account; <strong>the</strong> efficient use <strong>of</strong> resources shall be aimed at. Development activities shall be<br />

realised accord<strong>in</strong>g to this plan”(WEB-4, WEB-5).<br />

Accord<strong>in</strong>g to article 168 titled as “explorati<strong>on</strong> and exploitati<strong>on</strong> <strong>of</strong> Natural<br />

resources”. “Natural wealth and resources shall be placed under <strong>the</strong> c<strong>on</strong>trol <strong>of</strong> and put<br />

at <strong>the</strong> disposal <strong>of</strong> <strong>the</strong> state”. The state may delegate this right to <strong>in</strong>dividuals or public<br />

corporati<strong>on</strong>s for specific periods.<br />

Regulati<strong>on</strong>s about “forests and <strong>the</strong> <strong>in</strong>habitants <strong>of</strong> forest villages” and<br />

“protecti<strong>on</strong> and development <strong>of</strong> forests” are expla<strong>in</strong>ed <strong>in</strong> article 169. The state shall<br />

enact <strong>the</strong> necessary legislati<strong>on</strong> and take <strong>the</strong> measures necessary for <strong>the</strong> protecti<strong>on</strong> and<br />

extensi<strong>on</strong> <strong>of</strong> forests. “All forests shall be under <strong>the</strong> care and supervisi<strong>on</strong> <strong>of</strong> <strong>the</strong><br />

state”(WEB-5). With this <strong>the</strong> limitati<strong>on</strong>s <strong>of</strong> duties <strong>of</strong> <strong>the</strong> state are determ<strong>in</strong>ed. In this<br />

article <strong>the</strong> ownership rights, management and exploitati<strong>on</strong> <strong>of</strong> <strong>the</strong> forests are given to <strong>the</strong><br />

state and <strong>the</strong> state is under duty for this subject. “The ownership <strong>of</strong> state forests shall not<br />

be transferred to o<strong>the</strong>rs... Ownership <strong>of</strong> <strong>the</strong>se forests cannot be acquired through<br />

prescripti<strong>on</strong> and nor shall servitude o<strong>the</strong>r than that <strong>in</strong> <strong>the</strong> public <strong>in</strong>terest”(WEB-5,<br />

WEB4).<br />

With this article, No acts and acti<strong>on</strong>s and political propaganda are permitted that<br />

may damage forests; and no general and special amnesties are permitted for <strong>of</strong>fences<br />

aga<strong>in</strong>st forests.<br />

The c<strong>on</strong>diti<strong>on</strong>s for <strong>the</strong> limitati<strong>on</strong> <strong>of</strong> forest boundaries are described as: “The<br />

limit<strong>in</strong>g <strong>of</strong> forest boundaries shall be prohibited, except <strong>in</strong> respect <strong>of</strong> areas whose<br />

preservati<strong>on</strong> as forests is c<strong>on</strong>sidered technically and scientifically useless, but whose<br />

c<strong>on</strong>versi<strong>on</strong> <strong>in</strong>to agricultural land has been found to be def<strong>in</strong>itely advantageous, and <strong>in</strong><br />

respect <strong>of</strong> fields, v<strong>in</strong>eyards, orchards, olive groves or similar areas which technically<br />

and scientifically ceased to be forest before 31 December 1981 and whose use for<br />

agricultural or stock-breed<strong>in</strong>g purposes has been found advantageous, and <strong>in</strong> respect <strong>of</strong><br />

built-up areas <strong>in</strong> <strong>the</strong> vic<strong>in</strong>ity <strong>of</strong> cities, towns or villages”.(WEB-5, WEB-4, WEB-3)<br />

In <strong>the</strong> article 170 about “<strong>the</strong> protecti<strong>on</strong> <strong>of</strong> <strong>the</strong> <strong>in</strong>habitants <strong>of</strong> forest areas” it<br />

is determ<strong>in</strong>ed that for improv<strong>in</strong>g <strong>the</strong> liv<strong>in</strong>g c<strong>on</strong>diti<strong>on</strong>s <strong>of</strong> <strong>the</strong> villagers and protect<strong>in</strong>g <strong>the</strong><br />

forests and <strong>the</strong>ir <strong>in</strong>tegrity some measures should be taken between <strong>the</strong> state and <strong>the</strong><br />

forest villagers.<br />

In part V <strong>of</strong> <strong>the</strong> C<strong>on</strong>stituti<strong>on</strong>, under <strong>the</strong> title “Miscellaneous Provisi<strong>on</strong>s”,<br />

regulati<strong>on</strong>s about <strong>the</strong> preservati<strong>on</strong> <strong>of</strong> reform laws take place. In part VI under <strong>the</strong> topic<br />

“Provisi<strong>on</strong>al Articles” provisi<strong>on</strong>al articles with 16 articles and lastly part VII under <strong>the</strong><br />
