about <strong>the</strong> utilizati<strong>on</strong> <strong>of</strong> natural and envir<strong>on</strong>mental resources. In this c<strong>on</strong>text, <strong>the</strong>se<br />

articles accepted as top data for plann<strong>in</strong>g discipl<strong>in</strong>e do not <strong>on</strong>ly determ<strong>in</strong>e <strong>the</strong> duties <strong>of</strong><br />

<strong>the</strong> state but also <strong>in</strong>dicate to <strong>the</strong> ec<strong>on</strong>omic rights <strong>of</strong> <strong>in</strong>dividuals.<br />

article 56 “health services and c<strong>on</strong>servati<strong>on</strong> <strong>of</strong> <strong>the</strong> envir<strong>on</strong>ment” under <strong>the</strong> topic<br />

“health, <strong>the</strong> envir<strong>on</strong>ment and hous<strong>in</strong>g”. This article states that “every<strong>on</strong>e has <strong>the</strong><br />

right to live <strong>in</strong> a healthy, balanced envir<strong>on</strong>ment”. In <strong>the</strong> utilizati<strong>on</strong> <strong>of</strong> this right<br />

improv<strong>in</strong>g <strong>the</strong> envir<strong>on</strong>ment, protect<strong>in</strong>g envir<strong>on</strong>mental health and prevent<strong>in</strong>g<br />

envir<strong>on</strong>mental polluti<strong>on</strong>, are described as <strong>the</strong> duties <strong>of</strong> <strong>the</strong> state and citizens. In this<br />

article about <strong>the</strong> improvement <strong>of</strong> health c<strong>on</strong>diti<strong>on</strong>s <strong>of</strong> <strong>in</strong>dividuals <strong>the</strong>se po<strong>in</strong>ts are stated:<br />

“To ensure that every<strong>on</strong>e leads <strong>the</strong>ir lives <strong>in</strong> c<strong>on</strong>diti<strong>on</strong>s <strong>of</strong> physical and mental health<br />

and to secure cooperati<strong>on</strong> <strong>in</strong> terms <strong>of</strong> human and material resources through ec<strong>on</strong>omy<br />

and <strong>in</strong>creased productivity, <strong>the</strong> state shall regulate central plann<strong>in</strong>g and functi<strong>on</strong><strong>in</strong>g <strong>of</strong><br />

<strong>the</strong> health services”(WEB-3,WEB-4, WEB-5). In this article <strong>of</strong> <strong>the</strong> C<strong>on</strong>stituti<strong>on</strong>, <strong>the</strong><br />

right to live <strong>in</strong> a healthy and well balanced envir<strong>on</strong>ment and <strong>the</strong> physical and<br />

psychological health c<strong>on</strong>diti<strong>on</strong>s are c<strong>on</strong>sidered as a whole.<br />

“Right to hous<strong>in</strong>g” is described <strong>in</strong> article 57: “The state shall take measures to<br />

meet <strong>the</strong> need for hous<strong>in</strong>g with<strong>in</strong> <strong>the</strong> framework <strong>of</strong> a plan which takes <strong>in</strong>to account <strong>the</strong><br />

characteristics <strong>of</strong> cities and envir<strong>on</strong>mental c<strong>on</strong>diti<strong>on</strong>s and supports community hous<strong>in</strong>g<br />

projects”. This article gives state two ma<strong>in</strong> duties such as tak<strong>in</strong>g precauti<strong>on</strong>s <strong>in</strong> meet<strong>in</strong>g<br />

<strong>the</strong> requirements <strong>of</strong> hous<strong>in</strong>g and sec<strong>on</strong>dly support<strong>in</strong>g community hous<strong>in</strong>g projects<br />

(Kabo lu, 1996,70). In <strong>the</strong> realizati<strong>on</strong> tools is plann<strong>in</strong>g c<strong>on</strong>sider<strong>in</strong>g <strong>the</strong> properties <strong>of</strong><br />

cities and envir<strong>on</strong>mental c<strong>on</strong>diti<strong>on</strong>s. Laws about this subject are Development Law<br />

No.3194, Mass Hous<strong>in</strong>g Law, Gecek<strong>on</strong>du (squatter settlement) Law.<br />

“C<strong>on</strong>servati<strong>on</strong> <strong>of</strong> Historical, Cultural and Natural Wealth” is expla<strong>in</strong>ed <strong>in</strong><br />

article 63. It is stated <strong>in</strong> this article that “The state shall ensure <strong>the</strong> c<strong>on</strong>servati<strong>on</strong> <strong>of</strong> <strong>the</strong><br />

historical, cultural and natural assets and wealth, and shall take supportive and<br />

promotive measures towards that end.<br />

Any limitati<strong>on</strong>s to be imposed <strong>on</strong> such privately owned assets and wealth and<br />

<strong>the</strong> compensati<strong>on</strong> and exempti<strong>on</strong>s to be accorded to <strong>the</strong> owners <strong>of</strong> such, as a result <strong>of</strong><br />

<strong>the</strong>se limitati<strong>on</strong>s, shall be regulated by law”(WEB-5). Related with this article legal<br />
