Crabtree opened the<br />

hearing by asking Judge<br />

Reed Dixon to quash the<br />

arrest warrant against<br />

Kile, claiming the warrant<br />

failed to establish probable<br />

cause that Kile was connected<br />

“in any way whatsoever”<br />

with the death of<br />

Click. Crabtree said that<br />

the warrant had failed in<br />

its verbiage to establish<br />

that Kile had committed a<br />

crime.<br />

“The allegations in the<br />

warrant are not sufficient,”<br />

Crabtree said, insisting the<br />

shooting of Click was the<br />

sole action of Chrisman.<br />

time of the shooting.<br />

“An arrest warrant must<br />

be specific,” Crabtree said,<br />

“much like a search warrant.<br />

And since it is insufficient<br />

and fails to<br />

establish probable cause, it<br />

therefore must be<br />

quashed and my client released.”<br />

In rebuttal, Assistant<br />

Attorney General Jim<br />

Stutts was unequivocal in<br />

his words and not swayed<br />

by Crabtree’s argument.<br />

“The affidavit accuses<br />

the defendant of first-degree<br />

murder,” Stutts said.<br />

“The offense occurred in<br />

his presence and he provided<br />

specific information<br />

of the location of a vehicle<br />

used in the killing that had<br />

blood inside it and shots in<br />

its door. This vehicle<br />

turned up where Kile said<br />

it was. Mr. Kile did act to<br />

assist another person and<br />

did participate in the murder,<br />

and the state has<br />

based its case on the responsibility<br />

of him being<br />

present at the time of the<br />

homicide.”<br />

Stutts said Kile knew<br />

the “specifics of the<br />

crime” and his “information<br />

was correct.”<br />

“And by being present,<br />

he helped Mr. Chrisman<br />

commit murder,” Stutts<br />

said.<br />

Crabtree responded,<br />

reiterating his belief that<br />

the arrest of Kile lacked<br />

probable cause.<br />

“The state wants to<br />

make this case as vague as<br />

possible to keep from<br />

being tied to specific<br />

facts,” he said. “The law<br />

says the warrant must contain<br />

a statement that attests<br />

my client acted with<br />

intent to assist or promote,<br />

and there’s no statement<br />

in the affidavit that<br />

says this.”<br />

Crabtree said the warrant<br />

did not give Kile “notice<br />

of exactly what he is<br />

being charged with.”<br />

“But this whole thing<br />

here today is basically an<br />

exercise in futility, for the<br />

state will simply issue a<br />

new corrected warrant<br />

and charge my client all<br />

over again,” he added.<br />

Pausing a moment,<br />

Dixon agreed with Crabtree.<br />

“Yes, the warrant is insufficient,”<br />

Dixon said. “It<br />

must be quashed. But the<br />

defendant won’t be freed<br />

until a new warrant is<br />

Then, on behalf of his<br />

client, Shahan asked<br />

Dixon to lower Chrisman’s<br />

$350,000 bond to<br />

$150,000, explaining that<br />

a defendant had a right to<br />

“a reasonable bond.”<br />

“Plus, Mr. Chrisman is<br />

indigent,” Shahan said,<br />

“and $350,000 is excessive.<br />

He’s currently unemployed<br />

and looking for<br />

work. He has a wife and is<br />

the father of two children.<br />

For him to remain in jail<br />

would impose an unreasonable<br />

burden on the<br />

family and if free he can<br />

participate in his own defense.”<br />

In rebuttal, Stutts said<br />

the court could hold a suspect<br />

in a first-degree murder<br />

case without bond.<br />

“Mr. Chrisman has<br />

eight prior felony convictions<br />

in McMinn <strong>County</strong>,”<br />

Stutts said. “Three were<br />

aggravated burglaries, or<br />

crimes of violence. Others<br />

were burglaries and thefts.<br />

He’s a Range Two offender,<br />

and in this case he<br />

allegedly used a weapon to<br />

shoot Mr. Click, violating<br />

the statute of a convicted<br />

felon in possession of a<br />

<strong>July</strong> 9, 2012<br />

firearm.”<br />

Stutts continued, saying<br />

that the preliminary<br />

results of Click’s autopsy<br />

showed “multiple gunshot<br />

wounds to his body.”<br />

“One was a gunshot<br />

wound to the head at close<br />

range, so close that there<br />

was soot on the fingers of<br />

the victim, and one was to<br />
