g>the</str<strong>on</strong>g> preceding twelve years. Such evidence should include, but not be<br />

limited to: a sworn affidavit detailing <str<strong>on</strong>g>the</str<strong>on</strong>g> nature and extent of <str<strong>on</strong>g>the</str<strong>on</strong>g> petiti<strong>on</strong>er's legal work<br />

experience during <str<strong>on</strong>g>the</str<strong>on</strong>g> time <str<strong>on</strong>g>the</str<strong>on</strong>g> petiti<strong>on</strong>er claims to have engaged in <str<strong>on</strong>g>the</str<strong>on</strong>g> full-time practice of law;<br />

legal memoranda prepared <str<strong>on</strong>g>by</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> petiti<strong>on</strong>er; copies of published cases resulting from <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

petiti<strong>on</strong>er's pleadings and/or pleadings and papers filed <str<strong>on</strong>g>by</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> petiti<strong>on</strong>er in his/her capacity as an<br />

attorney and counselor at law as a sole practiti<strong>on</strong>er or for a law firm, legal services office, legal<br />

clinic or <str<strong>on</strong>g>the</str<strong>on</strong>g> like, or as an attorney for an individual, a corporati<strong>on</strong>, partnership, trust; and/or<br />

letters of reference from <str<strong>on</strong>g>the</str<strong>on</strong>g> bench and bar in <str<strong>on</strong>g>the</str<strong>on</strong>g> jurisdicti<strong>on</strong> in which <str<strong>on</strong>g>the</str<strong>on</strong>g> petiti<strong>on</strong>er has been<br />

engaged in <str<strong>on</strong>g>the</str<strong>on</strong>g> practice of law.<br />

The above listing is not meant to be exhaustive. Ra<str<strong>on</strong>g>the</str<strong>on</strong>g>r, it is illustrative of <str<strong>on</strong>g>the</str<strong>on</strong>g> minimum<br />

qualificati<strong>on</strong>s that <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>committee</str<strong>on</strong>g> will c<strong>on</strong>sider in determining whe<str<strong>on</strong>g>the</str<strong>on</strong>g>r <str<strong>on</strong>g>the</str<strong>on</strong>g> petiti<strong>on</strong>er has met <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

qualificati<strong>on</strong>s set forth in SCR <str<strong>on</strong>g>51.5.</str<strong>on</strong>g><br />

6. Fees and Expenses. Verified petiti<strong>on</strong>s for certificati<strong>on</strong> shall be accompanied <str<strong>on</strong>g>by</str<strong>on</strong>g> a $750 filing fee<br />

which shall be paid to <str<strong>on</strong>g>the</str<strong>on</strong>g> State Bar of Nevada. The filing fee shall cover those costs which in <str<strong>on</strong>g>the</str<strong>on</strong>g> opini<strong>on</strong><br />

of <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>committee</str<strong>on</strong>g> are reas<strong>on</strong>ably necessary to c<strong>on</strong>duct investigati<strong>on</strong>s and to hold hearings. Costs under<br />

this rule shall include, without limitati<strong>on</strong>, <str<strong>on</strong>g>the</str<strong>on</strong>g> cost of court reporters, c<strong>on</strong>sultants, experts, teleph<strong>on</strong>e and<br />

telecopy, as well as transportati<strong>on</strong>, meals and lodging incurred <str<strong>on</strong>g>by</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> members of <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>committee</str<strong>on</strong>g> in <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

fur<str<strong>on</strong>g>the</str<strong>on</strong>g>rance of its investigati<strong>on</strong>.<br />

In <str<strong>on</strong>g>the</str<strong>on</strong>g> event <str<strong>on</strong>g>the</str<strong>on</strong>g> initial filing fee shall prove to be inadequate to cover <str<strong>on</strong>g>the</str<strong>on</strong>g> actual costs of <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

investigati<strong>on</strong> and hearings, an invoice shall be served <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> petiti<strong>on</strong>er. Within ten (10) days of service of<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> invoice, <str<strong>on</strong>g>the</str<strong>on</strong>g> petiti<strong>on</strong>er shall pay <str<strong>on</strong>g>the</str<strong>on</strong>g> additi<strong>on</strong>al invoiced amount to <str<strong>on</strong>g>the</str<strong>on</strong>g> state bar. Failure to pay <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

filing fee or any subsequent invoiced costs under this rule shall result in denial of <str<strong>on</strong>g>the</str<strong>on</strong>g> petiti<strong>on</strong>.<br />

7. Hearings. In accordance with SCR 57, <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>committee</str<strong>on</strong>g> may, in c<strong>on</strong>ducting its investigati<strong>on</strong>s, take and<br />

hear relevant evidence, administer oaths and affirmati<strong>on</strong>s, and compel <str<strong>on</strong>g>by</str<strong>on</strong>g> subpoena <str<strong>on</strong>g>the</str<strong>on</strong>g> attendance of<br />

witnesses and <str<strong>on</strong>g>the</str<strong>on</strong>g> producti<strong>on</strong> of books, papers and documents, subject to <str<strong>on</strong>g>the</str<strong>on</strong>g> Supreme Court <str<strong>on</strong>g>Rule</str<strong>on</strong>g>s.<br />

Up<strong>on</strong> payment of <str<strong>on</strong>g>the</str<strong>on</strong>g> filing fee and estimated expenses, <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>committee</str<strong>on</strong>g> shall review such evidence<br />

and c<strong>on</strong>duct such hearings as it deems necessary to investigate <str<strong>on</strong>g>the</str<strong>on</strong>g> grounds asserted <str<strong>on</strong>g>by</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> petiti<strong>on</strong>er and<br />

to make a determinati<strong>on</strong> whe<str<strong>on</strong>g>the</str<strong>on</strong>g>r <str<strong>on</strong>g>the</str<strong>on</strong>g> petiti<strong>on</strong>er has met <str<strong>on</strong>g>the</str<strong>on</strong>g> qualificati<strong>on</strong>s set forth in SCR <str<strong>on</strong>g>51.5.</str<strong>on</strong>g> The<br />

petiti<strong>on</strong>er shall be entitled to notice as set forth in secti<strong>on</strong> 8 below, and to be present, toge<str<strong>on</strong>g>the</str<strong>on</strong>g>r with<br />

counsel, if desired, to present evidence to substantiate <str<strong>on</strong>g>the</str<strong>on</strong>g> claim. The petiti<strong>on</strong>er shall also be entitled to<br />

all rights and privileges as are set forth in <str<strong>on</strong>g>the</str<strong>on</strong>g> Supreme Court <str<strong>on</strong>g>Rule</str<strong>on</strong>g>s relating to <str<strong>on</strong>g>the</str<strong>on</strong>g> c<strong>on</strong>duct of<br />

investigati<strong>on</strong>s and hearings. In any proceeding before <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>committee</str<strong>on</strong>g>, <str<strong>on</strong>g>the</str<strong>on</strong>g> petiti<strong>on</strong>er shall bear <str<strong>on</strong>g>the</str<strong>on</strong>g> burden


of proof to dem<strong>on</strong>strate that <str<strong>on</strong>g>the</str<strong>on</strong>g> petiti<strong>on</strong>er meets <str<strong>on</strong>g>the</str<strong>on</strong>g> qualificati<strong>on</strong>s as set forth in SCR <str<strong>on</strong>g>51.5.</str<strong>on</strong>g><br />

8. Notice. In accordance with SCR 59, whenever a petiti<strong>on</strong>er is required to appear before <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>committee</str<strong>on</strong>g><br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> petiti<strong>on</strong>er shall be entitled to five (5) days' notice <str<strong>on</strong>g>the</str<strong>on</strong>g>reof if served pers<strong>on</strong>ally, and ten (10) days'<br />

notice if served <str<strong>on</strong>g>by</str<strong>on</strong>g> mail at <str<strong>on</strong>g>the</str<strong>on</strong>g> petiti<strong>on</strong>er's last-known address.<br />

9. Recommendati<strong>on</strong> to <str<strong>on</strong>g>the</str<strong>on</strong>g> Board of Bar Examiners. On or before January 1 of <str<strong>on</strong>g>the</str<strong>on</strong>g> year in which <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

petiti<strong>on</strong>er seeks to sit for <str<strong>on</strong>g>the</str<strong>on</strong>g> bar examinati<strong>on</strong>, <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>committee</str<strong>on</strong>g> shall make a determinati<strong>on</strong> whe<str<strong>on</strong>g>the</str<strong>on</strong>g>r <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

petiti<strong>on</strong>er meets <str<strong>on</strong>g>the</str<strong>on</strong>g> qualificati<strong>on</strong>s as set forth in SCR <str<strong>on</strong>g>51.5.</str<strong>on</strong>g> If <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>committee</str<strong>on</strong>g> has noted questi<strong>on</strong>s relating<br />

to <str<strong>on</strong>g>the</str<strong>on</strong>g> petiti<strong>on</strong>er's ability to meet <str<strong>on</strong>g>the</str<strong>on</strong>g> moral character and fitness requirements of SCR 51(1), <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

<str<strong>on</strong>g>committee</str<strong>on</strong>g> may recommend to <str<strong>on</strong>g>the</str<strong>on</strong>g> Board of Bar Examiners that <str<strong>on</strong>g>the</str<strong>on</strong>g> petiti<strong>on</strong>er be referred to <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>committee</str<strong>on</strong>g><br />

<strong>on</strong> moral character and fitness for fur<str<strong>on</strong>g>the</str<strong>on</strong>g>r investigati<strong>on</strong> and/or hearings prior to review <str<strong>on</strong>g>by</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>committee</str<strong>on</strong>g>.<br />

A. Favorable Recommendati<strong>on</strong>. If <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>committee</str<strong>on</strong>g> recommends that certificati<strong>on</strong> be granted in<br />

accordance with S.C.R. 51.5, <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>committee</str<strong>on</strong>g> shall reduce such recommendati<strong>on</strong> to writing and shall<br />

transmit to <str<strong>on</strong>g>the</str<strong>on</strong>g> Board of Bar Examiners, toge<str<strong>on</strong>g>the</str<strong>on</strong>g>r with proof of service <str<strong>on</strong>g>by</str<strong>on</strong>g> mail <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> petiti<strong>on</strong>er, its<br />

certificati<strong>on</strong> that <str<strong>on</strong>g>the</str<strong>on</strong>g> petiti<strong>on</strong>er has met <str<strong>on</strong>g>the</str<strong>on</strong>g> qualificati<strong>on</strong>s set forth in SCR 51.5(1)(a), (b), or (c). Service<br />

shall be complete up<strong>on</strong> mailing. The report shall be filed with <str<strong>on</strong>g>the</str<strong>on</strong>g> Board of Bar Examiners within thirty<br />

(30) days of <str<strong>on</strong>g>the</str<strong>on</strong>g> c<strong>on</strong>clusi<strong>on</strong> of any hearing, unless o<str<strong>on</strong>g>the</str<strong>on</strong>g>rwise ordered <str<strong>on</strong>g>by</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Board of Bar Examiners.<br />

Up<strong>on</strong> receipt of such certificati<strong>on</strong>, <str<strong>on</strong>g>the</str<strong>on</strong>g> Board of Bar Examiners shall permit <str<strong>on</strong>g>the</str<strong>on</strong>g> petiti<strong>on</strong>er to apply for<br />

admissi<strong>on</strong>, unless <str<strong>on</strong>g>the</str<strong>on</strong>g> Board determines that fur<str<strong>on</strong>g>the</str<strong>on</strong>g>r investigati<strong>on</strong> is necessary. The petiti<strong>on</strong>er may, in <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

Board's discreti<strong>on</strong>, be permitted to sit for <str<strong>on</strong>g>the</str<strong>on</strong>g> bar examinati<strong>on</strong> if <str<strong>on</strong>g>the</str<strong>on</strong>g> petiti<strong>on</strong>er meets all o<str<strong>on</strong>g>the</str<strong>on</strong>g>r applicable<br />

requirements.<br />

B. Adverse Recommendati<strong>on</strong>. If <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>committee</str<strong>on</strong>g> recommends that certificati<strong>on</strong> be denied based<br />

up<strong>on</strong> its determinati<strong>on</strong> that <str<strong>on</strong>g>the</str<strong>on</strong>g> petiti<strong>on</strong>er has not met <str<strong>on</strong>g>the</str<strong>on</strong>g> qualificati<strong>on</strong>s set forth in SCR 51.5, <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

<str<strong>on</strong>g>committee</str<strong>on</strong>g> shall file a report with <str<strong>on</strong>g>the</str<strong>on</strong>g> Board of Bar Examiners, toge<str<strong>on</strong>g>the</str<strong>on</strong>g>r with proof of service <str<strong>on</strong>g>by</str<strong>on</strong>g> mail <strong>on</strong><br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> petiti<strong>on</strong>er, describing <str<strong>on</strong>g>the</str<strong>on</strong>g> basis for <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>committee</str<strong>on</strong>g>’s adverse recommendati<strong>on</strong>. Service shall be<br />

complete up<strong>on</strong> mailing. The report shall be filed with <str<strong>on</strong>g>the</str<strong>on</strong>g> Board of Bar Examiners, within thirty (30) days<br />

of <str<strong>on</strong>g>the</str<strong>on</strong>g> c<strong>on</strong>clusi<strong>on</strong> of any hearing, unless o<str<strong>on</strong>g>the</str<strong>on</strong>g>rwise ordered <str<strong>on</strong>g>by</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Board of Bar Examiners. Absent a<br />

timely verified petiti<strong>on</strong> for review filed in accordance with secti<strong>on</strong> 10 below and SCR 51.5(7), <str<strong>on</strong>g>the</str<strong>on</strong>g> Board<br />

of Bar Examiners shall approve <str<strong>on</strong>g>the</str<strong>on</strong>g> adverse recommendati<strong>on</strong> of <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>committee</str<strong>on</strong>g>, unless <str<strong>on</strong>g>the</str<strong>on</strong>g> Board of Bar<br />

Examiners determines that fur<str<strong>on</strong>g>the</str<strong>on</strong>g>r investigati<strong>on</strong> is necessary.<br />

10. Procedure for Review <str<strong>on</strong>g>by</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Supreme Court. If <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>committee</str<strong>on</strong>g> recommends to <str<strong>on</strong>g>the</str<strong>on</strong>g> Board of Bar<br />

Examiners that a petiti<strong>on</strong>er be denied certificati<strong>on</strong>, <str<strong>on</strong>g>the</str<strong>on</strong>g> petiti<strong>on</strong>er may, within fifteen (15) days from <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

date of service of such report, file an original and two (2) copies of a verified petiti<strong>on</strong> for relief with <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

Supreme Court, which shall be accompanied <str<strong>on</strong>g>by</str<strong>on</strong>g> a n<strong>on</strong>-refundable $200 filing fee and proof of service of a<br />

copy up<strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> Director of Admissi<strong>on</strong>s of <str<strong>on</strong>g>the</str<strong>on</strong>g> state bar, <str<strong>on</strong>g>the</str<strong>on</strong>g> chair of <str<strong>on</strong>g>the</str<strong>on</strong>g> Board of Bar Examiners, and <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

chair of <str<strong>on</strong>g>the</str<strong>on</strong>g> Functi<strong>on</strong>al Equivalency Committee. Such petiti<strong>on</strong> shall c<strong>on</strong>tain any relevant documentati<strong>on</strong><br />

necessary for <str<strong>on</strong>g>the</str<strong>on</strong>g> Court's understanding of <str<strong>on</strong>g>the</str<strong>on</strong>g> matter, a statement of facts supported <str<strong>on</strong>g>by</str<strong>on</strong>g> adequate citati<strong>on</strong><br />

to any record, and legal points and authorities setting forth <str<strong>on</strong>g>the</str<strong>on</strong>g> legal basis for each ground up<strong>on</strong> which <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

<str<strong>on</strong>g>committee</str<strong>on</strong>g>'s recommendati<strong>on</strong> is alleged to be err<strong>on</strong>eous.<br />

Within fifteen (15) days of service of any verified petiti<strong>on</strong>, <str<strong>on</strong>g>the</str<strong>on</strong>g> Board of Bar Examiners shall file<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>committee</str<strong>on</strong>g>'s report with <str<strong>on</strong>g>the</str<strong>on</strong>g> Court. Additi<strong>on</strong>ally, within fifteen (15) days of service of any verified<br />

petiti<strong>on</strong>, <str<strong>on</strong>g>the</str<strong>on</strong>g> Board of Bar Examiners and/or <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>committee</str<strong>on</strong>g>, or <str<strong>on</strong>g>the</str<strong>on</strong>g>ir representative may file a supplement<br />

to <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>committee</str<strong>on</strong>g>'s report addressing any issues raised in <str<strong>on</strong>g>the</str<strong>on</strong>g> petiti<strong>on</strong>.<br />

If <str<strong>on</strong>g>the</str<strong>on</strong>g> Court is of <str<strong>on</strong>g>the</str<strong>on</strong>g> opini<strong>on</strong> that <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>committee</str<strong>on</strong>g>'s recommendati<strong>on</strong> should not be disturbed, it<br />

may deny <str<strong>on</strong>g>the</str<strong>on</strong>g> petiti<strong>on</strong>. O<str<strong>on</strong>g>the</str<strong>on</strong>g>rwise, <str<strong>on</strong>g>the</str<strong>on</strong>g> Court may enter an order fixing <str<strong>on</strong>g>the</str<strong>on</strong>g> time within which an answer<br />

may be filed <str<strong>on</strong>g>by</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>committee</str<strong>on</strong>g>, if <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>committee</str<strong>on</strong>g> has not already filed an answer. Should <str<strong>on</strong>g>the</str<strong>on</strong>g> Court<br />

determine that <str<strong>on</strong>g>the</str<strong>on</strong>g> petiti<strong>on</strong>er is entitled to relief, it may direct <str<strong>on</strong>g>the</str<strong>on</strong>g> Board of Bar Examiners to permit <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

petiti<strong>on</strong>er to file an applicati<strong>on</strong> for admissi<strong>on</strong> and to process <str<strong>on</strong>g>the</str<strong>on</strong>g> applicati<strong>on</strong> in accordance with Supreme<br />

Court <str<strong>on</strong>g>Rule</str<strong>on</strong>g>s 49 to 75.
