"high as a kite" and "wasted". Tr. 491. Investigators<br />
Mason and Burke led police into <strong>McCowen</strong>'s Hyannis home<br />
at 7:05 PM, found him in bed watching cartoons, arrested<br />
him, and transported him to the State Police barracks.<br />
Tr. 1576. Marijuana, burnt out roaches and Percocets<br />
were found on his bedside table. Tr. 2590-91.<br />
Given Miranda warnings, <strong>McCowen</strong> waived his right to<br />
an attorney "at this time." Tr. 1579-81. Mason claimed<br />
he sought <strong>McCowen</strong>'s conaent to record the interview and<br />
<strong>McCowen</strong> asked if he'd "look like an asahole" if he<br />
refused. Tr, 1582,1584. Mason alleged he replied "courts<br />
prefer that the interview be recorded to ensure<br />
accuracy" but <strong>McCowen</strong> didn't want to be recorded. Id. He<br />
signed a form withholding consent. a. MaSon told<br />
<strong>McCowen</strong> he "had a right to immediate medical attention,<br />
should he require it; and that he had a right to a phone<br />
call.," Tr. 1586. Charged with first-degree murder,<br />
<strong>McCowen</strong> purportedly told Mason "that he wanted to answer<br />
[his] questions and straighten everything out" to qet<br />
him home as soon as possible. Id.<br />
Throughout six hours of interrogation without food,<br />
drink, rest and with limited mental capacity, MCCOWen<br />
denied killing Worthington. At 12:09 AN on April 15,<br />
2005, "Mr. MCCOwen indicated to [Trooper Mason] that he<br />
