Notes <strong>f<strong>or</strong></strong> Guidance<br />

1. The Local Auth<strong>or</strong>ity is required to satisfy itself that the applicant <strong>f<strong>or</strong></strong> registration <strong>as</strong> a mot<strong>or</strong><br />

<strong>salvage</strong> operat<strong>or</strong> is a fit and proper person to carry on such a business. In deciding whether<br />

they are so satisfied the Local Auth<strong>or</strong>ity shall have regard to:<br />

a. whether the applicant h<strong>as</strong> been convicted <strong>of</strong> any <strong>of</strong>fences under the Vehicles<br />

(Crime) Act 2001; and<br />

b. whether the applicant h<strong>as</strong> been convicted <strong>of</strong> any <strong>of</strong>fences <strong>of</strong> a description specified<br />

by the Secretary <strong>of</strong> State which include any unspent convictions <strong>f<strong>or</strong></strong> the following<br />

<strong>of</strong>fences:<br />

⇒ theft <strong>or</strong> attempted theft <strong>of</strong> <strong>or</strong> from a mot<strong>or</strong> vehicles, contrary to Section 1 <strong>of</strong> the<br />

Theft Act 1968;<br />

⇒ taking a mot<strong>or</strong> vehicle without consent, contrary to Section 12 <strong>of</strong> the Theft Act<br />

1968;<br />

⇒ aggravated vehicle taking, contrary to Section 12A <strong>of</strong> the Theft Act 1968;<br />

⇒ handling stolen goods, contrary to Section 22 <strong>of</strong> the Theft Act 1968;<br />

⇒ going equipped to steal <strong>or</strong> take a mot<strong>or</strong> vehicle, contrary to Section 25 <strong>of</strong> the<br />

Theft Act 1968;<br />

⇒ interference with a mot<strong>or</strong> vehicle, contrary to Section 9 <strong>of</strong> the Criminal Attempts<br />

Act 1981;<br />

⇒ tampering with a mot<strong>or</strong> vehicle, contrary to Section 25 <strong>of</strong> the Road Traffic Act<br />

1988;<br />

⇒ convictions <strong>f<strong>or</strong></strong> <strong>of</strong>fences under Part 1 <strong>of</strong> the Vehicles (Crime) Act 2001.<br />

c. Any c<strong>as</strong>e <strong>of</strong> undischarged bankruptcy <strong>of</strong> the applicant <strong>or</strong> any direct<strong>or</strong>s <strong>or</strong> partners <strong>of</strong><br />

the applicant business.<br />

2. A Police Enquiry F<strong>or</strong>m must be completed in respect <strong>of</strong> all individual applicants and, where<br />

the application is made on behalf <strong>of</strong> a company <strong>or</strong> partnership, each partner <strong>or</strong> direct<strong>or</strong>.<br />

3. The completed <strong>f<strong>or</strong></strong>ms will be submitted to Essex Police Vetting Unit <strong>f<strong>or</strong></strong> comment. The<br />

in<strong>f<strong>or</strong></strong>mation given may be used in conjunction with other Local Auth<strong>or</strong>ities <strong>f<strong>or</strong></strong> the prevention<br />

and detection <strong>of</strong> fraud, and will be held on computer, subject to the Data Protection Act<br />

1998.<br />

4. An entry in the mot<strong>or</strong> <strong>salvage</strong> operat<strong>or</strong>’s register is valid <strong>f<strong>or</strong></strong> three years from the date <strong>of</strong><br />

entry and should be renewed two months pri<strong>or</strong> to the expiration <strong>of</strong> that period by submitting<br />

an application <strong>f<strong>or</strong></strong> renewal together with the appropriate fee.<br />

5. If an applicant is considered not to be a suitable person to become a registered mot<strong>or</strong><br />

<strong>salvage</strong> operat<strong>or</strong>, <strong>or</strong> to have a registration renewed, he will be advised in writing and given<br />

the opp<strong>or</strong>tunity to make representations to the Council.<br />

6. The application <strong>f<strong>or</strong></strong>m must be signed. An applicant’s agent (<strong>f<strong>or</strong></strong> example solicit<strong>or</strong>) may sign<br />

the <strong>f<strong>or</strong></strong>m on their behalf provided that they have actual auth<strong>or</strong>ity to do so. Where there is<br />

m<strong>or</strong>e than one applicant, all applicants <strong>or</strong> their respective agents must sign the application<br />

<strong>f<strong>or</strong></strong>m.<br />
