<strong>the</strong> C<strong>on</strong>stituti<strong>on</strong> formed with “social state governed by rule <strong>of</strong> law” idea aims to protect<br />

and c<strong>on</strong>trol <strong>the</strong> <strong>in</strong>dividualistic rights and freedoms and also c<strong>on</strong>stitutes a political and<br />

ec<strong>on</strong>omic balance with<strong>in</strong> <strong>the</strong> social structure.<br />

II. Part forms <strong>of</strong> 4 chapters. Topics <strong>of</strong> <strong>the</strong>se chapters are: 1. Basic Rights and<br />

Freedoms; 2. Rights and Duties <strong>of</strong> Individuals; 3. Social and Ec<strong>on</strong>omic Rights and<br />

Duties; 4. Political Rights and Duties. In <strong>the</strong>se chapters laws about settlements,<br />

plann<strong>in</strong>g, public <strong>in</strong>terest, rights and freedoms take place <strong>in</strong> <strong>the</strong>se articles:<br />

2. Chapter-Article 23 under <strong>the</strong> topic Rights and Duties <strong>of</strong> Individuals<br />

determ<strong>in</strong>es that every pers<strong>on</strong> has <strong>the</strong> freedom <strong>of</strong> settlement and travel<strong>in</strong>g under <strong>the</strong> topic<br />

“residence and movement”; and article 35 determ<strong>in</strong>es that “ownership right” is a<br />

right for everybody and <strong>the</strong>se rights could <strong>on</strong>ly be limited for <strong>the</strong> public <strong>in</strong>terest. In <strong>the</strong><br />

same article a limitati<strong>on</strong> that <strong>in</strong> <strong>the</strong> usage <strong>of</strong> ownership rights it cannot be aga<strong>in</strong>st <strong>the</strong><br />

social <strong>in</strong>terest. By this limitati<strong>on</strong>, it is determ<strong>in</strong>ed that although ownership right is<br />

current for every pers<strong>on</strong> it cannot be used aga<strong>in</strong>st <strong>the</strong> public <strong>in</strong>terest and also expla<strong>in</strong>ed<br />

that a limitati<strong>on</strong> can be put to <strong>the</strong>se rights for “public <strong>in</strong>terest”.<br />

3. Chapter is about social and ec<strong>on</strong>omic rights and duties and <strong>the</strong> right and duty<br />

<strong>of</strong> educati<strong>on</strong> and tra<strong>in</strong><strong>in</strong>g is def<strong>in</strong>ed with article 42. This article expla<strong>in</strong>s that “no <strong>on</strong>e<br />

shall be deprived <strong>of</strong> <strong>the</strong> right <strong>of</strong> learn<strong>in</strong>g and educati<strong>on</strong>”, and <strong>the</strong> state should help<br />

successful students who lack f<strong>in</strong>ancial means and should take necessary measures who<br />

need special tra<strong>in</strong><strong>in</strong>g.<br />

In <strong>the</strong> third chapter <strong>the</strong>re are five different sub-topics. These sub-topics can be<br />

listed as utilizati<strong>on</strong> <strong>of</strong> <strong>the</strong> coasts, land ownership, protecti<strong>on</strong> <strong>of</strong> agriculture, animal<br />

husbandry and <strong>of</strong> pers<strong>on</strong>s engaged <strong>in</strong> <strong>the</strong>se activities, expropriati<strong>on</strong>, nati<strong>on</strong>alizati<strong>on</strong> and<br />

privatizati<strong>on</strong>.<br />

Utilizati<strong>on</strong> <strong>of</strong> <strong>the</strong> coasts is organized <strong>in</strong> article 43. In this article coasts are<br />

under <strong>the</strong> sovereignty and disposal <strong>of</strong> <strong>the</strong> state. It is stated that “sea, coasts, lake, shores<br />

or river banks and <strong>of</strong> <strong>the</strong> coastal strip al<strong>on</strong>g <strong>the</strong> sea and lakes, public <strong>in</strong>terest shall be<br />

taken <strong>in</strong>to c<strong>on</strong>siderati<strong>on</strong> with priority... The width <strong>of</strong> coasts and coastal strips accord<strong>in</strong>g<br />

to <strong>the</strong> purpose <strong>of</strong> utilizati<strong>on</strong> and <strong>the</strong> c<strong>on</strong>diti<strong>on</strong>s <strong>of</strong> utilizati<strong>on</strong> by <strong>in</strong>dividuals shall be<br />

determ<strong>in</strong>ed by law”. In this article <strong>of</strong> <strong>the</strong> C<strong>on</strong>stituti<strong>on</strong> it is c<strong>on</strong>sidered that <strong>the</strong> utilizati<strong>on</strong><br />

<strong>of</strong> coasts will be determ<strong>in</strong>ed by <strong>the</strong> laws also and it carries great importance for<br />

plann<strong>in</strong>g discipl<strong>in</strong>e for plans d<strong>on</strong>e at <strong>the</strong>se areas.<br />
