liberties ra<strong>the</strong>r than <strong>on</strong> equalities; <strong>in</strong>tensificati<strong>on</strong> <strong>of</strong> global capital; NGO acti<strong>on</strong>s aga<strong>in</strong>st<br />
globalizati<strong>on</strong>; affects <strong>of</strong> envir<strong>on</strong>mental problems <strong>on</strong> whole global society and<br />
<strong>in</strong>ternati<strong>on</strong>al organizati<strong>on</strong> mechanisms directed toward decreas<strong>in</strong>g <strong>the</strong>se affects. Aga<strong>in</strong>st<br />
<strong>the</strong> ec<strong>on</strong>omic, cultural and social fields bas<strong>in</strong>g <strong>on</strong> <strong>the</strong> spread and <strong>in</strong>tensity <strong>of</strong> liberalism<br />
<strong>on</strong> <strong>the</strong> world with is ec<strong>on</strong>omic and political dimensi<strong>on</strong>s and developments <strong>of</strong> c<strong>on</strong>cepts<br />
<strong>of</strong> “rights, liberties, equality, <strong>in</strong>terest” <strong>on</strong> <strong>the</strong>se fields, <strong>the</strong>re are still some unsolved<br />
problems; today. These problems can be listed as:<br />
1) There is tensi<strong>on</strong> between <strong>the</strong> equality side <strong>of</strong> political liberalism (legal) and <strong>the</strong><br />
mechanism bas<strong>in</strong>g <strong>on</strong> <strong>the</strong> free competiti<strong>on</strong> am<strong>on</strong>g <strong>the</strong> unequal <strong>in</strong>dividuals <strong>of</strong> ec<strong>on</strong>omic<br />
liberalism. The c<strong>on</strong>crete results <strong>of</strong> this tensi<strong>on</strong> is legal liberalism and liberal rule <strong>of</strong> law<br />
becom<strong>in</strong>g mean<strong>in</strong>gless by accept<strong>in</strong>g every<strong>on</strong>e equal and giv<strong>in</strong>g equal political rights<br />
and freedoms to <strong>the</strong>m, <strong>in</strong> o<strong>the</strong>r words mak<strong>in</strong>g <strong>the</strong>m equal <strong>in</strong> fr<strong>on</strong>t <strong>of</strong> laws. Aim <strong>of</strong><br />
liberal rule <strong>of</strong> law to obta<strong>in</strong> <strong>the</strong> <strong>in</strong>dividual’s happ<strong>in</strong>ess, to protect <strong>the</strong> h<strong>on</strong>or <strong>of</strong> humanity<br />
and <strong>in</strong>dividual rights turns <strong>in</strong>to an unpracticed project because <strong>of</strong> reas<strong>on</strong>s caused by<br />
ec<strong>on</strong>omic liberalism.<br />
2) Because it <strong>in</strong>volves <strong>justice</strong> equality, <strong>in</strong>dividuals’ hav<strong>in</strong>g <strong>the</strong> same equalities is an<br />
important subject. Discourse say<strong>in</strong>g that political equalities are <strong>the</strong> first step <strong>in</strong> <strong>the</strong><br />
performance <strong>of</strong> <strong>justice</strong> is accepted prevalently. There is no c<strong>on</strong>venti<strong>on</strong> <strong>on</strong> <strong>the</strong> o<strong>the</strong>r hand<br />
about <strong>the</strong> subject what equalities should <strong>in</strong>volve <strong>in</strong> ec<strong>on</strong>omic <strong>justice</strong> 29 . The th<strong>in</strong>g that is<br />
revealed by <strong>the</strong> <str<strong>on</strong>g>evaluati<strong>on</strong></str<strong>on</strong>g>s bas<strong>in</strong>g <strong>on</strong> liberties and equal rights is that <strong>on</strong>e’s rights are<br />
resp<strong>on</strong>ses to <strong>the</strong> o<strong>the</strong>r’s obligati<strong>on</strong>s. This shows that <strong>the</strong> duties <strong>of</strong> <strong>the</strong> state and <strong>the</strong><br />
political <strong>in</strong>stituti<strong>on</strong>s and <strong>the</strong> obligati<strong>on</strong>s <strong>of</strong> citizens <strong>in</strong> <strong>the</strong> provisi<strong>on</strong> <strong>of</strong> ec<strong>on</strong>omic and<br />
political rights are determ<strong>in</strong>ed by historical, cultural, social <strong>process</strong>es. The ec<strong>on</strong>omic<br />
distributi<strong>on</strong> system established am<strong>on</strong>g citizens where every pers<strong>on</strong> is accepted equal<br />
and free are determ<strong>in</strong>ed and practiced accord<strong>in</strong>g to time, space, ethic and social cultural<br />
values and also practices with<strong>in</strong> given time and place.<br />
In this c<strong>on</strong>text, <strong>the</strong>re are certa<strong>in</strong> po<strong>in</strong>ts <strong>in</strong> balanc<strong>in</strong>g antag<strong>on</strong>ism am<strong>on</strong>g rights<br />
and liberties when dist<strong>in</strong>guishes between “liberal rule <strong>of</strong> law” and “social rule <strong>of</strong> law”<br />
are taken as fundamental pr<strong>in</strong>ciples, such as; whe<strong>the</strong>r society or <strong>in</strong>dividual is taken as<br />
basic subject; whe<strong>the</strong>r priority is given to political values or ec<strong>on</strong>omic values; how<br />
