ABSTRACT<br />

This <strong>the</strong>sis aims at scrut<strong>in</strong>iz<strong>in</strong>g what is meant by <strong>the</strong> c<strong>on</strong>cept <strong>of</strong> <strong>justice</strong> and <strong>the</strong><br />

ways <strong>the</strong> c<strong>on</strong>cept is be<strong>in</strong>g referred to <strong>in</strong> urban plann<strong>in</strong>g practice <strong>in</strong> Turkey. Aimed as<br />

such, <strong>the</strong> due analysis <strong>in</strong>volves exam<strong>in</strong>ati<strong>on</strong> <strong>of</strong> how <strong>the</strong> c<strong>on</strong>cept is taken <strong>in</strong>to<br />

c<strong>on</strong>siderati<strong>on</strong> and def<strong>in</strong>ed by different actors tak<strong>in</strong>g part <strong>in</strong> urban plann<strong>in</strong>g <strong>process</strong> <strong>of</strong><br />

our country. The basic data underly<strong>in</strong>g <strong>the</strong> c<strong>on</strong>siderati<strong>on</strong>s based <strong>on</strong> not <strong>on</strong>ly <strong>the</strong><br />

c<strong>on</strong>ceptual discussi<strong>on</strong>s, but also <strong>the</strong> plann<strong>in</strong>g practice will comprise different demands<br />

c<strong>on</strong>cern<strong>in</strong>g <strong>the</strong> urban space and <strong>the</strong> cases <strong>of</strong> lawsuit under c<strong>on</strong>trol <strong>of</strong> adjudicati<strong>on</strong> as<br />

reflecti<strong>on</strong>s <strong>of</strong> <strong>the</strong>se demands up<strong>on</strong> <strong>the</strong> <strong>process</strong> <strong>of</strong> plann<strong>in</strong>g.<br />

The questi<strong>on</strong>s to which this study based <strong>on</strong> “<strong>justice</strong>” <strong>in</strong> <strong>the</strong> urban system and <strong>the</strong><br />

plann<strong>in</strong>g discipl<strong>in</strong>e are to be answered can be listed as follows: Which c<strong>on</strong>cepts, which<br />

ideals, which discourses and methods are used dur<strong>in</strong>g <strong>the</strong> <strong>process</strong> <strong>of</strong> distributi<strong>on</strong><br />

mechanism <strong>in</strong> <strong>the</strong> ec<strong>on</strong>omic realm, law system and judicial <strong>process</strong>? How are <strong>the</strong> basic<br />

c<strong>on</strong>cepts <strong>of</strong> <strong>justice</strong>, namely equality, <strong>in</strong>terest, right and liberty used <strong>in</strong> def<strong>in</strong><strong>in</strong>g and<br />

encounter<strong>in</strong>g <strong>the</strong> urban social needs <strong>in</strong> <strong>the</strong>se <strong>process</strong>es? Do <strong>the</strong> achieved results <strong>in</strong>volve<br />

any targeted ends that can be called as just?<br />

In order to elucidate <strong>the</strong> understand<strong>in</strong>g and demands <strong>of</strong> <strong>justice</strong>, c<strong>on</strong>ceptual<br />

<strong>in</strong>formati<strong>on</strong> perta<strong>in</strong><strong>in</strong>g to <strong>the</strong> c<strong>on</strong>cept <strong>of</strong> <strong>justice</strong> is required. For this reas<strong>on</strong>, study<br />

focuses <strong>on</strong> <strong>the</strong>ories <strong>of</strong> <strong>justice</strong> and elaborates <strong>the</strong> fundamental po<strong>in</strong>ts <strong>of</strong> c<strong>on</strong>cepts,<br />

<strong>the</strong>ories and <strong>the</strong>ir reflecti<strong>on</strong> <strong>on</strong> <strong>the</strong> state regulati<strong>on</strong>s.<br />

Regard<strong>in</strong>g an assessment <strong>of</strong> <strong>the</strong> Turkish practice, overall assessments are held as<br />

based <strong>on</strong> cases <strong>of</strong> lawsuit under c<strong>on</strong>trol <strong>of</strong> adjudicati<strong>on</strong>. The cases <strong>of</strong> lawsuit are<br />

assumed to represent matters <strong>of</strong> c<strong>on</strong>flict/dispute and spatial demands <strong>of</strong> actors regard<strong>in</strong>g<br />

<strong>the</strong> urban space. Accepted as such, <strong>the</strong> spatial disputes will be elaborated <strong>on</strong> basis <strong>of</strong> <strong>the</strong><br />

matters <strong>of</strong> case study area <strong>in</strong> emphasis.<br />
