2.4.4. A General Evaluati<strong>on</strong> about <strong>the</strong> Development <strong>of</strong> Rights and<br />

Liberties<br />

Three different periods <strong>in</strong> <strong>the</strong> improvement liberal rule <strong>of</strong> law and liberal rights<br />

and liberties can be generalized as below.<br />

First Period: Negative liberties began to be seen dur<strong>in</strong>g <strong>the</strong> beg<strong>in</strong>n<strong>in</strong>g <strong>of</strong> ris<strong>in</strong>g period<br />

<strong>of</strong> rule <strong>of</strong> law (first stage, <strong>in</strong>dividual liberties and political rights) and <strong>the</strong>se liberties<br />

found a practice field with “laissez faire”, ec<strong>on</strong>omic political perspective. Protecti<strong>on</strong> <strong>of</strong><br />

liberties owned by people start<strong>in</strong>g from <strong>the</strong>ir birth and <strong>the</strong>ir put under security take<br />

place <strong>on</strong> <strong>the</strong> basis <strong>of</strong> <strong>justice</strong> <strong>of</strong> <strong>the</strong> state at that period. It is accepted that with <strong>the</strong><br />

compet<strong>in</strong>g attempts am<strong>on</strong>g <strong>the</strong>se <strong>in</strong>dividuals whose liberties are protected, ec<strong>on</strong>omic<br />

and social progresses and developments could be achieved. Characteristics <strong>of</strong> this<br />

period are; a society c<strong>on</strong>stitute <strong>of</strong> atomistic free <strong>in</strong>dividuals; a legal order formed <strong>of</strong><br />

<strong>the</strong>se <strong>in</strong>dividuals’ unlimited rights and liberties; unlimited rights and liberties ga<strong>in</strong>ed by<br />

birth; a state approach as <strong>the</strong> organiz<strong>in</strong>g mechanism <strong>of</strong> <strong>the</strong>se rights and liberties. First<br />

stage rights at this period when dom<strong>in</strong>ancy was given to law and state <strong>in</strong> <strong>the</strong> sense <strong>of</strong><br />

gett<strong>in</strong>g free from div<strong>in</strong>e will power, from class and group and arrangement <strong>of</strong> <strong>the</strong>se<br />

rights were progressive practices. However, <strong>in</strong>equalities <strong>in</strong> <strong>the</strong> development <strong>of</strong> rights<br />

and liberties <strong>in</strong> ec<strong>on</strong>omic and political fields and deepen<strong>in</strong>g poverty problems mode it<br />

necessary to ga<strong>in</strong> a new dimensi<strong>on</strong> to first stage liberties.<br />

Sec<strong>on</strong>d stage; Sec<strong>on</strong>d stage which developed after ec<strong>on</strong>omic progressi<strong>on</strong>s, ec<strong>on</strong>omic<br />

crisis <strong>of</strong> <strong>the</strong> world, and after First and Sec<strong>on</strong>d World War is <strong>the</strong> period <strong>of</strong> social,<br />

ec<strong>on</strong>omic and cultural rights. This period can be summarized as; welfare state practices<br />

supported by Keynesian policies, too; rule <strong>of</strong> law transform<strong>in</strong>g <strong>in</strong>to a social state and its<br />

extensi<strong>on</strong>; extensi<strong>on</strong> <strong>in</strong> government type and <strong>in</strong> representative democracy. The ma<strong>in</strong><br />

emphasize <strong>of</strong> that period is <strong>on</strong> <strong>the</strong> “<strong>in</strong>terfer<strong>in</strong>g role <strong>of</strong> <strong>the</strong> state <strong>in</strong> achiev<strong>in</strong>g equality”. In<br />

o<strong>the</strong>r words, <strong>in</strong>terventi<strong>on</strong> <strong>of</strong> <strong>the</strong> state <strong>on</strong> distributi<strong>on</strong> divisi<strong>on</strong> relati<strong>on</strong> <strong>on</strong> ec<strong>on</strong>omic field<br />

has <strong>the</strong> mean<strong>in</strong>g <strong>of</strong> <strong>the</strong> state to take <strong>the</strong> role <strong>of</strong> balanc<strong>in</strong>g and organiz<strong>in</strong>g <strong>the</strong> <strong>in</strong>equalities.<br />

In <strong>the</strong> third period; global ec<strong>on</strong>omic, social, cultural organizati<strong>on</strong> and<br />

developments were effective especially after 1970’s. The ma<strong>in</strong> characteristics <strong>of</strong> this<br />

period are; aband<strong>on</strong>ment <strong>of</strong> Keynesian development policies; discourses about go<strong>in</strong>g<br />
