that where materials 'are entrusted to a g(overnment<br />
entity, under some degree of compulsion, for a limited<br />
purpose that would not normally entail disclosure to<br />
others, it would 'appear reasonable' to expect that the<br />
government entity will use the items 'solely for the<br />
purposes intended and not disclose them to others in<br />
ways that are unconnected with those intended purposes.<br />
No institutional concerns of the Barnstable Jail<br />
justified seizing the calls in this case. Tr. 3789-93.<br />
For all of the foregoing reasons, defendant invokes<br />
this Court's discretionary remedial powers undel: G.L. c.<br />
218 5333 and asks that his convictions be reversed.<br />
CONCLUSIOW<br />
For any, some, or all of the foregoing reasons,<br />
Defendant-<strong>Appellant</strong> <strong>McCowen</strong> asks this Court to REVERSE<br />
his convictions and remand his case to Superior Court<br />
for a new trial.<br />
