These data are important <strong>in</strong> <strong>in</strong>dicat<strong>in</strong>g <strong>the</strong> level <strong>of</strong> c<strong>on</strong>flicts that emerge <strong>in</strong><br />

spatial situati<strong>on</strong>s. Distributi<strong>on</strong> <strong>of</strong> total 965 cases about <strong>the</strong> spatial c<strong>on</strong>flicts from <strong>the</strong><br />

viewpo<strong>in</strong>t <strong>of</strong> pla<strong>in</strong>tiffs are: 811 private (84.04 %), 63 <strong>of</strong>ficial <strong>in</strong>stituti<strong>on</strong>s (6.53), 57<br />

firms (5.91), 19 zmir Chamber <strong>of</strong> Commerce (Ticaret Odası) (1.97 %), 12 cooperatives<br />

(most <strong>of</strong> <strong>the</strong>m build<strong>in</strong>g cooperatives), <strong>on</strong>e foundati<strong>on</strong> (0.10 %), <strong>on</strong>e TMMOB General<br />

Directorate <strong>of</strong> Chamber <strong>of</strong> Architecture (0.10 %), <strong>on</strong>e apartment build<strong>in</strong>g management<br />

(0.10 %). S<strong>in</strong>ce <strong>the</strong> objecti<strong>on</strong>s about <strong>the</strong> spatial <strong>in</strong>terventi<strong>on</strong>s and pla<strong>in</strong>tiffs are mostly<br />

<strong>the</strong> build<strong>in</strong>g cooperatives and pers<strong>on</strong>s it can be c<strong>on</strong>cluded that <strong>the</strong> <strong>in</strong>terventi<strong>on</strong>s <strong>on</strong> <strong>the</strong><br />

ownership rights <strong>in</strong> urban space are subjects to <strong>the</strong>se cases.<br />

Distributi<strong>on</strong> <strong>of</strong> <strong>the</strong> cases as be<strong>in</strong>g Adm<strong>in</strong>istrative/Judical are; cases proceeded <strong>in</strong><br />

Tax and Adm<strong>in</strong>istartive courts (818) are more than <strong>the</strong> <strong>on</strong>es proceeded <strong>in</strong> Civil Court <strong>of</strong><br />

First Instance, Crim<strong>in</strong>al Court <strong>of</strong> Peace and o<strong>the</strong>r courts (397). In <strong>the</strong>se two settlements<br />

with a total populati<strong>on</strong> 120 thousand, when <strong>the</strong> number <strong>of</strong> acti<strong>on</strong>s proceeded about<br />

spatial problems between <strong>the</strong> years 1992-2003 are evaluated, <strong>the</strong> levels and <strong>in</strong>tensity <strong>of</strong><br />

<strong>the</strong> decisi<strong>on</strong>s and <strong>in</strong>terventi<strong>on</strong>s produced <strong>on</strong> urban land and c<strong>on</strong>flicts reflected <strong>on</strong> courts<br />

can be understood. These areas which take place <strong>on</strong> <strong>the</strong> western axis <strong>of</strong> <strong>the</strong> city and<br />

seem as if <strong>the</strong>y were separated from <strong>the</strong> whole <strong>of</strong> city with municipality borders are <strong>in</strong><br />

fact <strong>the</strong> c<strong>on</strong>t<strong>in</strong>u<strong>in</strong>g parts <strong>of</strong> <strong>the</strong> greater city. Decisi<strong>on</strong>s taken for <strong>the</strong> municipality <strong>of</strong><br />

county also affect <strong>the</strong> greater city <strong>of</strong> zmir. C<strong>on</strong>trarily, it is very <strong>in</strong>terest<strong>in</strong>g that most <strong>of</strong><br />

<strong>the</strong> acti<strong>on</strong>s proceeded about <strong>the</strong> decisi<strong>on</strong>s taken for <strong>the</strong> area c<strong>on</strong>stitute <strong>of</strong> <strong>the</strong> <strong>on</strong>es liv<strong>in</strong>g<br />

with<strong>in</strong> county municipality borders, owners <strong>of</strong> properties and <strong>the</strong> <strong>on</strong>es affected from <strong>the</strong><br />

applicati<strong>on</strong>s.<br />

In <strong>the</strong> acti<strong>on</strong>s proceeded about urban space and plann<strong>in</strong>g it is necessary to<br />

c<strong>on</strong>sider <strong>the</strong>se acti<strong>on</strong>s with an <str<strong>on</strong>g>evaluati<strong>on</strong></str<strong>on</strong>g> that protects <strong>the</strong> rights <strong>of</strong> settlers liv<strong>in</strong>g at that<br />

place and <strong>the</strong> rights <strong>of</strong> future generati<strong>on</strong>s and that balance <strong>the</strong>se rights. In o<strong>the</strong>r words,<br />

results reached by <strong>the</strong> acti<strong>on</strong>s/c<strong>on</strong>flicts also mean to take decisi<strong>on</strong>s for future<br />

generati<strong>on</strong>s as well as generati<strong>on</strong>s <strong>of</strong> today. In this sense, it seems necessary to make<br />

new arrangements by c<strong>on</strong>sider<strong>in</strong>g that spatial acti<strong>on</strong>s <strong>on</strong> urban place target to provide<br />

<strong>justice</strong> am<strong>on</strong>g generati<strong>on</strong>s.<br />

Plann<strong>in</strong>g decisi<strong>on</strong>s and <strong>in</strong>terventi<strong>on</strong>s <strong>on</strong> urban space determ<strong>in</strong>e not <strong>on</strong>ly <strong>the</strong> land<br />

use types <strong>of</strong> <strong>the</strong> area but also <strong>the</strong> level and form <strong>of</strong> relati<strong>on</strong>s between human be<strong>in</strong>g and<br />

nature and between human and human. In this c<strong>on</strong>text, both <strong>the</strong> plann<strong>in</strong>g decisi<strong>on</strong> and<br />
