THE FRAMEWORK OF JUSTICE CONCEPT<br />
In this part <strong>of</strong> <strong>the</strong> study c<strong>on</strong>ceptual c<strong>on</strong>siderati<strong>on</strong>s accompany<strong>in</strong>g <strong>the</strong> <str<strong>on</strong>g>evaluati<strong>on</strong></str<strong>on</strong>g>s<br />
<strong>on</strong> urban plann<strong>in</strong>g field will be exam<strong>in</strong>ed. In this frame, firstly <strong>the</strong> <strong>justice</strong> def<strong>in</strong>iti<strong>on</strong>s are<br />
handled and <strong>justice</strong> <strong>the</strong>ories and arguments which came <strong>on</strong> agenda after 1970’s.<br />
As <strong>justice</strong> mostly was evaluated with <strong>the</strong> state and structure <strong>of</strong> <strong>the</strong> state and<br />
toge<strong>the</strong>r with <strong>the</strong> rights, freedoms, <strong>in</strong>terests and equality with<strong>in</strong> this structure,<br />
transformati<strong>on</strong> <strong>of</strong> <strong>the</strong>se values with<strong>in</strong> <strong>the</strong> development <strong>process</strong> <strong>of</strong> Liberal Nati<strong>on</strong> State<br />
c<strong>on</strong>stitute ano<strong>the</strong>r subject <strong>of</strong> this chapter. It is c<strong>on</strong>sidered important that <str<strong>on</strong>g>evaluati<strong>on</strong></str<strong>on</strong>g> <strong>of</strong><br />
<strong>the</strong> state and its <strong>in</strong>stituti<strong>on</strong>s/tools that form <strong>on</strong>e <strong>of</strong> <strong>the</strong> tools <strong>in</strong> <strong>the</strong> realizati<strong>on</strong> <strong>of</strong> formal<br />
<strong>process</strong>es <strong>of</strong> <strong>justice</strong> plays an important role <strong>in</strong> understand<strong>in</strong>g <strong>the</strong> c<strong>on</strong>cept <strong>of</strong> “formal<br />
<strong>justice</strong>”. This type <strong>of</strong> c<strong>on</strong>siderati<strong>on</strong> is thought as a necessary factor <strong>in</strong> <strong>the</strong> <str<strong>on</strong>g>evaluati<strong>on</strong></str<strong>on</strong>g> <strong>of</strong><br />
formal <strong>justice</strong> that evolves with modern state and legitimate <strong>justice</strong>. Therefore, subjects<br />
like liberal development <strong>of</strong> <strong>the</strong> state <strong>in</strong> understand<strong>in</strong>g <strong>the</strong> c<strong>on</strong>cept <strong>of</strong> <strong>justice</strong>, state as an<br />
organiz<strong>in</strong>g mechanism, and <str<strong>on</strong>g>evaluati<strong>on</strong></str<strong>on</strong>g> <strong>of</strong> right, freedom, <strong>in</strong>terest and equality<br />
approaches def<strong>in</strong>ed with<strong>in</strong> this development are also covered <strong>in</strong> this chapter.<br />
From viewpo<strong>in</strong>t <strong>of</strong> Urban Plann<strong>in</strong>g discipl<strong>in</strong>e <str<strong>on</strong>g>evaluati<strong>on</strong></str<strong>on</strong>g>s about <strong>justice</strong> <strong>on</strong> urban<br />
area which came <strong>in</strong>to agenda <strong>in</strong> <strong>the</strong> last 30 years and some <strong>of</strong> <strong>the</strong> critics about plann<strong>in</strong>g<br />
also are <strong>in</strong>cluded <strong>in</strong>to this chapter. It is thought that with <strong>the</strong>se c<strong>on</strong>siderati<strong>on</strong>s a general<br />
perspective about <strong>the</strong> new directi<strong>on</strong>s <strong>of</strong> plann<strong>in</strong>g discipl<strong>in</strong>e can be drawn.<br />
2.1. Def<strong>in</strong>iti<strong>on</strong>s <strong>of</strong> Justice C<strong>on</strong>cept<br />
In <strong>the</strong> m<strong>on</strong>ol<strong>in</strong>gual (Turkish) dicti<strong>on</strong>ary 5 <strong>the</strong> def<strong>in</strong>iti<strong>on</strong> <strong>of</strong> <strong>justice</strong> c<strong>on</strong>cept is<br />
given as compliance with laws. When <strong>justice</strong> is def<strong>in</strong>ed as legal rights and state<br />
organizati<strong>on</strong>s, <strong>the</strong> c<strong>on</strong>cepts <strong>of</strong> law and <strong>justice</strong> are replaceable. However, such a<br />
replacement does not adequately clarify <strong>the</strong> c<strong>on</strong>text or <strong>the</strong> mean<strong>in</strong>g <strong>of</strong> <strong>justice</strong> bey<strong>on</strong>d<br />
laws (Çeçen;1993;18). In <strong>the</strong> def<strong>in</strong>iti<strong>on</strong>s that stress <strong>the</strong> fact that <strong>the</strong>se two c<strong>on</strong>cepts are<br />
