Crabtree opened the 

hearing by asking Judge 

Reed Dixon to quash the 

arrest warrant against 

Kile, claiming the warrant 

failed to establish probable 

cause that Kile was connected 

“in any way whatsoever” 

with the death of 

Click. Crabtree said that 

the warrant had failed in 

its verbiage to establish 

that Kile had committed a 

crime. 

“The allegations in the 

warrant are not sufficient,” 

Crabtree said, insisting the 

shooting of Click was the 

sole action of Chrisman.

time of the shooting. 

“An arrest warrant must 

be specific,” Crabtree said, 

“much like a search warrant. 

And since it is insufficient 

and fails to 

establish probable cause, it 

therefore must be 

quashed and my client released.” 

In rebuttal, Assistant 

Attorney General Jim 

Stutts was unequivocal in 

his words and not swayed 

by Crabtree’s argument. 

“The affidavit accuses 

the defendant of first-degree 

murder,” Stutts said. 

“The offense occurred in 

his presence and he provided 

specific information 

of the location of a vehicle 

used in the killing that had 

blood inside it and shots in 

its door. This vehicle 

turned up where Kile said 

it was. Mr. Kile did act to 

assist another person and 

did participate in the murder, 

and the state has 

based its case on the responsibility 

of him being 

present at the time of the 

homicide.” 

Stutts said Kile knew 

the “specifics of the

crime” and his “information 

was correct.” 

“And by being present, 

he helped Mr. Chrisman 

commit murder,” Stutts 

said. 

Crabtree responded, 

reiterating his belief that 

the arrest of Kile lacked 

probable cause. 

“The state wants to 

make this case as vague as 

possible to keep from 

being tied to specific 

facts,” he said. “The law 

says the warrant must contain 

a statement that attests 

my client acted with 

intent to assist or promote, 

and there’s no statement 

in the affidavit that 

says this.” 

Crabtree said the warrant 

did not give Kile “notice 

of exactly what he is 

being charged with.” 

“But this whole thing 

here today is basically an 

exercise in futility, for the 

state will simply issue a 

new corrected warrant 

and charge my client all 

over again,” he added. 

Pausing a moment, 

Dixon agreed with Crabtree. 

“Yes, the warrant is insufficient,” 

Dixon said. “It 

must be quashed. But the 

defendant won’t be freed 

until a new warrant is

Then, on behalf of his 

client, Shahan asked 

Dixon to lower Chrisman’s 

$350,000 bond to 

$150,000, explaining that 

a defendant had a right to 

“a reasonable bond.” 

“Plus, Mr. Chrisman is 

indigent,” Shahan said, 

“and $350,000 is excessive. 

He’s currently unemployed 

and looking for 

work. He has a wife and is 

the father of two children. 

For him to remain in jail 

would impose an unreasonable 

burden on the 

family and if free he can 

participate in his own defense.” 

In rebuttal, Stutts said 

the court could hold a suspect 

in a first-degree murder 

case without bond. 

“Mr. Chrisman has 

eight prior felony convictions 

in McMinn County,” 

Stutts said. “Three were 

aggravated burglaries, or 

crimes of violence. Others 

were burglaries and thefts. 

He’s a Range Two offender, 

and in this case he 

allegedly used a weapon to 

shoot Mr. Click, violating 

the statute of a convicted 

felon in possession of a 


firearm.” 

Stutts continued, saying 

that the preliminary 

results of Click’s autopsy 

showed “multiple gunshot 

wounds to his body.” 

“One was a gunshot 

wound to the head at close 

range, so close that there 

was soot on the fingers of 

the victim, and one was to 

the left forearm, two were 

to the back, and a fifth hit 

the right arm and entered 

the chest. And there was 

blunt force trauma to the 

torso of the victim.” 

“This,” Stutts said, “was 

not a homicide. This was 

an execution.” 

Shahan interrupted at 

this point, telling Dixon 

the proceeding was not a 

preliminary hearing and 

there was no proof that 

Chrisman was involved 

with Click’s murder. 

“The court is stepping 

ahead of itself if it thinks 

my client is guilty,” Shahan 

said. 

But Dixon agreed with 

Stutts and said the bond 

was not excessive. 

“The motion to lower 

Mr. Chrisman’s bond is 

not granted,” Dixon said.

not identified nor were 

any charges against such a 

person issued following 

the hearing. 

A preliminary hearing 

for the case was scheduled 

in general sessions court 

on Wednesday, July 11, two 

days from now.

date were secreted in the 

couch cushions. The bottles 

had West’s name on 

them, Harrill said. 

Inside West’s pockets 

were two additional bottles 

containing 110 oxycodone 

pills. West said he 

had arrived at Long’s residence 

and had traded 100 

oxycodones for a vehicle 

that had yet been delivered. 

Long turned up in the 

kitchen of his home as 

Harrill and other officers 

entered and inside Long’s 

pocket was a bottle that 

held 201 pills that were 

identified as an assortment 

of oxycodones. 

Harrill said Long admitted 

to him that he had 

been selling the controlled 

drug illegally.

matter, he found Erwin 

and Erwin pulled a knife 

on him. 

Ordering Erwin to put 

that knife away and go 

home, the neighbor said 

his words fell on deaf ears 

and Erwin refused. Poe 

found the two men and 

witnesses standing in the 

apartment complex’s 

breezeway, he said. 

The knife turned up 

during a safety pat-down 

of Erwin, said Poe, who 

also located a bottle of 

pills. Poe said the bottle 

was labeled for clonazepam 

and there were 

clonazepam inside, but 

there were also tramadol, 

and the bottle wasn’t labeled 

for the Schedule IV 

substance.

told Bowers that Phillips 

had choked a puppy and 

had tried to turn its head 

almost all the way around. 

Phillips said she was 

mad and had started to 

choke the puppy. 

She also admitted to

dog, Bowers said.

from what appeared to be 

a long circular object. 

He said the female had 

two black eyes, multiple 

cuts on her forehead, and 

a bruised nose and chin. 

An injury report from 

Blount Memorial Hospital 

in Maryville said the female 

had broken nasal 

bones, a contusion on her 

chest wall, and a sprained 

left wrist.
