1/5000 approved by Council <strong>of</strong> Greater Municipality <strong>of</strong> zmir <strong>on</strong> 17.6.2002 numbered<br />

05/46 and implementati<strong>on</strong> plans scaled 1/1000 approved by Municipality <strong>of</strong> Balçova <strong>on</strong><br />

26.6.2002 numbered 45”.<br />

Pla<strong>in</strong>tiff parties were <strong>the</strong> <strong>on</strong>es who purchased <strong>the</strong> plots sold by Municipality <strong>of</strong><br />

Balçova <strong>in</strong> 1970’s but couldn’t have <strong>the</strong> title-deeds and <strong>the</strong> <strong>on</strong>es who had <strong>the</strong> title-deeds<br />

but left outside <strong>the</strong> boundaries <strong>of</strong> <strong>the</strong> plan.<br />

Defendant parties were Mayoralty <strong>of</strong> Greater Municipality <strong>of</strong> zmir and<br />

Mayoralty <strong>of</strong> Balçova Municipality.<br />

Pla<strong>in</strong>tiff party has emphasised <strong>on</strong> susta<strong>in</strong>ability <strong>of</strong> <strong>the</strong> adm<strong>in</strong>istrati<strong>on</strong> c<strong>on</strong>cern<strong>in</strong>g<br />

ownership and c<strong>on</strong>fidence to <strong>the</strong> sale procedure <strong>of</strong> a public <strong>in</strong>stituti<strong>on</strong>. On <strong>the</strong> o<strong>the</strong>r<br />

hand, follow<strong>in</strong>g po<strong>in</strong>ts were exam<strong>in</strong>ed c<strong>on</strong>cern<strong>in</strong>g plann<strong>in</strong>g procedure:<br />

1. There was a discordance between scales 1/25000 and 1/5000 and that<br />

discordance was c<strong>on</strong>tradictory to regulati<strong>on</strong>s and plann<strong>in</strong>g pr<strong>in</strong>ciples; 2. Includ<strong>in</strong>g <strong>on</strong>ly<br />

<strong>the</strong> lands under municipality’s ownership <strong>in</strong> plan boundaries was not <strong>in</strong> accordance with<br />

equality and <strong>justice</strong> c<strong>on</strong>cept, fur<strong>the</strong>rmore <strong>on</strong> those land that were sold to built social<br />

houses accord<strong>in</strong>g to subdivisi<strong>on</strong> plans prepared <strong>in</strong> 1969, a plann<strong>in</strong>g <strong>in</strong>terference should<br />

be realized accord<strong>in</strong>g to this goal; 3. Peacemeal plann<strong>in</strong>g approach has created<br />

implementati<strong>on</strong>s c<strong>on</strong>tradictory to equality and <strong>justice</strong> c<strong>on</strong>cepts and makes useless <strong>the</strong><br />

<strong>in</strong>tegrity <strong>of</strong> plans, <strong>the</strong>refore has caused today’s unplanned cities.”(Applicati<strong>on</strong> petiti<strong>on</strong>s<br />

submitted to 2 nd Adm<strong>in</strong>istrative Court dated 2.8.2002 with E.no. 2002/1042 and E No:<br />

2003/79)<br />

Municipality <strong>of</strong> Balçova claims that, this ownership discussi<strong>on</strong> should be<br />

<strong>in</strong>validated because <strong>of</strong> lapse <strong>of</strong> time after 30 years and parties are no more party <strong>on</strong> this<br />

case. Besides, it is claimed that, implementati<strong>on</strong> plans scaled 1/1000 are <strong>in</strong> accordance<br />

with greater scaled plans and Greater Municipality <strong>of</strong> zmir is authorized to pursue<br />

those plans, thus Municipality <strong>of</strong> Balçova is not c<strong>on</strong>cerned with this case. Besides,<br />

pla<strong>in</strong>tiffs do not have any relati<strong>on</strong> with <strong>the</strong> plans that are subject <strong>of</strong> <strong>the</strong> menti<strong>on</strong>ed case.<br />

Greater Municipality <strong>of</strong> Izmir, as defendant part, claims <strong>in</strong> <strong>the</strong>ir owner that; 1.<br />

The project developed for <strong>the</strong> university games is not c<strong>on</strong>tradictory to “equality”,<br />

“<strong>justice</strong>” and “public <strong>in</strong>terest”; 2. There is an accordance between Master Plan scaled<br />

1/5000 and implementati<strong>on</strong> Plan scaled 1/1000.<br />
