c<strong>on</strong>cepts is <strong>the</strong> society’s structure such as nati<strong>on</strong>al-cultural differences, level <strong>of</strong><br />

ec<strong>on</strong>omic and social development. (Aybay&Aybay; 2003; 70).<br />

Justice c<strong>on</strong>cept that is be<strong>in</strong>g used today is <strong>the</strong> results <strong>of</strong> liberal, modernist and a<br />

west centralized traditi<strong>on</strong> <strong>of</strong> last tree centuries. (Özlem; 2000a; 9-23). Justice <strong>in</strong> modern<br />

times is separated <strong>in</strong>to; law state and <strong>in</strong>stituti<strong>on</strong> field, distributi<strong>on</strong>al pr<strong>in</strong>ciple <strong>in</strong><br />

ec<strong>on</strong>omic field, democracy and adm<strong>in</strong>istrati<strong>on</strong> <strong>in</strong> politic field. In ec<strong>on</strong>omic, social,<br />

cultural <strong>process</strong>es which are different fields <strong>of</strong> social life, def<strong>in</strong>iti<strong>on</strong> <strong>of</strong> <strong>justice</strong> <strong>in</strong><br />

<strong>in</strong>dependent and different c<strong>on</strong>tents prevents a comprehensive aspect. Never<strong>the</strong>less,<br />

<strong>the</strong>se dis<strong>in</strong>tegrated <strong>process</strong>es c<strong>on</strong>stitute <strong>the</strong> <strong>in</strong>tegrity that completes each o<strong>the</strong>r. (Özlem;<br />

2000b, 29-43).<br />

Although <strong>the</strong> human relati<strong>on</strong>s, <strong>the</strong> relati<strong>on</strong>s <strong>of</strong> man with o<strong>the</strong>rs, rights,<br />

resp<strong>on</strong>sibilities and duties were given a central place <strong>in</strong> <strong>the</strong> c<strong>on</strong>cept <strong>of</strong> <strong>justice</strong> dur<strong>in</strong>g <strong>the</strong><br />

Modern periods, <strong>in</strong> recent times, <strong>the</strong> emphasis has been put more <strong>on</strong> necessity <strong>of</strong> a<br />

nature-based <strong>justice</strong> approach as supported by debates <strong>on</strong> fem<strong>in</strong>ist c<strong>on</strong>siderati<strong>on</strong>s <strong>on</strong> <strong>the</strong><br />

<strong>on</strong>e hand, and envir<strong>on</strong>mentalist movements and debates <strong>of</strong> susta<strong>in</strong>ability, <strong>on</strong> <strong>the</strong> o<strong>the</strong>r 10 .<br />

Still however, <strong>in</strong> <strong>the</strong> prevail<strong>in</strong>g discourse and paradigm <strong>of</strong> our day, <strong>the</strong> def<strong>in</strong>iti<strong>on</strong> <strong>of</strong><br />

rights; def<strong>in</strong>iti<strong>on</strong> <strong>of</strong> existence; <strong>in</strong>terest; liberty (absolute); and equality c<strong>on</strong>cepts are<br />

usually regarded with<strong>in</strong> <strong>the</strong> framework <strong>of</strong> humanistic world and human relati<strong>on</strong>s.<br />

At f<strong>in</strong>al stage arrived; <strong>justice</strong> depends up<strong>on</strong> <strong>the</strong> ethical <strong>on</strong>e as a virtue <strong>in</strong><br />

subjective sphere <strong>of</strong> th<strong>in</strong>k<strong>in</strong>g and behaviors, up<strong>on</strong> <strong>the</strong> <strong>in</strong>formal sphere (that is,<br />

c<strong>on</strong>science and <strong>the</strong> <strong>in</strong>dividual). In sphere <strong>of</strong> social life <strong>on</strong> <strong>the</strong> o<strong>the</strong>r hand, it is an idea<br />

and ideal. 11 In o<strong>the</strong>r words, whereas it is virtue actively tak<strong>in</strong>g part <strong>in</strong> pers<strong>on</strong>al-<strong>in</strong>formal<br />

relati<strong>on</strong>s, <strong>in</strong> impers<strong>on</strong>al-formal relati<strong>on</strong>s and with<strong>in</strong> <strong>the</strong> formal sphere, <strong>the</strong> ways,<br />

pr<strong>in</strong>ciples and rules to reach <strong>the</strong> idea and <strong>the</strong> ideal are at issue. While <strong>the</strong> basic idea<br />

up<strong>on</strong> which <strong>the</strong> laws <strong>in</strong> formal sphere and regulati<strong>on</strong> tools <strong>of</strong> <strong>the</strong> social structure is<br />

<strong>justice</strong>, <strong>in</strong> private sphere it takes place as a “value” (<strong>in</strong> sphere <strong>of</strong> <strong>in</strong>dividual, c<strong>on</strong>science<br />

and virtues). Never<strong>the</strong>less, it is manifest that c<strong>on</strong>siderati<strong>on</strong>s <strong>of</strong> <strong>the</strong> formal sphere<br />

<strong>in</strong>evitably cover and menti<strong>on</strong> <strong>justice</strong> as virtue and ethics as well. 12 In terms <strong>of</strong> its<br />

widespread positi<strong>on</strong> with<strong>in</strong> <strong>the</strong> public sphere and social structure, while <strong>justice</strong><br />

On <strong>on</strong>e hand, while <strong>the</strong> debates <strong>on</strong> hypo<strong>the</strong>tical assents, laws regulat<strong>in</strong>g <strong>the</strong> existence <strong>of</strong> man <strong>in</strong> human<br />

world (natural-human) and <strong>on</strong> <strong>justice</strong> all c<strong>on</strong>t<strong>in</strong>ue, <strong>on</strong> <strong>the</strong> o<strong>the</strong>r hand, with <strong>the</strong> questi<strong>on</strong>s as to what nature<br />

and man are and how <strong>the</strong>y exist, <strong>the</strong> debates are carried up to a new dimensi<strong>on</strong>.<br />
