Verdict in Jim Miller Murder Trial<br />

Stutts: Jessica Kennedy Facing Possible 35 Years<br />

On Monday evening, a<br />

jury of eight women and<br />

four men convicted Jessica<br />

Lynn Kennedy in the<br />

death of Sweetwater businessman<br />

Jim Miller.<br />

The jury found her<br />

guilty of facilitation of<br />

felony first-degree murder,<br />

facilitation of aggravated<br />

robbery, facilitation of setting<br />

fire to personal property,<br />

and facilitation of<br />

abuse of a corpse.<br />

Sentencing will take<br />

place in Madisonville on<br />

Wednesday, October 3.<br />

In closing arguments<br />

that took place Monday<br />

morning, Assistant District<br />

Attorney General Jim<br />

Stutts reminded the jury<br />

of Kennedy’s words in a<br />

November 10, 2010, video<br />

interview, “I know the<br />

part I played and I am wiling<br />

to do my time.”<br />

Kennedy’s attorney,<br />

John Eldridge, described<br />

Kennedy as someone<br />

whose life was “horrific”<br />

and rife with drugs and<br />

sexual abuse and who<br />

would give persons in<br />

power what they wanted<br />

to hear, “just in order to<br />

survive.”<br />

Jim Miller died of three<br />

gunshots wounds to the<br />

head on July 17, 2010. He<br />

was apparently killed at a<br />

“yellow house” on Creek<br />

Road and afterward his<br />

body was loaded into the<br />

trunk of his car and driven<br />

five miles away to Sands<br />

Road, where the car was<br />

burned and along with it<br />

his body.<br />

The charges that came<br />

down on Kennedy in a<br />

January 2011 indictment<br />

were felony murder, aggravated<br />

robbery, setting fire<br />

to personal property, and<br />

abuse of a corpse. Months<br />

before her indictment but<br />

in weeks following the<br />

homicide, Kennedy told a<br />

myriad of stories about<br />

Miller’s death, implicating<br />

several individuals but always<br />

altering a story and<br />

the persons who were in it;<br />

however, she placed herself<br />

in each story and reported<br />

eyewitness<br />

accounts to investigators.<br />

In his final arguments<br />

to the jury, Stutts reiterated<br />

that Kennedy did not<br />

act alone. He called her<br />

role in Miller’s death as<br />

“part of a plan to rob Jim<br />

Miller.”<br />

“And she had money<br />

the next day,” said Stutts.<br />

“According to Paul Cain (a<br />

prosecution witness),<br />

more money than I’ve<br />

ever seen in my life, a wad<br />

as big as my fist. Where<br />

did she get this money?”<br />

Stutts reminded the<br />

jury that on the day Miller<br />

died his cousin said Miller<br />

intended to buy cattle; another<br />

witness saw Miller<br />

with money later that day;<br />

and a resident off Creek<br />

Road reported hearing<br />

gunshots in the vicinity of<br />

the “yellow house” and<br />

watched a car and van pass<br />

her home afterward.<br />

Eldridge, however, in<br />

his closing remarks, said<br />

forty or fifty dollars would<br />

fill up a hand.<br />

“But take the money<br />

and leave the watch and<br />

rings that you saw earlier<br />

this week?” Eldridge<br />

asked. “Could the murder<br />

been a jealous husband or<br />

boyfriend or a hit? And<br />

what got Jim Miller to that<br />

house in the first place?”<br />

Eldridge asked the jury<br />

if it was true, as Kennedy<br />

said, that Sheriff Bill<br />

Bivens and Captain Detective<br />

Michael Morgan<br />

were involved. He said<br />

that placing Kennedy in a<br />

“cage” in the jail would<br />

make her life so miserable<br />

that “she would blow and<br />

crack.”<br />

“She not only broke,<br />

she gave up,” Eldridge<br />

said. “She was used and<br />

abused by the detectives<br />

and she breaks down. In<br />

her world, when you conform,<br />

you give a person in<br />

power what they want to<br />

hear. She was saying that<br />

what you want me to say I<br />

will say for you, and I’ve<br />

got a wild imagination.”<br />

Eldridge said Kennedy<br />

told so many stories she<br />

couldn’t keep them<br />

straight.<br />

“But she wanted to satisfy<br />

them,” he said, “so she<br />

would get out of the cage.<br />

And if I tell them I did, no<br />

one – not even Brandon<br />

Steele, Boonie Stokes, or<br />

Michael Morgan – will be<br />

after me.”<br />

Shortly before he<br />

ended his closing, Eldridge<br />

actually admitted to the<br />

jury that Kennedy was<br />

present at Miller’s murder.<br />

“You can conclude<br />

properly that she was<br />

there,” he said, “but she<br />

didn’t know a thing about<br />

what they were going to<br />

do with the body.”<br />

Then Eldridge beseeched<br />

the jurors.<br />

“Do this first kind deed<br />

ever in her life,” Eldridge<br />

implored the jury. “Set her<br />

free. She’s been in jail almost<br />

two years and it’s<br />

been the first period of sobriety<br />

since she was a<br />

teenager. She might make<br />

it if you set her free. You’d<br />

be telling the authorities<br />

to roll up their sleeves, get<br />

to work, and find out who<br />

killed Jim Miller.”<br />

Stutts, in rebuttal, said<br />

Kennedy was not powerless,<br />

as Eldridge had portrayed<br />

her, but was<br />

“violent.”<br />

“Remember her saying<br />

‘crazy people do crazy<br />

things’ to Agent Legg?” he<br />

asked. “And how afraid<br />

was she of Brandon Steele<br />

and Boonie Stokes? She<br />

was with both of them. If<br />

they are the desperados<br />

she would have you believe,<br />

are they stupid<br />

enough to take a witness<br />

to a murder?”<br />

Stutts said Kennedy,<br />

during her time in custody<br />

at the <strong>Monroe</strong> Count Jail,<br />

was treated like any other<br />

inmate.<br />

“It was not like being in<br />

a gulag,” Stutts said.<br />

“That’s not the way it was<br />

down there. Three days a<br />

week she not in that ‘cage,’<br />

but was with the rest of<br />

the females. You, as jurors,<br />

do not check your common<br />

sense at the door.<br />

Truth is, Jessica Kennedy<br />

played a part, and she admitted<br />

it. She said I know<br />

the part I played and I’ll<br />

do my time. Now that’s<br />

Chiefs Blast Rockwood in Season Opener<br />

The Sequoyah Chiefs<br />

traveled to Roane <strong>County</strong><br />

on Friday to face the<br />

Tigers of Rockwood in the<br />

season opener for both<br />

teams. The Tigers were<br />

predicted to be a strong<br />

team this year and were favored<br />

against Sequoyah,<br />

but it was the Chiefs who<br />

came out and proved to be<br />

the stronger team, jumping<br />

all over the Tigers early<br />

and completely dominating<br />

the game from start to<br />

finish and winning in convincing<br />

fashion with a<br />

score of 41-14.<br />

Sequoyah received the<br />

opening kick and with the<br />

ball on its own 20-yard line<br />

the Chiefs went on a<br />

seven-play 80-yard scoring<br />

drive for the game’s first<br />

points. Casey Coon ran<br />

for 13-yard on the first play<br />

for a first down. Blake<br />

Huffman rumbled for five<br />

yards and then quarterback<br />

Brett King hit his receiver<br />

Garret Dalton for<br />

14 yards and another first<br />

down. Coon then had runs<br />

of two, five, and two yards,<br />

setting up a fourth and<br />

one at the Tigers 40-yard<br />

line. Drew Carson got the<br />

first down and more, busting<br />

up the middle and by<br />

the defense for a 40-yard<br />

touchdown. The extra<br />

point was no good and<br />

with 8:16 left in the first<br />

quarter, the Chiefs led 6-0.<br />

Rockwood started its<br />

first possession on its own<br />

24-yard line. The Tigers’<br />

quarterback found his<br />

wide receiver down the<br />

left sideline on a fade pass<br />

for 22 yards and a first<br />

down, but the home team<br />

fumbled the ball on the<br />

next play as Sequoyahs'<br />

Forrest McKane came up<br />

with the loose pigskin and<br />

the Chiefs were back in<br />

business.<br />

With the ball on the<br />

Tigers 42-yard line, it only<br />

took the Chiefs four plays<br />

to find the end zone. King<br />

completed passes of eight<br />

yards to Coon, 22 yards to<br />

Austin Lunsford, and<br />

seven yards to Dalton.<br />

Coon then took the handoff<br />

and scampered up the<br />

middle for the six-yard<br />

touchdown. Huffman ran<br />

in the two-point conversion<br />

and, just like that, Sequoyah<br />

led 14-0.<br />

After a nice kick-off return,<br />

Rockwood started<br />

its next possession with<br />

good field position at its<br />

own 41-yard line but that<br />

did not last long. On the<br />

second play, Sequoyah's<br />

Luke Knott intercepted<br />

the Tigers’ quarterback<br />

giving the Chiefs the ball<br />

back at the Rockwood 40yard<br />

line.<br />

With the offense back<br />

on the field, it only took<br />

one play for Big Red to<br />

again find paydirt. Quar-<br />

terback King dropped<br />

back and found Huffman<br />

streaking down the right<br />

sideline for a 40-yard<br />

touchdown pass. King’s<br />

extra point kick was good<br />

and with 4:49 left in the<br />

first Sequoyah led 21-0.<br />

The Tigers started the<br />

next possession on their<br />

own 26- yard line and this<br />

time the home team<br />

picked up three first<br />

downs and moved the ball<br />

into Sequoyah territory,<br />

but on fourth and six<br />

punted the ball back to<br />

the Chiefs and with the<br />

first period coming to a<br />

end Sequoyah led 21-0.<br />

The Chiefs opened up<br />

the second quarter with<br />

the ball on their own 20yard<br />

line and it looked like<br />

they were going to put<br />

more points on the board<br />

moving the ball down the<br />

field, picking up five first<br />

downs and pushing the<br />

ball deep into Tiger territory,<br />

but the home team<br />

held on a fourth and goal<br />

at the five-yard line, turning<br />

the ball over on downs.<br />

Rockwood picked up<br />

three first downs as its<br />

pushed the ball out to<br />

mid-field but once again a<br />

turnover stopped the drive<br />

line.<br />

It only took the visitors<br />

four plays to find the end<br />

zone again. Huffman<br />

busted loose for a run of 32<br />

yards, then after a incomplete<br />

pass and a run for no<br />

gain, King hit his wide receiver<br />

Dalton for a 32-yard<br />

touchdown strike down<br />

the left side line, and with<br />

the extra point kick being<br />

no good, the Chiefs had<br />

pushed their lead to 27-0<br />

with 3:12 left in the second<br />

period.<br />

With the ball on their<br />

own 25-yard line the Tigers<br />

offense came to life, picking<br />

up four first downs and<br />

in front of the Rockwood<br />

pass attempt and picked it<br />

off and streaked 65 yards<br />

for the Sequoyah touchdown.<br />

King's extra point<br />

kick was good and with<br />

the quarter coming to an<br />

end the Chiefs held the<br />

halftime lead 34-0.<br />

Rockwood started the<br />

first possession of the second<br />

half on its own 15-yard<br />

line. The Chiefs pushed<br />

the Tigers back and forced<br />

a punt from inside the 10yard<br />

line, giving the Chiefs<br />

the ball with great field<br />

position on the Tigers’ 37.<br />

KC Deherrera ran the<br />

ball for three yards and<br />

then one yard, the Chiefs<br />

then fumbled the ball on<br />

third down as the Tigers<br />

recovered the loose<br />

pigskin on their own 29yard<br />

line.<br />

The Tigers took advantage<br />

of the great field po-<br />

sition and five plays later<br />

were in the end zone for<br />

their first score of the<br />

night, and with the extra<br />

point kick being good,<br />

Rockwood had cut the<br />

Chiefs lead to 34-7 with<br />

7:05 left in the third quarter.<br />

The home team was not<br />

done yet, as it recovered<br />

the onside kick, giving it<br />

the ball back at the Chiefs<br />

41-yard line. From there<br />

the Tigers scored six plays<br />

later on a three-yard<br />

touchdown run. The kick<br />

was again good and with<br />

4:17 left in the third, the<br />

Chiefs led 34-14.<br />

The Tigers tried another<br />

on-sides kick but this time<br />

the Chiefs recovered the<br />

ball giving them great field<br />

position on their own 44yard<br />

line. Looking to seize<br />

back some momentum,<br />

the Chiefs’ offense went<br />

to work and on the first<br />

play answered in a big way.<br />

King dropped back to<br />

pass and found his receiver<br />

Dalton in the left flats,<br />

where he broke loose<br />

The 2012-13 Sequoyah Chiefs Cheerleading Squad<br />

by Coon with 12 carries for<br />

72 yards with one touchdown.<br />

High School had its first<br />

home game on Friday, August<br />

17, with the Cats hosting<br />

the Bears of Tellico<br />

Plains. Each squad was<br />

looking to begin the season<br />

with a W.<br />

But it was the home<br />
