However, <strong>the</strong> size <strong>of</strong> <strong>the</strong> plot and <strong>the</strong> c<strong>on</strong>diti<strong>on</strong>s for c<strong>on</strong>structi<strong>on</strong> envisaged <strong>in</strong> <strong>the</strong> plan<br />

implicate certa<strong>in</strong> drawbacks. The m<strong>in</strong>imum c<strong>on</strong>diti<strong>on</strong> <strong>of</strong> allotment <strong>of</strong> 10,000 m2, shall<br />

give rise to <strong>the</strong> occurrence <strong>of</strong> jo<strong>in</strong>t possessi<strong>on</strong> and certa<strong>in</strong> c<strong>on</strong>flicts aris<strong>in</strong>g <strong>in</strong> c<strong>on</strong>necti<strong>on</strong><br />

with jo<strong>in</strong>t possessi<strong>on</strong>. The reducti<strong>on</strong> <strong>of</strong> <strong>the</strong> c<strong>on</strong>diti<strong>on</strong> for m<strong>in</strong>imum allotment shall be<br />

recommendable <strong>in</strong> order to alleviate <strong>the</strong> c<strong>on</strong>flicts am<strong>on</strong>gst <strong>the</strong> landowners and to ensure<br />

<strong>the</strong> improvement <strong>of</strong> <strong>the</strong> area as so<strong>on</strong> as possible. C<strong>on</strong>sequently, <strong>the</strong> porti<strong>on</strong> <strong>of</strong> <strong>the</strong><br />

subdivisi<strong>on</strong> plan that bel<strong>on</strong>gs to <strong>the</strong> pla<strong>in</strong>tiff is not c<strong>on</strong>sistent with <strong>the</strong> fundamentals and<br />

pr<strong>in</strong>ciples <strong>of</strong> city plann<strong>in</strong>g and public <strong>in</strong>terests.<br />

Resoluti<strong>on</strong> <strong>of</strong> <strong>the</strong> Adm<strong>in</strong>istrative Court<br />

In <strong>the</strong> adm<strong>in</strong>istrative courts, <strong>the</strong> decisi<strong>on</strong>s passed were <strong>in</strong> l<strong>in</strong>e with <strong>the</strong> majority<br />

op<strong>in</strong>i<strong>on</strong>s c<strong>on</strong>ta<strong>in</strong>ed <strong>in</strong> <strong>the</strong> report and c<strong>on</strong>sequently, it was resolved that <strong>the</strong> cases shall be<br />

rejected from <strong>the</strong> standpo<strong>in</strong>t <strong>of</strong> <strong>the</strong> pla<strong>in</strong>tiff party. The pla<strong>in</strong>tiffs <strong>of</strong> <strong>the</strong> seven <strong>of</strong> <strong>the</strong><br />

acti<strong>on</strong>s have submitted <strong>the</strong> case to <strong>the</strong> court <strong>of</strong> appeal and that at <strong>the</strong> current stage, <strong>the</strong><br />

appeal was approved by <strong>the</strong> Council <strong>of</strong> State. The demand for <strong>the</strong> revisi<strong>on</strong> <strong>of</strong> decisi<strong>on</strong><br />

submitted by <strong>on</strong>e <strong>of</strong> <strong>the</strong> parties was rejected. Up<strong>on</strong> <strong>the</strong> completi<strong>on</strong> <strong>of</strong> <strong>the</strong> litigati<strong>on</strong><br />

<strong>process</strong>, <strong>the</strong> implementati<strong>on</strong> <strong>of</strong> <strong>the</strong> c<strong>on</strong>cerned plans were <strong>in</strong>itiated. (The images <strong>of</strong> <strong>the</strong><br />

area are presented <strong>in</strong> Figure:4.7.)<br />

4.6. Olympiad Village<br />

There are two acti<strong>on</strong>s exam<strong>in</strong>ed under “olympiad village” title which have<br />

different characteristics and c<strong>on</strong>tents like; ownerships rights and objecti<strong>on</strong> to<br />

implementati<strong>on</strong> plans. The transacti<strong>on</strong> that is <strong>the</strong> subject <strong>of</strong> <strong>the</strong>se two cases has been<br />

started <strong>in</strong> 1970’s. Thus, most <strong>of</strong> data have been obta<strong>in</strong>ed from <strong>the</strong> <strong>in</strong>formati<strong>on</strong> files<br />

prepared by pla<strong>in</strong>tiff parties.<br />

Pla<strong>in</strong>tiff Parties and Development <strong>of</strong> <strong>the</strong> Case<br />

In 1970’s, with <strong>the</strong> decisi<strong>on</strong> no.3 dated 08.10.1971, Municipality <strong>of</strong> Balçova<br />

decided to subdivide and sell <strong>the</strong> build<strong>in</strong>g block no. 671 and plot no.94 (new no’s. 97,<br />

98, 99) <strong>in</strong>side <strong>the</strong>ir municipal boundaries <strong>in</strong> order to prevent <strong>the</strong> c<strong>on</strong>structi<strong>on</strong> <strong>of</strong><br />

“gecek<strong>on</strong>du”. Title-deeds <strong>of</strong> some plots could be taken before military <strong>in</strong>terventi<strong>on</strong> <strong>in</strong><br />
