These questi<strong>on</strong>s are directed towards c<strong>on</strong>siderati<strong>on</strong> <strong>of</strong> <strong>the</strong> c<strong>on</strong>flicts/disputes<br />
with<strong>in</strong> <strong>the</strong> <strong>process</strong> <strong>of</strong> adjudicati<strong>on</strong> <strong>in</strong> Turkish practice as based <strong>on</strong> <strong>the</strong> experience <strong>of</strong> case<br />
study area selected.<br />
1.4. Methodology<br />
As <strong>the</strong> case study, plann<strong>in</strong>g <strong>process</strong>es <strong>of</strong> Balçova and Narlıdere settlements <strong>in</strong><br />
between 1991-2003 were analyzed and evaluated with <strong>the</strong> aim <strong>of</strong> clarify<strong>in</strong>g <strong>the</strong> role <strong>of</strong><br />
<strong>justice</strong> c<strong>on</strong>cept <strong>in</strong> plann<strong>in</strong>g <strong>process</strong> over judicial c<strong>on</strong>trol. Acti<strong>on</strong>s <strong>in</strong> judicial c<strong>on</strong>trol<br />
<strong>process</strong> c<strong>on</strong>stitute <strong>the</strong> necessary amprical data required to make <strong>justice</strong> discussi<strong>on</strong>s <strong>in</strong><br />
plann<strong>in</strong>g <strong>process</strong> over c<strong>on</strong>crete events. In <strong>the</strong> exam<strong>in</strong>ati<strong>on</strong> <strong>of</strong> acti<strong>on</strong>s <strong>in</strong> <strong>the</strong> extent <strong>of</strong> this<br />
<strong>the</strong>sis, above menti<strong>on</strong>ed actors <strong>of</strong> plann<strong>in</strong>g <strong>process</strong> are classified as follows;<br />
pla<strong>in</strong>tiff/defendant parties represent<strong>in</strong>g <strong>the</strong> private pers<strong>on</strong>s and <strong>in</strong>stituti<strong>on</strong>s, experts as<br />
representatives <strong>of</strong> plann<strong>in</strong>g discipl<strong>in</strong>e, pers<strong>on</strong>s charged with plann<strong>in</strong>g <strong>process</strong> and<br />
approval authorities and courts as representatives <strong>of</strong> legal <strong>process</strong>. Claims <strong>of</strong> <strong>the</strong>se<br />
actors, as parties, c<strong>on</strong>stitute <strong>the</strong> primary data to discuss <strong>the</strong> chang<strong>in</strong>g mean<strong>in</strong>g <strong>of</strong> <strong>justice</strong><br />
and chang<strong>in</strong>g c<strong>on</strong>tent <strong>of</strong> <strong>justice</strong> demands. In this <strong>process</strong>, <strong>the</strong>re are data which are<br />
obta<strong>in</strong>ed <strong>in</strong> two different fields and exam<strong>in</strong>ed under different <str<strong>on</strong>g>evaluati<strong>on</strong></str<strong>on</strong>g>s. First k<strong>in</strong>ds <strong>of</strong><br />
data are <strong>the</strong> generalized <strong>on</strong>es that were obta<strong>in</strong>ed <strong>in</strong> order to exam<strong>in</strong>e <strong>in</strong> which subjects<br />
and how <strong>of</strong>ten <strong>the</strong>se actors <strong>of</strong> plann<strong>in</strong>g <strong>process</strong> have c<strong>on</strong>flicts. These data are used <strong>in</strong><br />
order to determ<strong>in</strong>e <strong>in</strong> which subjects, <strong>in</strong> which stage <strong>of</strong> plann<strong>in</strong>g <strong>process</strong> and how <strong>of</strong>ten<br />
acti<strong>on</strong>s do occur. In this extent, problems and c<strong>on</strong>flicts, which were occurred with<br />
demands <strong>of</strong> <strong>the</strong>se comp<strong>on</strong>ents exam<strong>in</strong>ed <strong>in</strong> plann<strong>in</strong>g <strong>process</strong> as a whole, can be<br />
determ<strong>in</strong>ed and discussed. Besides, <strong>the</strong>se data form <strong>the</strong> criteria <strong>of</strong> selecti<strong>on</strong> <strong>in</strong><br />
determ<strong>in</strong>ati<strong>on</strong> <strong>of</strong> which subjects and samples can be taken <strong>in</strong>to c<strong>on</strong>siderati<strong>on</strong> <strong>in</strong> detail.<br />
Sec<strong>on</strong>d k<strong>in</strong>d <strong>of</strong> data c<strong>on</strong>sists <strong>of</strong> <strong>the</strong> detailed data regard<strong>in</strong>g <strong>the</strong> case samples<br />
which were selected to make detailed discussi<strong>on</strong>s after general <str<strong>on</strong>g>evaluati<strong>on</strong></str<strong>on</strong>g> stage. In <strong>the</strong><br />
discussi<strong>on</strong>s made by <strong>the</strong> help <strong>of</strong> <strong>the</strong>se data, it is possible to determ<strong>in</strong>e <strong>in</strong> which forms<br />
and <strong>in</strong> which different c<strong>on</strong>tents right, equality, <strong>in</strong>terest and liberty c<strong>on</strong>cepts as<br />
determ<strong>in</strong>atives <strong>of</strong> <strong>justice</strong> c<strong>on</strong>cept have been used <strong>in</strong> <strong>the</strong> claims <strong>of</strong> parties. In Rawlsian<br />
perspective, a need orig<strong>in</strong>ated <strong>justice</strong> c<strong>on</strong>cept and use <strong>of</strong> this c<strong>on</strong>cept <strong>in</strong> <strong>the</strong> <strong>process</strong> and<br />
<strong>the</strong> existence <strong>of</strong> alternative <str<strong>on</strong>g>evaluati<strong>on</strong></str<strong>on</strong>g> possibilities can be discussed. Fur<strong>the</strong>rmore,<br />
dur<strong>in</strong>g plan mak<strong>in</strong>g, research, approval and implementati<strong>on</strong> stages, exam<strong>in</strong>ati<strong>on</strong> <strong>of</strong> <strong>the</strong>se<br />
